Unfortunately, this type of story is more the norm than the exception in most cities. Copes are a brotherhood of psychopaths. Anyone wanting to join law enforcement to make things better and proper, is quickly recognized as a boat rocker and troublemaker, and is quickly alienated then removed from service. Can't have anyone busting up that policemen's union of psychos. I feel sorry for the naivety of those who still think the police are there to protect them. Despite my detestation of guns, I'd feel safer protecting myself with one than depending on the criminal police to keep the "bad guys" away. Guilty until proven innocent. First of all she committed a crime. The crime was obviously not a big deal. If she had ID they would have just done a quick check for warrants or whatever and let her go as they did her friend. The officer did his job. In this case there was no room for common sense.

would it be a crime if someone "trespasses on your property"? I guess not, but in my world "trespassing" is a crime. You do have to carry an ID in America if you dont want this kind of thing to happen to you.
I constantly hear we can not afford health care, food stamps, etc. As a tax payer, I can not afford to see my tax dollars wasted so some loser can play bully behind a badge. And all of the other public servants aided and abetted his unethical behavior. If the police want the support of the public, they need to remember who they work for. If they have time for wasting money like this, they are telling me we have too many police, and need to cut their budget.

during a time i was not employed a police officer illegally took my california id card. i did not at the time have the $25.00 replacement charge for a new id. for many months i was consigned to not having an id card because of the lack of finances to replace and when i contacted the police their response "was why don't you just go and get another id card?" what was my negligence in not having an id card? should i have to stay in jail because of law enforcement illegality?
i was doubly penalized. not only by your standards i should be jailed, in california you have to have state id, either a state id card or a state drivers license to gain employment. so by not having an id card or the means to get another one i could not get a job legally in the state of california. the police know this because one of the first things they ask you is your employment status (this is the reason i have learned to not answer that question). and no, you don't have any legal obligation to answer that question. the officer knew what he was doing when he took my id card. he was keeping me in poverty.
the police only have the right to keep you long enough ascertain your identity. in today's technological policing that takes no time. she should only have been kept a couple of hours max. if she was registered at a nearby hotel they could have verified that quickly with one phone call (most police department pay for their officers cell phone bill in lieu of walkytalkies).
there were many alternative ways to have handled this situation. to intimate that the way the police handled is the only way is misguided at best.
She was not charge for not carrying an ID. She was charged with trespassing.

Having said that, some department policies are to detain that person until ID can be established. I kind of agree with that policy. My brother was arrested for shoplifting. He used my name. Police never bothered to establish ID when he didn't provide one. Then my brother skipped his court date (of course)...
So, a warrant was issued in my name for failure to appear. I was half way across the country. I had to drive (very carefully) back to Florida to prove I wasn't the one arrested.

Which policy is right? Should we start a national database of fingerprints and allow cops to verify ID through a handheld device? Every idea will find a large group of people blasting it as wrong. But until we find a solution that works, stupid things will happen to people.
Which is the more serious crime? In a park after hours, no ID or the police showing how well they are at being pigs? When bogus cases like this are dismissed the officers should at the very least have to pay court costs if not restitution for time misspent.
In fairness to cops, all the ones I've ever met have been very professional. Haven't run into big city cops, but I still look to the police for protection, not a shake down.

The only 'crime' she committed was being in a park at 3 a.m. - the lowest level of sub-misdemeanor possible! Not having I.D. on you is not a crime. And, by the department's own statement a person is permitted to have someone retrieve their I.D. if asked for it and not on their person. The fact that Durrel felt compelled to charge her for her non-crime shows a great deal of personal insecurity on his part.

I've never encountered such low life cops in NYC or anywhere I've traveled but, I guarantee, if he ever did something like this to me while in the city, he'd be up on charges in a New York minute and he'd be turning in his badge in no time. What he did was, quite simply, unconscionable and beneath contempt. The entirety of New York should be ashamed and embarrassed at this kind of conduct from one of their supposed "finest".
The police conduct personality tests before accepting recruits. They want the 'right kind' of police officers... a good example of which is found in this very headline.
The only effectiveness I've ever seen in changing police is to remove all upper administrative personnel and demand a change from the new administrative personnel, hiring the right people through careful selection.

Trespass is a misdemeanor crime. However, the police could have found out who she was, and whether or not there were any warrants out on her just with her name. Unless she was withholding information (like her name), would they have to wait to have her 'processed' by a judge.
I have to agree that it was either a slow night at the precinct, some cops were tripping on their own egos, or they were just being total asses. It cost more to keep her and "process" her than it would have for them to do their actual jobs.

There is not one state in the USA that has a "law" that requires you to have an ID let alone carry one. You need a photo ID to do certain things in this country, however just walking around is not one of them . Anyone who thinks otherwise is a fool who does not know what they are talking about.
Try being homeless and then getting an ID. In order to get ID, the state wants an address. No address, no ID...........No ID, no address, no welfare checks or social security checks. The government wont mail a check to you with no address. They like it that way, as then some that would be eligible for a check do not get one as no address. Uncle Sam likes that aspect of no ID, NO address.........It saves them money.
I dated a Sacramento Dispatcher, she told me, the cops she works with are worst then the inmates. For all the people who wrote that she deserved what she got, I hope you are put in a situation where your arrested for something and moved around for days in the jail system until your released so your able to walk in her shoes to know the feeling of helplessness. If I read this story correctly, she said the officer put words in her mouth when she address him as "SIR". as if she was calling him a foul name. This happens, it justifies for the officer to fuel his mean and hateful personality. I was drinking beer and listening to country music and two young men started sh*t with me about the music I was listening too. A fight broke out, a police office came, I was arrested, the officer told me he will have the women with the men testify in court that I pulled my d**K out and have me put away for 8 years. my reply was, "SO O.J. WAS FRAMED". America is not the greatest country in this world, it is just okay. Over 400 innocent people have been freed from prison from DNA. DA's and Police Officers lied in U.S.Court to get a conviction. How many innocent people has the U.S. put to death because of Police Officers and DA's who lied and fabricated evidence to get a conviction. All it take is one Officer (and the ones who watched from the side line) like this one in this article to destroy a lot of INNOCENT LIVES. This women or any other person do not deserve this kind of justice.

If it is a crime of "trespass" to be in a public park, then the law needs to be changed. A "public park" is owned by the public. Thus, a person who is in a public park, is in a park that he/she owns. Thus, no trespass. If there is a law not to be in a park after certain hours, then it is a violation of that particular law. However, if the law is not conspicuously placed, then visitors from another state would not know of the law since in most states, public parks are, in fact, public parks. This girl should not have been arrested, and yes you idiots, common sense, does matter. Most people who don't have it can't recognize it.
As to the ID, if it is a law making it mandatory to carry an ID, virtually every American under the age of 15 should be in jail. There is no law that illegal aliens carry an ID. Why you might ask you mental giants? They are illegal, they should not have an US ID.

All the way back in 1987, a co-worker of mine was nearly arrested for just such a thing. We saw a mutual friend in the back seat of a cop car in the parking lot of the restaurant where we worked. We were laughing at our friends misfortune when one of the cops got mad and demanded to see my co-worker's ID!! We had nothing to do with whatever was going on, we just happened to know the person they had in custody. When he asked why, he was nearly tackled by the now-outraged officer! Turns out that cops in WA state have a right to demand to see your ID anytime, for no reason at all. So much for the Fourth Amendment!!!
Sorry, you might not need to have an ID, but she is stupid to not carry one because you don't know what could happen. What if someone had stolen it and then committed a crime, if that person looked like her. I carry an id on me even if I am going a block away. I have been stopped by cops and accused of skipping school (I'm much older than that). What if she had been killed and no one knew her identity? Would that make you feel better if that happened and she couldn't be identified?

On top of the cops bad behaviour there is also the forgotten laws of having to cary an ID and not being able to be in the park at night. What happened to freedom.
Just the other day I went to walk my dog in a park a mile away at 7 pm with my son. The park ranger came and told me it was closed after dark. This park has never been closed before and I am a regular who has visited doing night runs for years. This year they added a state fee to use the parks. It must have been enough to afford the park ranger to come tell me I no longer have the freedom to walk in the park at night. Pay more and get less! What makes it worse was that the park area was donated to the county by some nice folks years ago -- not the state. The park ranger of course has a house on the park. I guess someone gets to enjoy the waves lapping the beach at night.
First of all, I had to go to City Search to find out what the hours are for the park. The Parks website doesn't list them anywhere I could see them, and I doubt that any signs posted on the street are easily visible at night. There is no way of knowing what the hours are for an open stretch of land, 4 miles long and only about 500 feet wide. If you're standing across the street you can see the boardwalk and the Hudson. It is simply too accessible if this is the response towards anyone who wants to see the river a little closer.
Taking a simple walk in the city that never sleeps should never elicit that kind of a response from a cop. Any reasonable person who didn't have an axe to grind with society would have simply told the two kids to move along, the park is closed. But instead, this policy wonk with a hard on for throwing the book at every person he meets (because he likes the power) decides he needs to run background checks on every person who jaywalks, walks on the grass, or sneezes without covering their mouth - hoodlums!! He easily could have entertained this girl's need to get her ID from her hotel across the street. But he was a dick instead. Because of a lack of humanity and a zeal for crushing people under his thumb, this idiot pig wasted our money, this girl's time and goodwill, and spread more derision and bad feelings about cops.
Well it seems clear, officer a-hole from precinct X should not be allowed to tromp on people's rights anymore. Perhaps a nice stint on desk duty will readjust his attitude to Serve and Protect that is the credo of most police forces around the country. A good cop is in a noble profession that doesn't get the respect they deserve most days. A bad cop just needs to find another career. It sounds like internal affairs needs to put an undercover in the park without ID and make sure they've got enough on this cop to show him the door. Even if what he did was technically legal, it showed very poor judgement.
Only experience I have had with big city cops was in Boston, and I could see something like this happening. I was pulled over for a "broken tail light" at about 12am. The officer wanted to search my vehicle for drugs or something but for some reason sped off shortly after asking the question. I checked my lights after the cop left and both my tail lights were working, as were my blinkers and headlights. Guess they didn't like someone with Vermont plates driving around in their city unsupervised or something. Cop wouldn't have found anything if he had searched my car since I have never been involved with any type of drug use in my life, and I have no criminal record. I'm just glad it didn't head in the direction I thought it was going after he mentioned I had a broken tail light.
I feel bad for the girl since right now it is nearly impossible to find any type of Design job right out of school. I have a BFA in Graphic Design from one of the top schools in the country and I am still looking a year and a half and over a thousand applications later. Hopefully the jerk that did this didn't cause her to miss a job opportunity... for her sake.
Ok, ok...there is no misdemeanor for not having an ID - you can be detained as a driver for not having ID, and you can also be detained for refusing to give your name and/or address.
First, what the United States Supreme Court said. What the United States Supreme Court held in Hiibel v. Sixth Judicial Dist. Court (2004) 542 U.S. 177, was that a state could make it a crime for a person to refuse to identify himself (i.e., tell the officer his name and address) when lawfully detained for criminal activity. Note that the Supreme Court did NOT say that any kind of identification papers could be required, nor did they say that police officers could ordinarily arrest someone for refusing to identify himself absent a state law permitting that arrest.
This supreme stupidity is obviously not just on the part of the police officer. The individuals who think this is the fault of the Obama administration need to come back to earth and get their head out of Uranus.

