That seems the important question in this case. Did the Beer-O-Ramas outside the reservations break the law? Is it illegal in the state to sell alcohol to Indians or it only illegal to sell it on the reservation? If these businesses refuse to sell beer to Native Americans will they run afoul of anti discrimination laws?
If it is legal to sell beer to Indians then I'm not sure the beer companies are to blame. If they refuse to ship their product to towns near Indian reservations, are they allowed? Can a company refuse to sell their product to one group because they believe they can't use it correctly and it gives the company an image problem?
Unless the existing laws are changed to ban selling beer to the local Native Americans, I don't see how the beer companies and distributors are liable. As the law is now, the beer stores will face discrimination suits and government fines if they refuse service to Indians but serve the Whites and Blacks.

Depends on which law. The tribes have been having this battle for years. One of the complaints I've heard is that Nebraska doesn't enforce their own laws in White Clay. It's against the law to sell alchol to a drunk person...yet it happens in White Clay and no one is prosecuted.

I do not think it is illegal to sell to Indians. It's illegal to sell it on the reservation...which is why White Clay is located several feet across the border from the reservation.

I can see how having a town as a giant booze mill could be a problem. Enforcing the existing law on selling to drunks might work. They will have to send more cops to the town. A drunkard wanting his beer will not be happy when told to take his drunk ass home empty handed. It's not always easy to judge when someone is intoxicated, I would cut the store clerks some leeway for mistakes.
Many places have the local store that is just trouble. I imagine it's harder when it's a whole town skirting the law and being a public nuisance.
Those people are about nothing but money(probrably for their beer fund) Since they are all not smart enough to realize that when they lift the canof beer and put it up to their lips that they are the ones digging their own graves.
