They should try some personal responsibility
That seems the important question in this case. Did the Beer-O-Ramas outside the reservations break the law? Is it illegal in the state to sell alcohol to Indians or it only illegal to sell it on the reservation? If these businesses refuse to sell beer to Native Americans will they run afoul of anti discrimination laws?
If it is legal to sell beer to Indians then I'm not sure the beer companies are to blame. If they refuse to ship their product to towns near Indian reservations, are they allowed? Can a company refuse to sell their product to one group because they believe they can't use it correctly and it gives the company an image problem?
Unless the existing laws are changed to ban selling beer to the local Native Americans, I don't see how the beer companies and distributors are liable. As the law is now, the beer stores will face discrimination suits and government fines if they refuse service to Indians but serve the Whites and Blacks.
I'm not sure a lawsuit based on, 'Beer companies should of known about Indians and booze, they should of restricted beer purchases throughout the region', has very much merit.
Depends on which law. The tribes have been having this battle for years. One of the complaints I've heard is that Nebraska doesn't enforce their own laws in White Clay. It's against the law to sell alchol to a drunk person...yet it happens in White Clay and no one is prosecuted.
I do not think it is illegal to sell to Indians. It's illegal to sell it on the reservation...which is why White Clay is located several feet across the border from the reservation.

I don't either. I think the tribe is trying a new tactic in their fight to get White Clay shut down. It's definitely getting attention drawn to the issue.
I can see how having a town as a giant booze mill could be a problem. Enforcing the existing law on selling to drunks might work. They will have to send more cops to the town. A drunkard wanting his beer will not be happy when told to take his drunk ass home empty handed. It's not always easy to judge when someone is intoxicated, I would cut the store clerks some leeway for mistakes.
Many places have the local store that is just trouble. I imagine it's harder when it's a whole town skirting the law and being a public nuisance.

Those people are about nothing but money(probrably for their beer fund) Since they are all not smart enough to realize that when they lift the canof beer and put it up to their lips that they are the ones digging their own graves. There is a beer ban on they res. So each and every one of them should be prosecuted for breaking the law. Child protective services should be taking all the children their away from their stupid parents. Those people dont deserve children.Greedy ,money hungry ,alcoholics is all they are. They are worthless,they should all have their reproductive organs removed, so they can no longer breed their stupidity and destroy even more lives.I think the store in their area ought to not allow beer sales to members of this looser tribe, turn them down and say no I am not going to give you weapons to use in court against me,loosers! Then the loosers can try to file charges on the store for not selling them alcohol.The 2 cases will butt heads in court and both get thrown out. Nobody ever held a gun to their heads and made them walk their fat butts down to the store, Oh wait a second since members of this tribe are so pathetically STUPID they probrably DROVE their fat,stupid pathetic,DRUNK allready selves down to the store. Nobody held a gun to their heads and made them walk to the beer cooler and grab 12 cases of beer for dinner. They were just too worthless and weak to walk right past the beer.They should have cops patrolling the store and every time they see someone from that tribe reach for the beer club them over they head and say NO STUPID FOOD THATAWAY AND DIRECT THEM AWAY FROM THE BEER.So the next time my child or husband get constipated Im gonna consider suing the cheese manufacture. Of course that is just an example but just as rediculous! That tribe really ought to consider blowing their selves up, they wouldnt be "struggling" any more and causing problems for everyone else.