That said, this story should be a very simple lesson for anyone in this country: Carry some form of ID! I mean, they're in a public park after the park is closed, so it's not unusual for the police to ask for ID in a situation like that. And the guy who had ID was let go right away. It's sad that the girl had to go through what she did, but if she had her ID with her, well, problem solved. I wish I knew what everybody's hangup is about having to carry ID on them. That simple act will solve about 100 times more problems than it causes.
When an officer, is violating the Constitutional Rights of another individual, he is NOT protected by Legal Impunity. He can be arrested for assault with a deadly weapon, and charged with as may as 10 different violations, and is personally liable as is his supervisor, the prosecuting attorney's office, and the Department for malpractice. Look out, someone is going to get sued, and I would file criminal kidnap charges with the State Police and ask the Justice Department to handle Federal Charges.
This is such a blight on officers who are really trying to accomplish something good, that every officer on that force should go home and STAY home (for what this nut-job, gestapo-wannabe has done to their reputations) until he is fired and restitution is made to Ms. Zucker.
They should say clearly through their actions that this is NOT what we are all about, and the force needs to get busy reassuring the taxpayer. Until that time - We're done.
This is why it is so important for civilians to be able to record on video all encounters with police. They film their encounters with us for evidence, but then they get to control that evidence don't they. If an officer is abiding by the law and conducting him or herself professionally then they have no reason to react furiously to a video. Taping an officer at their job IS NOT resisting arrest or refusing a ticket. It is insurance that you won't be taken advantage of. I think that every car ought to be outfitted with a camera that points towards the side windows. If they know they are on tape, maybe they'll behave themselves a little better.

She technically broke two laws here being in a park after dusk and not carrying an I.D.. it is law that all adults must carry a state id or drivers liscence with them at all time. But i do think two days in jail is a little long for this. My biggest concern is with Mr. Dwyer and his editor. Further, the park closes at 1am not dusk. Unfortunately the signs are either not obvious or not present. Also there are clearly no hard barriers such as fences or gates that would keep unwanted people out after hours. I'm sure this cop could make a living kicking people out of Riverside Park on any night of the week. There are likely dozens of "trespassers" a night.
The discretion whether or not to follow through on prosecution of any crime rests with the officer. An appropriate response is to tell them to go somewhere else - not demand ID and take one of them to jail for two days. I have been in plenty of situations when a cop has told me some public place was closed and that I should move along. Never have I been given ticket for trespassing!

Allow me to explain in simple terms so that those screeching abouts rights and law suits can understand.
When this young lady was detained for a crime, tresspassing. The police officer had due right to know who she was and to be able to confirm who she was by her producing legal identification whether it be a driver's license or some form of state ID. Without production of said ID she could be and she was detained.
Yes, I agree that this could have been settled in a much simpler manner and would have cost much less on her part and on the part of the city. But, it was not illegal, unconstitutional, or anything similar.
And for those of you who want to roll up every officer and every precinct and label them based on the actions of one officer or the inefficiency of one city's operations; I suggest you get to know some of your local law enforcement. Most are decent hard working people who do their best to treat everyone they encounter reasonably and respectfully. Too bad the people they serve aren't that kind to them
Ok, so she and her friend were unknowingly in the park after closing hours and the police came by. The police have every right to do so, and as these 2 were technically breaking the law, the police have every right to ascertain their identity and check for warrants, etc. However, with that being said, she should have been detained ONLY the length of time it took her friend to run across to her hotel and grab her ID and have it checked. We're talking 30 minutes at most. If the hotel were a ways away I could even see taking her to the station and holding her for up to an hour while the id was retrieved - again, that's all well within the rights of the police on the basis that she was breaking the law in the first place. 36 hours is beyond any realm of reasonable - not to mention the costs of transferring her back and forth between stations (why again?), etc. Other officers were aware of the ridiculous situation, and one would like to assume that they are also aware that the department allows others to fetch id's in these situations, yet NO ONE spoke up?
I don't think this is lawsuit worthy but I do sincerely hope she lodges a formal complaint against the arresting officers and that this gets investigated.
Here is an interesting link, Edward Lawson is the man responsible for us not having to carry ID, This LA Times story is about how he was arrested years later for basically the same thing. The charges were dropped thanks to him and his landmark Supreme Court decision.

We had better be very careful about what we are allowing to happen to our country. I don't always have ID on me and I don't intend to do so when I feel it is unnecessary.
One peculiarity I have noticed over the years. Most municipal policemen, county sheriffs and sheriff deputies, are generally much sorrier, much more inept, and much more dangerous, than "state highway patrolmen". This seems to be so, at least for me, no matter which state I happen to be in.
So it is A OK to not have an ID if you are an illegal immigrant in the USA, but if you are an actual USA citizen by God you better have that id on you. What's wrong here people? Why are so many of you willing to accept that we as Americans no longer can expect the freedom to simply go for a walk without our ID and the fear someone in "authority" might ask for it? This is wrong on principle! None of us must by law carry ID on our person everytime we leave our homes, and no one can ask to see ID without due cause, based on real law. Why does anyone think this is ok, that we who live in a free society should be arrested for having no ID? I show my ID on the rare ocassion I write a check, I show ID when asked if circumstances involve my money and my bank account. I show ID at the liquor store. I carry ID when I drive. And how is it that anyone can be tresspassing on public property? It doesn't sound like the two young people were being difficult, and Bad Cop was trying to goad the young lady into saying something he could justify his actions for. He knew he was wrong, but not man enough to stop.
I would question the constitutionality of a law in any state or city that says everyone must have ID on their person at all times. There are countless reasons why it is a good idea, but there is only one reason necessary to explain why it is must never be law - it is an affront to our rights as free citizens in a free society.
Tell that to the one who pulls you, a friend or family member from a burning car wreck, or helps a stranded motorist during a deadly cold winter white-out. I could go on and on with various scenarios, but the receiver probably won't think it a rational retort because of bias.

Notice that the other cops know this officer is a problem, but didn't say anything to stop him. Hell, even the supervisor didn't stop him from abusing his power. The supervisor should have killed this when it got to the precinct.
As for needing ID, none is required unless he is going to write her a summons. This offense is less than a parking ticket. So why did she go through central booking?

You should have an id if you are a stranger in a big city. She did...left it in her room...her friend should have been allowed to retrieve it and get it to the police.
The fact that they held her for something that could easily have been dismissed as accidental (did the park have signs? If not, how could she have known if she wasn't from around there?) is just another example of bad cops making good cops look bad. He should be disciplined, if not fired, and the others should grow some so they can stop it from happening again.

I'm sure there are lots of good cops but this type of police insanity is happening all too often. A warning would have been sufficient, ID or not. I'm not normally sue-happy, but in this case, I hope some lawyer will give this police department a lot of grief. Apparently, public outrage makes no impression. My original comment was pointing out that undocumented residents/illegal aliens have more rights and receive more benefits than most Americans citizens....particularly this visiting college student. How many illegals trespass at your local Home Depot? I don't see the police or INS in the parking lots asking for ID.
People need to accept that we live in a corrupt fascist corporate state and along with it comes a thug/gang type policing system that is made up of stormtroopers that feel they are above the law they are supposed to enforce. I don't know about you, and I don't blame ALL cops, but when I'm out in public I always assume the police are my enemy - it seems clear that police are much more likely to hurt you than the help you... I don't like saying this because my family has a long history of cops, from beat cops to a police chief but I do think this is what America has come to.
I think this woman should lodge a complaint against the cop for harassment (not the ticket but the unlawful imprisonment for 36 hours) and she should sue. She might even win and I hope she does as this is probably the ONLY way to change police corruption and dereliction of duty.
They need to start fining (or firing) the officers that do such foolish things.... why wasn't he out looking for the criminals that were out stealing, raping and murdering others while he was "busy" with this wanton who didn't have her ID handy! I agree - he was within his rights to stop them as they were in the park after hours. A simple pointing that out would have probably done the trick. But even if he decided to go further, minor trespassing gets a TICKET similar to a speeding or parking ticket. It does NOT get you hauled off to jail.
The was also in his rights to ASK who they were, their address, etc. But as to having ID on them ... that is NOT a requirement in this country. While it may have been easier, the burden is not on the citizen, it is on the officer to behave in an appropriate manner.
You should have noticed the victim (and yes, she WAS a victim) offered to send people to her hotel to get her ID yet NO officer allowed this to happen.
There are a great many good, honest and decent cops out there. I know quite a few. This one, and the ones who stood by and watch, do not number among them.
Jailed for no "ID"? Where I live, if you don't have your ID on you and the cops want to know if you are who you said, they run your SS number. NOT to hard to do. As long as you can answer some questions that pertain to that personal info, usually you are OK. While there are some good cops, there are also bad ones. Not to long ago, where my wife works, was robbed at gun point, The young lady that was working had the gun put in her face then locked in the bathroom while this person took several thousands of dollars.When she got out of the bathroom, called the cops, it took them two hours to respond to a armed robbery! We live in a relatively small town, I have checked and there was nothing else going on that night that would delayed them for two hours. And they wonder why people want to carry guns.

Why didn't her friend get her ID and go to the police station? Why didn't the friend who got the ticket not ask basic information of where she was going to meet her? I carry my ID to avoid these types of problems because some cops are stupid.

No... I base it on the actions of most of the local law enforcement I've had occasion to deal with for most of my adult life.
Some of the highest percentages of mental illness, spousal abuse, suicides... the numbers don't lie. I find most of them to be egocentric, overly-arrogant, downright rude, abusive, and most seem to live in an alternative reality.

The trouble with sending her to jail for not being able to produce ID is that it's not true that she couldn't produce ID. She just couldn't produce it immediately. Instead of waiting fifteen minutes so her friend could go to the nearby hotel to get it for her, the officer arrested her for not producing an ID that she could have shown if he'd had just a tiny modicum of patience and respect.

Now, do you think it would be okay for her to have said used her sister’s name, DOB, address etc. fail to appear or pay on the ticket and now her sister is sitting in jail because the cops just took the criminals word for it? The police are and have been abusing their authority for a very long time.
All this officer had to do was call up the hotel to confirm who she was and the room she was staying at. Then another option would be to run her name, bd, and ss # and confirm it that was as well, or have them call a friend or family member. Arresting her was just wrong and stupid.

slow down - if you know that with a misdemeanor offense like trespassing AN ID allows the officer to fill out a CITATION and let you go.
But with out an i.d the officer doesnt have to take a risk that your telling the truth and can book you into jail to have you formerly i.d.ed and then the officer is contacted with your id and you get released.

A misdemeanor crime is one where the officer is the witness and he doesnt have to take you at your word. Meaning most jails dont intake misdemeanor suspects how have an valid i.d. or d.l
I take it by your posts that you were both there and "know for a fact" that she gave the officer(s) here name? If you were then your post is valid. If not it is your opinion based on the fact that you'd like to be able to do what you want to do and when you want to do it including breaking the law. Good luck with that and let me know how it turns out for you will you? Speed is a ticket-able offense as is trespass. Yet if you fail to provide verifiable information to the officer who stops you for speeding so they can verify you have a valid driver license, you will in most cases go to jail and post bail. I speak from 26.5 years of experience as a law enforcement officer in 3 different states and not from what "I think is true" or "what I want to believe."
Now the facts are; (a) this young lady failed to properly identify herself and was arrested. (b) She refused to properly identify herself and was arrested. (c) She did something that the writer of this article left out or was not aware of and was arrested. (d) The officer(s) involved abused their authority and the I.A. will prove this.

Denise--yes, the young woman is "accused of calling the police officer names." When a police officer knows darned well that he is doing something he should not, then he will try to manufacture something--they will beat someone yelling "stop resisting" so that the witnesses can be asked "did the officer tell the person to stop resisting" and the witnesses will have to answer "yes."
In this case, any witness would be asked "was the person told not to call the officer X." The witness would have to answer "yes," and would be cut off before the witness could say "but I didn't hear her use the word." Even if the witness said that, the point would be ignored if people (like you) want to assume that the word was used.
There are many fine officers--sadly, there are quite a few others who have figured out what they need to do to get "plausible deniability" in case of a complaint or how to arrest people simply because they want to arrest a certain type of person. Some like to lock up young women because they get off on seeing them locked up.
People scream about "unions" and "tenure," but how often do they scream about police officers' unions protecting officers until the bitter end (even when the officers are obviously guilty) and even when officers have the equivalent of tenure (though it is called "seniority"). If all the unions are to be dismantled and all the teachers are to be denied tenure--can we start making police officers responsible for such complaints and more easily fireable?
If police officers are made more easily fireable for such abuse of power, I think a lot of the rest of us would give up a lot to see that happen. There are enough fine officers left to do an excellent job of protecting us once the bad apples are gone.

Riverside Park is known for its Drug Activity, illicit sexual activity and various other Criminal activity after the sun goes down. While it's true the girl should not have been jailed for 2 day, the officers may have saver her life. Her "so-called friend" could have gotten her I.D's and taken them to the Police. Again, she should not have been jailed for 2 days but it's better than her being found as an "Unidentified Female Body" in the park.
Well, if she is such a criminal that needs to be held for 36 hours and transferred from precinct to precinct, why don't you volunteer all your tax dollars to pay for it? The rest of us can see our taxes go toward something that could actually benefit us as citizens, or better yet, we can keep that portion in our pocket.
That whole ordeal was ridiculous! If you read the article, policy would have allowed that officer to wait while one of her friends got her ID. The 15 minutes it would have taken to wait for that would have saved the city of New York could have saved on processing and court costs.

If the event went down as this young woman describes, then this police officer is a THUG, and needs to be disciplined. If he has a record of such senseless arrests, maybe he needs to go back to police school, or possibly taken off the streets. In addition, I hope this is an experience that shows other more 'responsible' peace officers to question such a ridiculous arrest before it brings embarrassment and shame to good officers who are trying to do a decent job.
You don't get what really was happening. This is called a shakedown. The bad cop wanted a payoff to let her go. Since she did not offer $100, she was taken in. the reason that nobody said anything is because it is so common an occurence.
I am aware of this exact type of thing happening at least 2 other times - all in NYC. Bloomberg has a very corrupt police force in NYC - and it probably has always been corrupt. The only other place this corrupt is Louisana. Try driving down I-10 with out of state plates and you will find out.
Just remember - you have to always carry a $100 bill on you in NYC - or you run the risk of this happening.
From the treatment of my daughter, who looks Spanish, and some of her black friends from college, we have a serious profiling problem peppered with serious racism within our public safety officials. Until my blonde haired blue eyes husband takes control of the situation the police treat her badly just because of her looks and the company she keeps. Go ahead and deny it, much like Cain does, but all the data show I am 100% correct about this. What mandatory programs do the police have in place to correct this blatant racism? Whether it was wrong or not, she did this to herself. She was in a closed city park after hours with no ID and she expects nothing to happen. Not very bright. If you are not smart enough to stay out of areas that are closed after hours what do you think is going to happen. She should have been arrested for trespassing as the very least.
There is no law requiring a person to show ID in NY state.
Why was her friend allowed to leave unrestricted? He was "trespassing" on PUBLIC property as well. And please, try real hard to remember there is no law requiring you to have papers on you.

What kills me is my brother in law is a cop in Brooklyn, he is always in a great mood and tells about how much he loves his job. I couldn't tell you a single negitive thing he has done or said since the day i first met him 11 years ago. The only time he hated his job was after 9/11 and spending 16 hours a day at ground zero and seeing the things he had to see...BUT he never lost faith in his work, his fellow officers and doing what he knew was right. This handful of badge carrying jerks are giving the heart of Great Men and Women a bad name and should be punished to the Max of what the law will allow.

If I am getting on a plane and you get pissed because you think it's against your "rights" to be asked for proof of some kind, I don't want you on the same plane I am on. Do you feel insulted? To those who think that they don't have to identify themselves to a law enforcement officer in "any state" in the United States you should read this or you can remain ignorant of the law, your choice: http://en.wikipedia.org/wiki/Stop_and_Identify_statutes. The U.S. Supreme Court says that if you are detained by law enforcement for a suspected crime (trespassing is a crime) then a person must identify themselves to the officer(s) detaining them. If they can not or refuse to do so then the officer has the right to detain for a reasonable period of time to identify the person arrested/detained in the "Terry Stop." Also that same person if the refuse to identify themselves may be in violation of the crime of delaying a police officer or obstruction of justice. The park was apparently closed and the officer(s) were enforcing the law....PERIOD....
Additionally to the person who said that in New York you do not have to identify yourself to the police, PLEASE READ THE ABOVE! New York is one of 13 states that as of February 2011 YOU DO HAVE TO PROVIDE IDENTIFYING INFORMATION UPON DEMAND FROM A POLICE OFFICER. Identifying information includes but is not limited to; Name, date of birth and address. Much like in Nevada (or most other states) a person issued a citation does not have to sign said citation, it is their right to refuse to sign it. However since their signature is simply a promise to appear in court or pay the fine by a certain date, if they refuse to sign the citation they are leaving the officer with no choice but to arrest them, take them to jail and after booking they may post bail.
Now! Having said all this; I was not there, was anyone who posted here, there at the time this young lady was arrested? If not than all we have is he said she said and her friends heard this and that. In other words NO FACTS. The officer, much like the suspect/young lady in this case is innocent UNTIL PROVED guilty, not Guilty until they can prove themselves innocent just because some said it was so. While it "WOULD APPEAR" that the officer(s) used poor judgement in this case, we do not know what department policy is nor what other circumstances may have existed that caused the officer(s) to make the decision to arrest and detain.
If anyone has an true indisputable facts please post them, if not all our opinions and armchair quarterbacking that the officer(s) should have done this and not done that and that the suspect should have done this and not that is pure speculation. All we know is what someone was told happened by one party involved who has everything to gain by lying and nothing to gain by telling the truth, if the truth shows that the officer had just cause to do what they did.
In New York the city that never sleeps, who knows a park closes at 1:00AM. Bogus excuse to harass someone. The cop thought he was dealing with punks. Ernie-201266 having to provide identifying information and requiring to show proof of identification are two different issues. All she is required to do is answer the officers questions as they pertain to her identity. No state or Federal law requires to show proof (papers); officers depend on this ignorance. Detain if they suspect she was untruthful is one thing getting the NYPD shuffle is harassment. Her friends probably could not locate her to provide the Identification and get her released she was being shuffled between precinct's. Like another poster stated we were not there and do not have all the facts. Hopefully Internal Affairs will sort it out.
@Ernie-201266 Well... Let's start with the facts. FIrst of all, it says you have to identify yourself. It then goes on to say that information can include name birthdate and address. It does NOT say you have to show any form of identification. You can give them the information and they are required to ascertain it's authenticity. That would be the part about detaining them for a REASONABLE period. The part about refusing to identify one's self refers to refusing to give your name and other the law information to an officer. This whole incident is stupid....and then the anti-immigration people in Alabama and Arizona want police to arrest every one who does not carry an I.D. in their state. Of course, what they do not admit openly is that their law seeks to apply racial profiling in the request for I.D.

Why should the officer be fired???? They were doing their jobs by asking her for her ID. When they ask for your ID it is done so that they can check your name and make sure you are not wanted for any crimes. How are these cops to know whether or not she was telling the truth about her name and DOB? USA is great- In general, you don't have to provide proof of your identity upon demand in New York State. Maybe you would like to make that a law. I believe they have in other states. But it is not against the law to walk around in New York without your identification.
If the officer had some other reason to arrest the woman and wanted to obtain identification as part of the arrest that is one thing. He could have, for example, suspected her of dealing drugs or accused her of solicitation and held her for those actions.
But you can't be arrested merely for not providing your "papers" in NYC in 2011. The woman's point about other officers letting him get away with it are very well taken. Where was his supervising officer?

A police officer cannot just RANDOMLY DEMAND TO SEE YOUR PAPERS. They're not jack-booted Nazi's, and this isn't a police state. You're not required to carry Identification Papers. SHe was tresspassing,m so they had a legal right to ask to see her ID, though not an ethical one. She had every right to ask to get a friend to bring them to her. Period. USA is great - you are as wrong as wrong can be. The officer can ask you for your name, but you are not required to provide ID. You cannot give false information, however you don't even have to provide ANY information. It is referred to as the right to remain silent by some........Check it out, it is written on some old piece of paper somewhere............

AJ Trespass is to deliberately interfere with the rights of the property owner. She and her companion agreed to leave immediately upon being informed that the park was closed. If the police officer was actually detaining her for the trespass, why did he let her companion leave the scene?
In the days before air conditioning, New Yorkers used to sleep in Riverside Park on hot nights. I don't believe even today anyone would stop you from crossing through the park or taking an early morning jog. It might not be advisable, but it is certainly not illegal.
There are no signs posted that I know of saying the park itself closes to traffic. The tennis courts and basketball courts close. There are hours posted for the skate park and Grant's tomb but not for the park or the bike paths.

Then they proceeded to treat her like a felon. The douche bag wouldn't even let her friend go get her ID which was a mere 2 blocks away. It would have taken ten minutes for him to get it and return, instead, she spent 36 hours in jail, and apparently, in two separateprecincts. That right there is some great police work, this idiot should be promoted to lead investigator, and then on to the Mayor. usa...I was pulled over and didnt have my insurance card...I just got the new one and it was still at home...the cop followed me and allowed me to go inside and show it to him. Then he said thank you (after suggesting I put it in my wallet) and left.

if he let the male go, then he should have taken her back to the hotel to fetch her I.D.. poor example of a policeman.. probable cause, a real officer knows that if she gives her name without proof of verification but her companion provided his then he or she can assume if the two do not meet any description of someone the police are searching for, then its just a simple case of "i forgot my I.D". the officer is a bully, using his badge on a young pretty girl to feel manly..if anything he should have made sure she made it back to her hotel safely and told her to make sure she carries her I.D at all times when out in the big scary city..this officer should be fired..

Didn't say she was blind and she is a college student, so I would hope she can read. Point being posted signs in the park clearly state that if she was there after X time its TRESPASSING... which is a... that’s right, Crime. Now, do you think it would be okay for her to have said used her sister’s name, DOB, address etc. fail to appear or pay on the ticket and now her sister is sitting in jail because the cops just took the criminals word for it? That is right; she committed a crime, which makes her a criminal. as for his supposed comments, I pray no one ever gets pissed off at you for doing your job, calls your work, claims that you said mean things to them, calls a TV station, then contacts news paper, and smears your name all over. If there are not witnesses to the claims of what was said, then is it fair to take her side? If he did say something about her date, isn't that freedom of speech? She was accused of calling the officer names, but no one is calling her out on that... something to think about, just in case you find yourself in jail waiting for a hearing because someone claimed to be you and because of uneducated outrage like this, officers just take people's word for who they are when they do something wrong and are pissed. yes trespassing is a crime and no dispute that giving them a ticket and paying a fine is justified, but the officer could have let her get her I.D and instead wasted hours of time and court time by being a hard @ss.. as far as i read she was not claiming an assumed name and her friend was given a ticket and provided I.D and was released...in the end her case was thrown out, so shes not even paying a fine, all for nothing...

Bluepanther20, exactly the same thing happened to me 20 years ago -- I was pulled over for a traffic violation at night (forgot to turn on headlights after leaving a brightly lit gas station), couldn't produce my insurance card (it was at home on my desk), but I got arrested, handcuffed, and booked on charges of uninsured driving and RECKLESS driving (a far more serious charge than was warranted). My friend drove to the station with my bail and picked up my insurance card on the way, but since the arresting officer had gone off shift they couldn't process it. I went to court eight months later and all charges were dismissed. The prosecutor told my lawyer the cop was "having a bad night." The whole debacle cost me about $1200 and 4 hours in jail.
I am thankful for the honorable police officers that serve us, but there are plenty of thugs too -- kinda goes with the job, I think...

A couple of years ago my wife took a nursing contract in Mesa AZ, our residence is in Mi and that is what license plate we have. We were driving through town around 1am when we were pulled over. He proceeded to tell us that the light for our license plate was out. I thought nothing of it and told him I was unaware of the issue but would fix it the next day. That next day we drove to an auto parts store to get a new bulb. I got out to check the bulb size before going in an d to my surprise there was not one light but two and both were working. Now it was summer and that area has a lot of elderly come from out of state to spend winters there. Many leave their vehicles. I can only guess that he was concerned the vehicle was one of those left behind and we had stolen it. I wish he would have said that because I would have felt like he was doing a good job of protecting and serving. Instead he lied and created mistrust. All it takes is one bad officer to tarnish the many who are decent.

Try telling that to the dairies who routinely spend over $1 million a year each replacing those stolen milk crates. Information easily Googled. As with shopping carts belonging to the stores, a dairy farm owns them crates and both have to pay their own money to replace them when they are taken.

Why is there no follow up to this story? Other than the initial NYTimes.com story, I haven't seen any other news organizations report on this. This NY cop could stakeout quiet streets and swoop down on jaywalkers. He could fill the jails with joggers. I guess that is his goal? A policeman should do everything he can to mitigate the circumstance. Instead of producing a revenue, this alleged jarhead cost the city money. If he was so hell bent to write a ticket, 10 minutes of his time would have solved it. Instead he spent more time writing a report and booking.

How silly your comment reads, not because you don't have a right to your opinion but because this is our system of justice. The cops have discretion in misdemeanor crimes, and in this case, he had the legal authority to do his job.
You have no idea what other factors made this officer decide to not give her discretion. Meaning you might have to stop the whining that the POLICE have an agenda type thinking(revenue crap).
And maybe think about THE PUBLIC'S expectation that the officer will do his job and not WORRY who it is he is dealing with. Meaning you have no idea how many neighbors complain about, loud or annoying late night goof balls in the park, you have no idea that she was a respectful angel, no have no idea what this OFFICER DOES LET GO.
As other REASONABLE minded people stated, this officer may not like people in closed areas, because HIS EXPERIENCE in dealing with citizens who have had negative issues, fights, assaults, attacks, lost items and so on stem from people in places they legal shouldn't be.

I see what you are saying. That's why I mentioned the no follow-up to the story. As it reads it does make the cop look real bad. So when I said "this cop", I was talking about the cop in the story. I'm leaning that there is more to the story. I said alleged jarhead because that is how the story portrays him. My revenue point was not to say the police have a revenue agenda but rather point out if the other person went to get the ID then the tax payers save money. That is why I have my doubts about this story. Why didn't the guy show up with ID? I'm thinking this story was embellished and that is why no major news organization has followed up on it.
I gotcha, and please dont take my COPS ARE ALWAYS RIGHT away from my stance i know that there's more to this story and the fact that most jails dont even book in misdemeanors anymore when an id is present unless its a crime of like theft because they use the finger prints to match other crimes.

Here in Maryland they do get food stamps if they have kids with them which I would venture to say is around 80% of them . They also get housing assistance and all other "free" perks again because they have kids with them and the illegals know this and therefore the illegals use this as their loop hole.

It is pretty simple because they don't have to provide documentation of citizenship for benefits. @Buffaloes Roam--it's not just a few illegals who have gotten benefits. In WA state, it has become a full-time industry. My state is one of the few left where illegals don't have to provide any papers at all to get a driver's license. Not to mention, they can take the written portion of their driver's test in their native language! Aren't all road signs written in English?! Once they have that driver's license, they are AUTOMATICALLY eligible for welfare, food stamps, Medicaid, the whole platter of benefits available from DSHS. Couple that with Washington's highest-in-the-country minimum wage, and it's no wonder that illegals from all over the country are flocking to the great NW.

If you really are a disabled VET then you do in fact get benies from the fed govt.. you got military pay compliments of the Federal government and taxpayer, you got health insurance (and most likely still do) and chances are you get disability. I can't go to a VA hospital and get treated, can you?
Have you ever been to a VA hospial, Sally? Ever tried petitioning the VA Admin for medical care? Been denied care for something that happened to you years ago while on active duty? Please read the story. She was trespassing that is against the law. The officer did not make up the law just enforced it. And she did not have ID they have every right to detain her until she can prove who she is. That too is the law. Do you just let everyone go or just this poor innocent girl?
Nick the officer was being an ass about it. Her friend had ID and they let him go. So apparently they were not pursuing the tresspaassing thing since they let her friend go. They were just harassing her.
Officers should be expected to use judgement when making decisions, exactly like the decision to arrest this girl. If he had suspicions that she was 'up to no good' then by all means allow her friend to go get her license to prove her identity, question her, whatever, but if she had previously declared that she was unaware of the law and would leave the park peacefully he should have just let her go...
Nick, I agree they had the right to detain her until her identity could be established. HOWEVER, according to their department policy, they could allow her to have a friend bring her ID to her to satisfy that requirement - which they did not allow her to do. Instead they shuffled her around for 36 hours, when this could have been resolved in less than one. I don't see the problem as requesting ID. Right or wrong, whether she realized it at the time or not, she was indeed breaking the law and requesting ID is not out of line. The problem is that instead of letting someone run back and get hers, they kept her locked up 36 hours and wasted her time and countless department resources unnecessarily.
The fact is, the cops can put ANYONE in jail for up to 48 hours without charging them with ANYTHING. This has been the law for longer than I can remember. The Supreme Court has upheld it every time it has been challenged. Furthermore, having been in and out of jail several times, I have first hand knowledge of how long the losers that work at the jails will take to proccess your paperwork, especially when it comes time to release you, usually at least 4-12 hours. Once they have you in the system, they are extremely reluctant to let you go. Why? They get money from the state for every day they keep you under their roof. It is against their financial interests to let you go, and they do whatever they can to maintain solidarity with their frontline cop brethren, i.e., "...if they brought you in here in the first place, you must be guilty of something."
If you're "trespassing", why does simply showing an ID let you off the hook? This wasn't "trespass." It was intimidation. PIGS.
Where I live, we just had a newsflash about a man arrested for his second murder. His first one netted him 20 years. He served 3 and was released, to kill again. But, we're OK with PIGS arresting and jailing people for "trespass" in a public park because they have no ID? Sick, sorry, and don't ask the taxpayers for raises if this is how you're going to conduct "law enforcement."

I honestly think what happened to this girl was overkill and shouldn't have happened, but the cop did not violate her right to liberty. She was trespassing in a park after hours. And if seeing the Hudson makes her happy, she can see it in her own town. The article said it runs near her home too. Or she could come back to the park when it is open.
If killing people made me happy (which it doesn't, but this is a hypothetical), and the cops stopped me, would they be violating my right to pursue happiness? Of course not, because I would be breaking the law.

It is clear there are some here who will defend the actions of the police no matter what. Perhaps they are police or a close family member or friend is. I get it. But, allegiance should not prevent you from seeing right from wrong. If they were pursuing tresspassing charges, then logic dictates they "detain" her friend. They did not. They let him go. So too the "tresspassing" charge goes out the window as well. What is left? No ID?? Maybe having ID on you in public is the law, maybe it is not. What we know from the article is the officer, per the department regs., is allowed to let someone go and get the ID they requested. Since the friend was allowed to leave (because he had his ID) they could have easily waited or better yet escorted them to the hotel for the ID. That did not happen. Why? Bad cop or good cop having a bad day and decided to make this person's life miserable for a night (or two). Can you tell right from wrong in this scenario or will you just blindly defend wrong because of who committed the deed?
I agree with the young lady. If so many in the precinct knew what she was being held for was bogus, why keep her there? Even more, why would the DA even consider these charges to begin with?

in all seriousness, I find it very disturbing that some people here believe that simply being in a public park ( there is no indication that they did ANYTHING else "wrong") and not having ID on her person means that a young woman can be detained by police for over a full day...there are some CONVICTED criminals who do not spend that much time in jail...imo they should have been told to vacate the park, and when she could not produce ID, then the cop could had followed them to the hotel ( a whole 2 blocks) to get her ID...I find it ridiculus that tax dollars were wasted on this, and that the other police knew something was not right but went along with it anyway...you cannot tell me that every person here has not gone out with out ID, either on purpose or by mistake, and that you review all the laws of the towns you ever visit..this whole thing is idiotic and shameful.

Very many Mexicans in this area have an official Mexican ID card, the Matricula Counselor. They are officially registered as being in this country by the office of the Mexican Counsel in Atlanta, so they can use this to open bank accounts, cash checks, etc. Of course, the Mexican government has no legal authority to allow anyone to enter the U.S. This makes for a very awkard situation. (Can you imagine a U.S. counselar office assiting in Americans being in Mexico illegally and what the outcry would be?) Let's face it, their citizens receiving money from the U.S. is one of Mexico's largest "industries", and without it there would be far more pressure on the government for real reform and the creation of better jobs there.

I completed my master's degree in NYC in the mid-1970s. While there, I participated in a study of the NYC judicial system, particularly monitoring how quickly people moved through the justice system. It was not uncommon for people to get "lost" in the system for days, sometimes even weeks, being moved from precinct holding to court and back. Hearings did not get held as paperwork was lost or unavailable, officers did not show up, etc.
What we are seeing today is no different than the games played for decades or longer. And NYC police are no different than police in many cities; they get a position with authority and it goes to their heads. Common sense and good judgment are lost; the public and innocent people suffer as a result. It is long past time to rethink our entire justice system and how it operates.

You have the right to remain silent at all times. You don't need Miranda rights said to you. If you are handcuffed then you can ask if you are under arrest. Most people are not handcuffed but depending on the situation an officer can place you in cuffs.

Um, no, you can not tell that someone is a veteran by looking at him. I just think the fact that he served his country should give him a bit of respect from the jerk cops. The wife needed food, she was faint in her advanced pregnancy. They kept the wrappers while they shopped and intended on paying for the sandwiches, but were not allowed to correct their mistake by paying for the sandwiches, instead they were arrested and their child was physically removed from them by social services. The whole thing is ridiculous. I am totally against shoplifting, but the story about the student and this story just proves that common sense is a thing of the past for law enforcement. During long shopping trips, I have let my kids start munching on a snack and paid for the snack while going through the line. It is a pretty common thing. So the couple forgot, let's traumatize their kid!!!

I don't think these two cases are similar. If the two were in the park at night they could have easily missed the signs. I've seen some of these signs-very small.

Well you see judge, it's policy that when someone breaks a law we ask for ID and if they can't provide one we detain them until we can find out who they are. If you don't like that policy talk to the police commissioner but that's what I have been told to do.

Let's highlight the important part of what you stated in bold... Now, here's the issue, the officer in question knowingly released the young man with her because he had ID right? Now using common sense the officer likely knew that she was a student too, and if he didn't then he easily could have found out that fact for certain in less than two minutes time with a simple phone call, which he didn't do. If he was not inclined to accept a phone call as proof of her ID then he easily could have had the young man who had been with her bring back her ID as proof, maybe taking 20 minutes of his time. Instead the officer chose to spend taxpayer money to the tune of approximately 20,000 dollars after you take into consideration the two nights in cells, two trips back and forth to booking from Harlem, the officer's, who took over for him, time while he was off duty, court cost, and meals.
Her actions may have constituted a crime, I wonder if the time of closing was posted where the young people entered the park, since the officer didn't argue about them not knowing it was closed, but let's be honest, who committed the bigger offense. I vote the officer did.

I have the right to carry or not carry ID as I see fit, not some pissed-off-because-I-have-to-work-nights police officer. I hope this young lady sues the officer in question, his shift supervisor, the precinct Captain, the Commissioner, and the Mayor for allowing this individual who is obviously not suited to be a police officer to wander the streets with a weapon and on the payroll of the city.

I think that the responses to this article are completely contradictory to the responses that we normally get in the cases with African-American men that are abused in the same way.
For example, go outside of a club where the majority of the crowd is Black and I would bet more than half of the crimes charged have to deal with possession of marijuana and had only come to surface after a non-threatening and much more trivial offense had been cited (as is the case with this young woman being in the park past its closing). Now, I'm not trying to say that not having an ID is as bad as the crime of possession of marijuana. There's a whole lot more involved in the latter. But I do think the situation here is useful for understanding how a crimes punishment might make a situation worse off. Of course, sometimes there are crimes that need to be dealt with in a harsher manner, but this is not my point.
Why are non-threatening and for the most part "poor-judgement crimes" allowed to be tried so harshly in the justice system, further solidifying the trend that the law is above good judgement? According to NY law, the cop was completely justified in his actions. But interestingly enough, most people can see quite clearly that his actions did nothing to help the situation.
It seems quite obvious that the justice system is broken because it causes people to enter a system that is retributive rather than rehabilitative, even though a vast majority of the crimes that are committed are non-threatening in the way that they do not harm society.I think this story is important, and am actually in a round about way glad that it happened, if not just but to bring to light the harsh manner in which the justice system deals with these types of crimes, many of them committed disproportionately by Black men.
The fact remains that this cop did not break any laws and was fully justified in his actions according to NY law. The deeper and more interesting question however should be, why do we live in an America where this kind of ineffectiveness has been allowed to continue for so long? And speaking even more to institutionalized racism, why is it only when THIS young lady gets put in this position is their such a huge response to the issue?
Even more what I wonder is, how many situations like this have become complete non-issues and altogether dismissed, simply because a police officer decided that the crime a young white woman committed was not equal to the level of punitive actions he were fully justified by law in taking?

Your saying exactly the point that I was trying to get across. Sometimes crimes (as in not carrying your ID) are just...well, not that serious. Also, the crime of not carrying her ID was in fact found out only after the non-threatening and more trivial, 'poor judgement crime' of being in the park after closing occurred. This happens a lot. In other words, many times police officers go out looking for trouble thereby actually initiating it, when it most likely never would have occurred in the first place.
To your point though: In this case, obviously the punishment of two nights in jail did not fit the crime of not carrying an ID. Something else could have been done to resolve the situation so that a more positive result could have been achieved. Most people are making this determination with very little effort. But its just funny to me that people are reacting this way, when this kind of situation goes on everyday for Blacks and has been unfair, in this way for years. Basically, I'm just making an analogy.
So then: What would be wrong with legalizing marijuana, and government effort to change the way society views the drug's use? We can't just have people getting harsh punishments for not carrying their IDs. The intent of a punishment should be to inspire order and obedience toward the law. I'm sure the young lady would have learned her lesson had the police officer had her go to the hotel. In other words, the "punishment" of having her go back to the hotel would have been sufficient to in the future, deter the "crime" of not carrying her ID.

It's up to the top brass to make sure this officer deeply regrets his actions - and change the 'group-think' to challenge this sort of abuse of power, not tolerate it. Every force has a few fascists but we rely on the rest to stand up to them.

Where I live now, to be considered for a raise or promotion, etc. LEOs have to issue so many traffic violation tickets a month = yes this includes not using your turn signal, following too closely, going to slow in fast lane, any and all State traffic violations; write so many tickets for failing to wear a bicycle helmet and all other laws regarding riding a bicycle off or your private property = front and rear lights, reflectors, etc; make so many DUI and Drug arrests per year; domestic violence, prostitution and even broken down as to customers and prostitutes; felony arrests a year; etc. It is all broken down. Which I totally agree with because many LEOs choose not to be bothered arresting criminals for certain crimes and some are just down right afraid to.

This woman and man were trespassing, which is a criminal offense, also in all States of the United States of America. The Park closes at 1 am and then she got him "to walk with her a few blocks to the park, at about 3 a.m." They purposely entered into a closed park 2 hours after closing time and no one thinks this is a crime. Then "We said, ‘O.K., we didn’t know" = what liars these two are. All parks has signs posted at all entrances with the times they are open and closed and most people in any City, especially New York has common sense to know that you do not go walking into or around any park at night time, let alone after midnight; unless you are up to no good.

Police were hired to SERVE and PROTECT the citizens. Instead, we allow local governments to use them as a revenue resource and some forget their lofty reasons for joining the force.

well i think the majority of the posts agree that it was a little to extreme for this girl to spend 36 hours in custody over a petty crime off trespass due to not having an I.D..also a waste of law enforcement time, given the outcome... however law enforcement did have the right to detain her to keep the public safe from a possible fugitive on the loose???hmmmm...you may want to know what your fourth amendment rights are if you are found in a situation like this.

She should have told the officer , she was a illegal alien, therefore under the Lawsuits by justice against, Arizona, Alabama, and South Carolina, she did not have to produce any identification. (what the hell is happening to common sense).
Unfortunately, this type of story is more the norm than the exception in most cities. Copes are a brotherhood of psychopaths. Anyone wanting to join law enforcement to make things better and proper, is quickly recognized as a boat rocker and troublemaker, and is quickly alienated then removed from service. First of all she committed a crime. The crime was obviously not a big deal. If she had ID they would have just done a quick check for warrants or whatever and let her go as they did her friend. The officer did his job. In this case there was no room for common sense.
I agree. We all want the illegals to produce ID then we must also live tot hat same standard and have our ID on our persons at all times as well. I dont know about any of you but I go no where without my ID. She needs to take this as a lesson learned and dont forget to carry your ID with you all of the time. I thought I read that she had a cell phone but not your ID, I hope that was not the case because if it is the case then I certainly dont have ANY sympathy for what she did and the consequences that took place after your poor decision.

I constantly hear we can not afford health care, food stamps, etc. As a tax payer, I can not afford to see my tax dollars wasted so some loser can play bully behind a badge. And all of the other public servants aided and abetted his unethical behavior. If the police want the support of the public, they need to remember who they work for. If they have time for wasting money like this, they are telling me we have too many police, and need to cut their budget.

during a time i was not employed a police officer illegally took my california id card. i did not at the time have the $25.00 replacement charge for a new id. for many months i was consigned to not having an id card because of the lack of finances to replace and when i contacted the police their response "was why don't you just go and get another id card?" what was my negligence in not having an id card? should i have to stay in jail because of law enforcement illegality?
i was doubly penalized. not only by your standards i should be jailed, in california you have to have state id, either a state id card or a state drivers license to gain employment. so by not having an id card or the means to get another one i could not get a job legally in the state of california. the police know this because one of the first things they ask you is your employment status (this is the reason i have learned to not answer that question). and no, you don't have any legal obligation to answer that question. the officer knew what he was doing when he took my id card. he was keeping me in poverty.
the police only have the right to keep you long enough ascertain your identity. in today's technological policing that takes no time. she should only have been kept a couple of hours max. if she was registered at a nearby hotel they could have verified that quickly with one phone call (most police department pay for their officers cell phone bill in lieu of walkytalkies).
there were many alternative ways to have handled this situation. to intimate that the way the police handled is the only way is misguided at best.
There is NO law that says one must carry an ID. This police arrest is ridiculous and the police officer should be disciplined.
The fact that the judge got rid of the ticket in less than a minute supports that.

You DO have to have ID to: get on a plane, drive a car, get into certain age restricted establishments, buy alcohol or tobacco.
You do NOT have to have an ID to: go for a walk, be a passenger in a car, go grocery shopping, or a myriad of other activities.
She was not charge for not carrying an ID. She was charged with trespassing.
And yes... this was stupid all around.
Having said that, some department policies are to detain that person until ID can be established. I kind of agree with that policy. My brother was arrested for shoplifting. He used my name. Police never bothered to establish ID when he didn't provide one. Then my brother skipped his court date (of course)...
So, a warrant was issued in my name for failure to appear. I was half way across the country. I had to drive (very carefully) back to Florida to prove I wasn't the one arrested.
Again... I'm not trying to troll the thread. I'm just saying... she went to jail for not being able to produce ID, and I had a warrant issued in my name because my brother didn't produce ID.
Which policy is right? Should we start a national database of fingerprints and allow cops to verify ID through a handheld device? Every idea will find a large group of people blasting it as wrong. But until we find a solution that works, stupid things will happen to people.

Which is the more serious crime? In a park after hours, no ID or the police showing how well they are at being pigs? When bogus cases like this are dismissed the officers should at the very least have to pay court costs if not restitution for time misspent.

The only 'crime' she committed was being in a park at 3 a.m. - the lowest level of sub-misdemeanor possible! Not having I.D. on you is not a crime. And, by the department's own statement a person is permitted to have someone retrieve their I.D. if asked for it and not on their person. The fact that Durrel felt compelled to charge her for her non-crime shows a great deal of personal insecurity on his part.

I've never encountered such low life cops in NYC or anywhere I've traveled but, I guarantee, if he ever did something like this to me while in the city, he'd be up on charges in a New York minute and he'd be turning in his badge in no time. What he did was, quite simply, unconscionable and beneath contempt. The entirety of New York should be ashamed and embarrassed at this kind of conduct from one of their supposed "finest".
The police conduct personality tests before accepting recruits. They want the 'right kind' of police officers... a good example of which is found in this very headline.
The only effectiveness I've ever seen in changing police is to remove all upper administrative personnel and demand a change from the new administrative personnel, hiring the right people through careful selection.

Trespass is a misdemeanor crime. However, the police could have found out who she was, and whether or not there were any warrants out on her just with her name. Unless she was withholding information (like her name), would they have to wait to have her 'processed' by a judge.
I have to agree that it was either a slow night at the precinct, some cops were tripping on their own egos, or they were just being total asses. It cost more to keep her and "process" her than it would have for them to do their actual jobs.

There is not one state in the USA that has a "law" that requires you to have an ID let alone carry one. You need a photo ID to do certain things in this country, however just walking around is not one of them . Anyone who thinks otherwise is a fool who does not know what they are talking about.
Try being homeless and then getting an ID. In order to get ID, the state wants an address. No address, no ID...........No ID, no address, no welfare checks or social security checks. The government wont mail a check to you with no address. They like it that way, as then some that would be eligible for a check do not get one as no address. Uncle Sam likes that aspect of no ID, NO address.........It saves them money.
I dated a Sacramento Dispatcher, she told me, the cops she works with are worst then the inmates. For all the people who wrote that she deserved what she got, I hope you are put in a situation where your arrested for something and moved around for days in the jail system until your released so your able to walk in her shoes to know the feeling of helplessness. If I read this story correctly, she said the officer put words in her mouth when she address him as "SIR". as if she was calling him a foul name. This happens, it justifies for the officer to fuel his mean and hateful personality. I was drinking beer and listening to country music and two young men started sh*t with me about the music I was listening too. A fight broke out, a police office came, I was arrested, the officer told me he will have the women with the men testify in court that I pulled my d**K out and have me put away for 8 years. my reply was, "SO O.J. WAS FRAMED". America is not the greatest country in this world, it is just okay. Over 400 innocent people have been freed from prison from DNA. DA's and Police Officers lied in U.S.Court to get a conviction. How many innocent people has the U.S. put to death because of Police Officers and DA's who lied and fabricated evidence to get a conviction. All it take is one Officer (and the ones who watched from the side line) like this one in this article to destroy a lot of INNOCENT LIVES. This women or any other person do not deserve this kind of justice.

If it is a crime of "trespass" to be in a public park, then the law needs to be changed. A "public park" is owned by the public. Thus, a person who is in a public park, is in a park that he/she owns. Thus, no trespass. If there is a law not to be in a park after certain hours, then it is a violation of that particular law. However, if the law is not conspicuously placed, then visitors from another state would not know of the law since in most states, public parks are, in fact, public parks. This girl should not have been arrested, and yes you idiots, common sense, does matter. Most people who don't have it can't recognize it.
As to the ID, if it is a law making it mandatory to carry an ID, virtually every American under the age of 15 should be in jail. There is no law that illegal aliens carry an ID. Why you might ask you mental giants? They are illegal, they should not have an US ID.

All the way back in 1987, a co-worker of mine was nearly arrested for just such a thing. We saw a mutual friend in the back seat of a cop car in the parking lot of the restaurant where we worked. We were laughing at our friends misfortune when one of the cops got mad and demanded to see my co-worker's ID!! We had nothing to do with whatever was going on, we just happened to know the person they had in custody. When he asked why, he was nearly tackled by the now-outraged officer! Turns out that cops in WA state have a right to demand to see your ID anytime, for no reason at all. So much for the Fourth Amendment!!!
Sorry, you might not need to have an ID, but she is stupid to not carry one because you don't know what could happen. What if someone had stolen it and then committed a crime, if that person looked like her. I carry an id on me even if I am going a block away. I have been stopped by cops and accused of skipping school (I'm much older than that). What if she had been killed and no one knew her identity? Would that make you feel better if that happened and she couldn't be identified?

On top of the cops bad behaviour there is also the forgotten laws of having to cary an ID and not being able to be in the park at night. What happened to freedom.
Just the other day I went to walk my dog in a park a mile away at 7 pm with my son. The park ranger came and told me it was closed after dark. This park has never been closed before and I am a regular who has visited doing night runs for years. This year they added a state fee to use the parks. It must have been enough to afford the park ranger to come tell me I no longer have the freedom to walk in the park at night. Pay more and get less! What makes it worse was that the park area was donated to the county by some nice folks years ago -- not the state. The park ranger of course has a house on the park. I guess someone gets to enjoy the waves lapping the beach at night.
First of all, I had to go to City Search to find out what the hours are for the park. The Parks website doesn't list them anywhere I could see them, and I doubt that any signs posted on the street are easily visible at night. There is no way of knowing what the hours are for an open stretch of land, 4 miles long and only about 500 feet wide. If you're standing across the street you can see the boardwalk and the Hudson. It is simply too accessible if this is the response towards anyone who wants to see the river a little closer.
Taking a simple walk in the city that never sleeps should never elicit that kind of a response from a cop. Any reasonable person who didn't have an axe to grind with society would have simply told the two kids to move along, the park is closed. But instead, this policy wonk with a hard on for throwing the book at every person he meets (because he likes the power) decides he needs to run background checks on every person who jaywalks, walks on the grass, or sneezes without covering their mouth - hoodlums!! He easily could have entertained this girl's need to get her ID from her hotel across the street. But he was a dick instead. Because of a lack of humanity and a zeal for crushing people under his thumb, this idiot pig wasted our money, this girl's time and goodwill, and spread more derision and bad feelings about cops.

Well it seems clear, officer a-hole from precinct X should not be allowed to tromp on people's rights anymore. Perhaps a nice stint on desk duty will readjust his attitude to Serve and Protect that is the credo of most police forces around the country. A good cop is in a noble profession that doesn't get the respect they deserve most days. A bad cop just needs to find another career. It sounds like internal affairs needs to put an undercover in the park without ID and make sure they've got enough on this cop to show him the door. Even if what he did was technically legal, it showed very poor judgement.
...oh and by the way, not having valid ID on your person anytime you are in public in the State of Washington IS a misdemeanor.
Only experience I have had with big city cops was in Boston, and I could see something like this happening. I was pulled over for a "broken tail light" at about 12am. The officer wanted to search my vehicle for drugs or something but for some reason sped off shortly after asking the question. I checked my lights after the cop left and both my tail lights were working, as were my blinkers and headlights. Guess they didn't like someone with Vermont plates driving around in their city unsupervised or something. Cop wouldn't have found anything if he had searched my car since I have never been involved with any type of drug use in my life, and I have no criminal record. I'm just glad it didn't head in the direction I thought it was going after he mentioned I had a broken tail light.
I feel bad for the girl since right now it is nearly impossible to find any type of Design job right out of school. I have a BFA in Graphic Design from one of the top schools in the country and I am still looking a year and a half and over a thousand applications later. Hopefully the jerk that did this didn't cause her to miss a job opportunity... for her sake.

Ok, ok...there is no misdemeanor for not having an ID - you can be detained as a driver for not having ID, and you can also be detained for refusing to give your name and/or address.

First, it's a bit of a relief that this happened to a Caucasion person...otherwise, the "amnesty for illegals" crowd would be on here throwing a fit about "profiling."
That said, this story should be a very simple lesson for anyone in this country: Carry some form of ID! I mean, they're in a public park after the park is closed, so it's not unusual for the police to ask for ID in a situation like that. And the guy who had ID was let go right away. It's sad that the girl had to go through what she did, but if she had her ID with her, well, problem solved. I wish I knew what everybody's hangup is about having to carry ID on them. That simple act will solve about 100 times more problems than it causes.
When an officer, is violating the Constitutional Rights of another individual, he is NOT protected by Legal Impunity. He can be arrested for assault with a deadly weapon, and charged with as may as 10 different violations, and is personally liable as is his supervisor, the prosecuting attorney's office, and the Department for malpractice. Look out, someone is going to get sued, and I would file criminal kidnap charges with the State Police and ask the Justice Department to handle Federal Charges.

This is such a blight on officers who are really trying to accomplish something good, that every officer on that force should go home and STAY home (for what this nut-job, gestapo-wannabe has done to their reputations) until he is fired and restitution is made to Ms. Zucker.

No law says you have to carry ID, period. However, the lack of ID could get you "detained" indefinitely until ID can be established.

But once they are writting you a ticket, they have to know who you are. They have to know if you have warrants.

This is why it is so important for civilians to be able to record on video all encounters with police. They film their encounters with us for evidence, but then they get to control that evidence don't they. If an officer is abiding by the law and conducting him or herself professionally then they have no reason to react furiously to a video. Taping an officer at their job IS NOT resisting arrest or refusing a ticket. It is insurance that you won't be taken advantage of. I think that every car ought to be outfitted with a camera that points towards the side windows. If they know they are on tape, maybe they'll behave themselves a little better.

She technically broke two laws here being in a park after dusk and not carrying an I.D.. it is law that all adults must carry a state id or drivers liscence with them at all time. But i do think two days in jail is a little long for this. My biggest concern is with Mr. Dwyer and his editor. It would have taken a mere 10-15 minutes for her friend to retrieve her ID, problem solved. And for the dim wits trying to blame Obama, I am pretty certain that New York is not run from Washington. Besides, even though Bloomberg is supposedly an Independent, he was a long term Republican. Wake Up America, our last little bit of freedoms are disappearing every day.

Further, the park closes at 1am not dusk. Unfortunately the signs are either not obvious or not present. Also there are clearly no hard barriers such as fences or gates that would keep unwanted people out after hours. I'm sure this cop could make a living kicking people out of Riverside Park on any night of the week. There are likely dozens of "trespassers" a night.
The discretion whether or not to follow through on prosecution of any crime rests with the officer. An appropriate response is to tell them to go somewhere else - not demand ID and take one of them to jail for two days. I have been in plenty of situations when a cop has told me some public place was closed and that I should move along. Never have I been given ticket for trespassing!

Allow me to explain in simple terms so that those screeching abouts rights and law suits can understand.
When this young lady was detained for a crime, tresspassing. The police officer had due right to know who she was and to be able to confirm who she was by her producing legal identification whether it be a driver's license or some form of state ID. Without production of said ID she could be and she was detained.
Yes, I agree that this could have been settled in a much simpler manner and would have cost much less on her part and on the part of the city. But, it was not illegal, unconstitutional, or anything similar.
And for those of you who want to roll up every officer and every precinct and label them based on the actions of one officer or the inefficiency of one city's operations; I suggest you get to know some of your local law enforcement. Most are decent hard working people who do their best to treat everyone they encounter reasonably and respectfully. Too bad the people they serve aren't that kind to them
Ok, so she and her friend were unknowingly in the park after closing hours and the police came by. The police have every right to do so, and as these 2 were technically breaking the law, the police have every right to ascertain their identity and check for warrants, etc. However, with that being said, she should have been detained ONLY the length of time it took her friend to run across to her hotel and grab her ID and have it checked. We're talking 30 minutes at most. If the hotel were a ways away I could even see taking her to the station and holding her for up to an hour while the id was retrieved - again, that's all well within the rights of the police on the basis that she was breaking the law in the first place. 36 hours is beyond any realm of reasonable - not to mention the costs of transferring her back and forth between stations (why again?), etc. Other officers were aware of the ridiculous situation, and one would like to assume that they are also aware that the department allows others to fetch id's in these situations, yet NO ONE spoke up?
I don't think this is lawsuit worthy but I do sincerely hope she lodges a formal complaint against the arresting officers and that this gets investigated.

One peculiarity I have noticed over the years. Most municipal policemen, county sheriffs and sheriff deputies, are generally much sorrier, much more inept, and much more dangerous, than "state highway patrolmen". This seems to be so, at least for me, no matter which state I happen to be in.
So it is A OK to not have an ID if you are an illegal immigrant in the USA, but if you are an actual USA citizen by God you better have that id on you. What's wrong here people? Since when is it ok to be in this country illegally and it be wrong to ask them to see their id, but stopping anyone else and asking is ok. This SUCKS!!!! Why are so many of you willing to accept that we as Americans no longer can expect the freedom to simply go for a walk without our ID and the fear someone in "authority" might ask for it? This is wrong on principle! None of us must by law carry ID on our person everytime we leave our homes, and no one can ask to see ID without due cause, based on real law. Why does anyone think this is ok, that we who live in a free society should be arrested for having no ID? I show my ID on the rare ocassion I write a check, I show ID when asked if circumstances involve my money and my bank account. I show ID at the liquor store. I carry ID when I drive. And how is it that anyone can be tresspassing on public property? It doesn't sound like the two young people were being difficult, and Bad Cop was trying to goad the young lady into saying something he could justify his actions for. He knew he was wrong, but not man enough to stop.
I would question the constitutionality of a law in any state or city that says everyone must have ID on their person at all times. There are countless reasons why it is a good idea, but there is only one reason necessary to explain why it is must never be law - it is an affront to our rights as free citizens in a free society.

Notice that the other cops know this officer is a problem, but didn't say anything to stop him. Hell, even the supervisor didn't stop him from abusing his power. The supervisor should have killed this when it got to the precinct.
As for needing ID, none is required unless he is going to write her a summons. This offense is less than a parking ticket. So why did she go through central booking?

The fact that they held her for something that could easily have been dismissed as accidental (did the park have signs? If not, how could she have known if she wasn't from around there?) is just another example of bad cops making good cops look bad. He should be disciplined, if not fired, and the others should grow some so they can stop it from happening again.

I agree - he was within his rights to stop them as they were in the park after hours. A simple pointing that out would have probably done the trick. But even if he decided to go further, minor trespassing gets a TICKET similar to a speeding or parking ticket. It does NOT get you hauled off to jail.
The was also in his rights to ASK who they were, their address, etc. But as to having ID on them ... that is NOT a requirement in this country. While it may have been easier, the burden is not on the citizen, it is on the officer to behave in an appropriate manner.
You should have noticed the victim (and yes, she WAS a victim) offered to send people to her hotel to get her ID yet NO officer allowed this to happen.
There are a great many good, honest and decent cops out there. I know quite a few. This one, and the ones who stood by and watch, do not number among them.
Jailed for no "ID"? Where I live, if you don't have your ID on you and the cops want to know if you are who you said, they run your SS number. NOT to hard to do. As long as you can answer some questions that pertain to that personal info, usually you are OK. While there are some good cops, there are also bad ones. Not to long ago, where my wife works, was robbed at gun point, The young lady that was working had the gun put in her face then locked in the bathroom while this person took several thousands of dollars.When she got out of the bathroom, called the cops, it took them two hours to respond to a armed robbery! We live in a relatively small town, I have checked and there was nothing else going on that night that would delayed them for two hours. And they wonder why people want to carry guns.

Why didn't her friend get her ID and go to the police station? Why didn't the friend who got the ticket not ask basic information of where she was going to meet her? I carry my ID to avoid these types of problems because some cops are stupid.
No... I base it on the actions of most of the local law enforcement I've had occasion to deal with for most of my adult life.

The trouble with sending her to jail for not being able to produce ID is that it's not true that she couldn't produce ID. She just couldn't produce it immediately. Instead of waiting fifteen minutes so her friend could go to the nearby hotel to get it for her, the officer arrested her for not producing an ID that she could have shown if he'd had just a tiny modicum of patience and respect.
Why didn't her friend go and get the id and bring it to the jail?
And here's where so much of it starts . Starting with a way to prosecute our assinine "War on Drugs" approach to marijuana, where the main casualty is human rights. Once the precedent is established that basically anyone can be stopped if the officer feels like it, then everything else follows.
One thing is interesting -- it's almost like she looked 'OUT OF PLACE', being that far uptown that late at night. Must be sort of like being black in Westchester!
The cops are under fire from their overlord bosses to get these damn occupy protesters to go home. If they screw with some of them, word gets out, FEAR takes hold, and other would-be protesters stay home. Mission accomplished.
Our occupiers; in my city, are standing on sidewalks and the plaza in front of the new cityhall...which we the voters never voted to build with our tax money. Didn't say she was blind and she is a college student, so I would hope she can read. Now, do you think it would be okay for her to have said used her sister’s name, DOB, address etc. fail to appear or pay on the ticket and now her sister is sitting in jail because the cops just took the criminals word for it? That is right; she committed a crime, which makes her a criminal. as for his supposed comments, I pray no one ever gets pissed off at you for doing your job, calls your work, claims that you said mean things to them, calls a TV station, then contacts news paper, and smears your name all over. If there are not witnesses to the claims of what was said, then is it fair to take her side? If he did say something about her date, isn't that freedom of speech? The police are and have been abusing their authority for a very long time.
All this officer had to do was call up the hotel to confirm who she was and the room she was staying at. Then another option would be to run her name, bd, and ss # and confirm it that was as well, or have them call a friend or family member. Arresting her was just wrong and stupid.

slow down - if you know that with a misdemeanor offense like trespassing AN ID allows the officer to fill out a CITATION and let you go.
But with out an i.d the officer doesnt have to take a risk that your telling the truth and can book you into jail to have you formerly i.d.ed and then the officer is contacted with your id and you get released.

A misdemeanor crime is one where the officer is the witness and he doesnt have to take you at your word. Meaning most jails dont intake misdemeanor suspects how have an valid i.d. or d.l

I take it by your posts that you were both there and "know for a fact" that she gave the officer(s) here name? If you were then your post is valid. If not it is your opinion based on the fact that you'd like to be able to do what you want to do and when you want to do it including breaking the law. Good luck with that and let me know how it turns out for you will you? Speed is a ticket-able offense as is trespass. Yet if you fail to provide verifiable information to the officer who stops you for speeding so they can verify you have a valid driver license, you will in most cases go to jail and post bail. I speak from 26.5 years of experience as a law enforcement officer in 3 different states and not from what "I think is true" or "what I want to believe."
Now the facts are; (a) this young lady failed to properly identify herself and was arrested. (b) She refused to properly identify herself and was arrested. (c) She did something that the writer of this article left out or was not aware of and was arrested. (d) The officer(s) involved abused their authority and the I.A. will prove this.
At this point anything else is pure speculation.....Period....
Denise--yes, the young woman is "accused of calling the police officer names." When a police officer knows darned well that he is doing something he should not, then he will try to manufacture something--they will beat someone yelling "stop resisting" so that the witnesses can be asked "did the officer tell the person to stop resisting" and the witnesses will have to answer "yes."
In this case, any witness would be asked "was the person told not to call the officer X." The witness would have to answer "yes," and would be cut off before the witness could say "but I didn't hear her use the word." Even if the witness said that, the point would be ignored if people (like you) want to assume that the word was used.
There are many fine officers--sadly, there are quite a few others who have figured out what they need to do to get "plausible deniability" in case of a complaint or how to arrest people simply because they want to arrest a certain type of person. Some like to lock up young women because they get off on seeing them locked up.
People scream about "unions" and "tenure," but how often do they scream about police officers' unions protecting officers until the bitter end (even when the officers are obviously guilty) and even when officers have the equivalent of tenure (though it is called "seniority"). If all the unions are to be dismantled and all the teachers are to be denied tenure--can we start making police officers responsible for such complaints and more easily fireable?
If police officers are made more easily fireable for such abuse of power, I think a lot of the rest of us would give up a lot to see that happen. There are enough fine officers left to do an excellent job of protecting us once the bad apples are gone.

Riverside Park is known for its Drug Activity, illicit sexual activity and various other Criminal activity after the sun goes down. While it's true the girl should not have been jailed for 2 day, the officers may have saver her life. Her "so-called friend" could have gotten her I.D's and taken them to the Police. Again, she should not have been jailed for 2 days but it's better than her being found as an "Unidentified Female Body" in the park.

That whole ordeal was ridiculous! If you read the article, policy would have allowed that officer to wait while one of her friends got her ID. The 15 minutes it would have taken to wait for that would have saved the city of New York could have saved on processing and court costs.

If the event went down as this young woman describes, then this police officer is a THUG, and needs to be disciplined. If he has a record of such senseless arrests, maybe he needs to go back to police school, or possibly taken off the streets. I am aware of this exact type of thing happening at least 2 other times - all in NYC. Bloomberg has a very corrupt police force in NYC - and it probably has always been corrupt. The only other place this corrupt is Louisana. Try driving down I-10 with out of state plates and you will find out.

From the treatment of my daughter, who looks Spanish, and some of her black friends from college, we have a serious profiling problem peppered with serious racism within our public safety officials. What kills me is my brother in law is a cop in Brooklyn, he is always in a great mood and tells about how much he loves his job. I couldn't tell you a single negitive thing he has done or said since the day i first met him 11 years ago. The only time he hated his job was after 9/11 and spending 16 hours a day at ground zero and seeing the things he had to see...BUT he never lost faith in his work, his fellow officers and doing what he knew was right. This handful of badge carrying jerks are giving the heart of Great Men and Women a bad name and should be punished to the Max of what the law will allow.

Everyone...could it be that just maybe because of certain terrorists that have made life on this planet a bit dangerous through the years...could it be a certain date in NYC's history about 10 years ago...could it be that certain haters of their own country have proclaimed an intent to kill any of us just because of where we live...could it be for any or all of those reasons that showing your id is a small price to pay to make sure none of these radicals get their wish?

If I am getting on a plane and you get pissed because you think it's against your "rights" to be asked for proof of some kind, I don't want you on the same plane I am on. Do you feel insulted? Too bad. I would feel a lot worse if you turned out to be one of those radicals and you killed me. I don't feel insulted if they ask me. I have nothing to hide. I don't feel my rights are violated. I feel my safety is being looked after.

The cop should have allowed her friend to get her id...end of story. Instead, he likes to be a bully...kinda thinks he's better than her because he has that authority. Sort of like the one in the airport that stands there and bitches like he or she is the only one that has something to do and isn't this a violation of blah blah blah...

To those who think that they don't have to identify themselves to a law enforcement officer in "any state" in the United States you should read this or you can remain ignorant of the law, your choice: http://en.wikipedia.org/wiki/Stop_and_Identify_statutes. The U.S. Supreme Court says that if you are detained by law enforcement for a suspected crime (trespassing is a crime) then a person must identify themselves to the officer(s) detaining them. If they can not or refuse to do so then the officer has the right to detain for a reasonable period of time to identify the person arrested/detained in the "Terry Stop." Also that same person if the refuse to identify themselves may be in violation of the crime of delaying a police officer or obstruction of justice. The park was apparently closed and the officer(s) were enforcing the law....PERIOD....
Additionally to the person who said that in New York you do not have to identify yourself to the police, PLEASE READ THE ABOVE! New York is one of 13 states that as of February 2011 YOU DO HAVE TO PROVIDE IDENTIFYING INFORMATION UPON DEMAND FROM A POLICE OFFICER. Identifying information includes but is not limited to; Name, date of birth and address. Much like in Nevada (or most other states) a person issued a citation does not have to sign said citation, it is their right to refuse to sign it. However since their signature is simply a promise to appear in court or pay the fine by a certain date, if they refuse to sign the citation they are leaving the officer with no choice but to arrest them, take them to jail and after booking they may post bail.
Now! Having said all this; I was not there, was anyone who posted here, there at the time this young lady was arrested? If not than all we have is he said she said and her friends heard this and that. In other words NO FACTS. The officer, much like the suspect/young lady in this case is innocent UNTIL PROVED guilty, not Guilty until they can prove themselves innocent just because some said it was so. While it "WOULD APPEAR" that the officer(s) used poor judgement in this case, we do not know what department policy is nor what other circumstances may have existed that caused the officer(s) to make the decision to arrest and detain.
If anyone has an true indisputable facts please post them, if not all our opinions and armchair quarterbacking that the officer(s) should have done this and not done that and that the suspect should have done this and not that is pure speculation. All we know is what someone was told happened by one party involved who has everything to gain by lying and nothing to gain by telling the truth, if the truth shows that the officer had just cause to do what they did.
In New York the city that never sleeps, who knows a park closes at 1:00AM. Bogus excuse to harass someone. The cop thought he was dealing with punks. Instead she is a photo-artist looking at the river because that is what she does. She enjoys looking at objects under different light.Unfortunately for him, if her story is true, he is toast. She appears to be a sweet young lady. I am curious what the school and her friends were doing to get her out. He showed his ID and ran off never to be seen? Ernie-201266 having to provide identifying information and requiring to show proof of identification are two different issues. All she is required to do is answer the officers questions as they pertain to her identity. No state or Federal law requires to show proof (papers); officers depend on this ignorance. Detain if they suspect she was untruthful is one thing getting the NYPD shuffle is harassment. Her friends probably could not locate her to provide the Identification and get her released she was being shuffled between precinct's. Like another poster stated we were not there and do not have all the facts. Hopefully Internal Affairs will sort it out.

It does NOT say you have to show any form of identification. You can give them the information and they are required to ascertain it's authenticity. That would be the part about detaining them for a REASONABLE period. The part about refusing to identify one's self refers to refusing to give your name and other the law information to an officer. It does NOT refer to producing an ID of any kind. Second, The officers were enforcing the law...PERIOD! Give me a break. It's a it's a misdemeanor ticket offense. HE was not enforcing the "law" he was enforcing his will...PERIOD!! Last but not least, don't put YOUR opinions out here and then lecture everyone else not to post theirs.

When they ask for your ID it is done so that they can check your name and make sure you are not wanted for any crimes. So you walk with her back to her hotel and she gets her ID. You save time (less than booking), money and your department's reputation. All lost now.

USA is great- In general, you don't have to provide proof of your identity upon demand in New York State. Maybe you would like to make that a law. I believe they have in other states. But it is not against the law to walk around in New York without your identification.
If the officer had some other reason to arrest the woman and wanted to obtain identification as part of the arrest that is one thing. He could have, for example, suspected her of dealing drugs or accused her of solicitation and held her for those actions.
But you can't be arrested merely for not providing your "papers" in NYC in 2011. The woman's point about other officers letting him get away with it are very well taken. Where was his supervising officer?

USA is great - you are as wrong as wrong can be. The officer can ask you for your name, but you are not required to provide ID. You cannot give false information, however you don't even have to provide ANY information. It is referred to as the right to remain silent by some........Check it out, it is written on some old piece of paper somewhere............

AJ Trespass is to deliberately interfere with the rights of the property owner. She and her companion agreed to leave immediately upon being informed that the park was closed. If the police officer was actually detaining her for the trespass, why did he let her companion leave the scene?
In the days before air conditioning, New Yorkers used to sleep in Riverside Park on hot nights. I don't believe even today anyone would stop you from crossing through the park or taking an early morning jog. It might not be advisable, but it is certainly not illegal.
There are no signs posted that I know of saying the park itself closes to traffic. The tennis courts and basketball courts close. There are hours posted for the skate park and Grant's tomb but not for the park or the bike paths.

AJ-10187929, did you read the article? The first officer on the scene was going to right them a ticket and send them on their way. But NO, the second thug with a badge showed up and demanded her ID. Then they proceeded to treat her like a felon. The douche bag wouldn't even let her friend go get her ID which was a mere 2 blocks away. It would have taken ten minutes for him to get it and return, instead, she spent 36 hours in jail, and apparently, in two separateprecincts. That right there is some great police work, this idiot should be promoted to lead investigator, and then on to the Mayor. usa...I was pulled over and didnt have my insurance card...I just got the new one and it was still at home...the cop followed me and allowed me to go inside and show it to him. Then he said thank you (after suggesting I put it in my wallet) and left.

if he let the male go, then he should have taken her back to the hotel to fetch her I.D.. poor example of a policeman.. probable cause, a real officer knows that if she gives her name without proof of verification but her companion provided his then he or she can assume if the two do not meet any description of someone the police are searching for, then its just a simple case of "i forgot my I.D". the officer is a bully, using his badge on a young pretty girl to feel manly..if anything he should have made sure she made it back to her hotel safely and told her to make sure she carries her I.D at all times when out in the big scary city..this officer should be fired..

Trespassing is a crime... it was clearly posted. If you read the poorly written story, her date was released with a ticket after showing his ID. Can the girl read? Didn't say she was blind and she is a college student, so I would hope she can read. Point being posted signs in the park clearly state that if she was there after X time its TRESPASSING... which is a... that’s right, Crime. Now, do you think it would be okay for her to have said used her sister’s name, DOB, address etc. fail to appear or pay on the ticket and now her sister is sitting in jail because the cops just took the criminals word for it? That is right; she committed a crime, which makes her a criminal. as for his supposed comments, I pray no one ever gets pissed off at you for doing your job, calls your work, claims that you said mean things to them, calls a TV station, then contacts news paper, and smears your name all over. If there are not witnesses to the claims of what was said, then is it fair to take her side? If he did say something about her date, isn't that freedom of speech? She was accused of calling the officer names, but no one is calling her out on that... something to think about, just in case you find yourself in jail waiting for a hearing because someone claimed to be you and because of uneducated outrage like this, officers just take people's word for who they are when they do something wrong and are pissed. yes trespassing is a crime and no dispute that giving them a ticket and paying a fine is justified, but the officer could have let her get her I.D and instead wasted hours of time and court time by being a hard @ss.. as far as i read she was not claiming an assumed name and her friend was given a ticket and provided I.D and was released...in the end her case was thrown out, so shes not even paying a fine, all for nothing...

Bluepanther20, exactly the same thing happened to me 20 years ago -- I was pulled over for a traffic violation at night (forgot to turn on headlights after leaving a brightly lit gas station), couldn't produce my insurance card (it was at home on my desk), but I got arrested, handcuffed, and booked on charges of uninsured driving and RECKLESS driving (a far more serious charge than was warranted). My friend drove to the station with my bail and picked up my insurance card on the way, but since the arresting officer had gone off shift they couldn't process it. I went to court eight months later and all charges were dismissed. The prosecutor told my lawyer the cop was "having a bad night." The whole debacle cost me about $1200 and 4 hours in jail.
I am thankful for the honorable police officers that serve us, but there are plenty of thugs too -- kinda goes with the job, I think...

A couple of years ago my wife took a nursing contract in Mesa AZ, our residence is in Mi and that is what license plate we have. We were driving through town around 1am when we were pulled over. He proceeded to tell us that the light for our license plate was out. I thought nothing of it and told him I was unaware of the issue but would fix it the next day. That next day we drove to an auto parts store to get a new bulb. I got out to check the bulb size before going in an d to my surprise there was not one light but two and both were working. Now it was summer and that area has a lot of elderly come from out of state to spend winters there. Many leave their vehicles. I can only guess that he was concerned the vehicle was one of those left behind and we had stolen it. I wish he would have said that because I would have felt like he was doing a good job of protecting and serving. Instead he lied and created mistrust. All it takes is one bad officer to tarnish the many who are decent.
The fine was for illegal use of a milk crate if you're referring to the article about the guy outside the hair salon. . Stupid law you say? Try telling that to the dairies who routinely spend over $1 million a year each replacing those stolen milk crates. Information easily Googled. As with shopping carts belonging to the stores, a dairy farm owns them crates and both have to pay their own money to replace them when they are taken.

Why is there no follow up to this story? Other than the initial NYTimes.com story, I haven't seen any other news organizations report on this. This NY cop could stakeout quiet streets and swoop down on jaywalkers. He could fill the jails with joggers. I guess that is his goal? A policeman should do everything he can to mitigate the circumstance. Instead of producing a revenue, this alleged jarhead cost the city money. If he was so hell bent to write a ticket, 10 minutes of his time would have solved it. Instead he spent more time writing a report and booking.

How silly your comment reads, not because you don't have a right to your opinion but because this is our system of justice. The cops have discretion in misdemeanor crimes, and in this case, he had the legal authority to do his job.
You have no idea what other factors made this officer decide to not give her discretion. Meaning you might have to stop the whining that the POLICE have an agenda type thinking(revenue crap).
And maybe think about THE PUBLIC'S expectation that the officer will do his job and not WORRY who it is he is dealing with. Meaning you have no idea how many neighbors complain about, loud or annoying late night goof balls in the park, you have no idea that she was a respectful angel, no have no idea what this OFFICER DOES LET GO.
As other REASONABLE minded people stated, this officer may not like people in closed areas, because HIS EXPERIENCE in dealing with citizens who have had negative issues, fights, assaults, attacks, lost items and so on stem from people in places they legal shouldn't be.

I see what you are saying. That's why I mentioned the no follow-up to the story. As it reads it does make the cop look real bad. So when I said "this cop", I was talking about the cop in the story. I'm leaning that there is more to the story. I said alleged jarhead because that is how the story portrays him. My revenue point was not to say the police have a revenue agenda but rather point out if the other person went to get the ID then the tax payers save money. That is why I have my doubts about this story. Why didn't the guy show up with ID? I'm thinking this story was embellished and that is why no major news organization has followed up on it.

I gotcha, and please dont take my COPS ARE ALWAYS RIGHT away from my stance i know that there's more to this story and the fact that most jails dont even book in misdemeanors anymore when an id is present unless its a crime of like theft because they use the finger prints to match other crimes.
Yes it bothers me that the guy couldnt seem to find anyone from the trip that knew how to get into her room or could locate her stuff to retrieve her id.
My OWN personal thought is that those two were warned by the first cop and got attitude with the 2nd cop and either both were drinking or her and the dude didnt like how she was acting and said F- it lol lol

And i am not so sure i believe the judges deal, i believe he released her but i am not so sure that he didn't have her a court docketed for a future date and released on her own recognizance.

Here in Maryland they do get food stamps if they have kids with them which I would venture to say is around 80% of them . They also get housing assistance and all other "free" perks again because they have kids with them and the illegals know this and therefore the illegals use this as their loop hole.

It is pretty simple because they don't have to provide documentation of citizenship for benefits. My state is one of the few left where illegals don't have to provide any papers at all to get a driver's license. Not to mention, they can take the written portion of their driver's test in their native language! Aren't all road signs written in English?! Once they have that driver's license, they are AUTOMATICALLY eligible for welfare, food stamps, Medicaid, the whole platter of benefits available from DSHS. Couple that with Washington's highest-in-the-country minimum wage, and it's no wonder that illegals from all over the country are flocking to the great NW.

Please read the story. She was trespassing that is against the law. The officer did not make up the law just enforced it. And she did not have ID they have every right to detain her until she can prove who she is. That too is the law. Do you just let everyone go or just this poor innocent girl?
Nick the officer was being an ass about it. Her friend had ID and they let him go. So apparently they were not pursuing the tresspaassing thing since they let her friend go. They were just harassing her.
Officers should be expected to use judgement when making decisions, exactly like the decision to arrest this girl. If he had suspicions that she was 'up to no good' then by all means allow her friend to go get her license to prove her identity, question her, whatever, but if she had previously declared that she was unaware of the law and would leave the park peacefully he should have just let her go...
Nick, I agree they had the right to detain her until her identity could be established. HOWEVER, according to their department policy, they could allow her to have a friend bring her ID to her to satisfy that requirement - which they did not allow her to do. Instead they shuffled her around for 36 hours, when this could have been resolved in less than one. I don't see the problem as requesting ID. Right or wrong, whether she realized it at the time or not, she was indeed breaking the law and requesting ID is not out of line. The problem is that instead of letting someone run back and get hers, they kept her locked up 36 hours and wasted her time and countless department resources unnecessarily.
The fact is, the cops can put ANYONE in jail for up to 48 hours without charging them with ANYTHING. This has been the law for longer than I can remember. The Supreme Court has upheld it every time it has been challenged. Furthermore, having been in and out of jail several times, I have first hand knowledge of how long the losers that work at the jails will take to proccess your paperwork, especially when it comes time to release you, usually at least 4-12 hours. Once they have you in the system, they are extremely reluctant to let you go. Why? They get money from the state for every day they keep you under their roof. It is against their financial interests to let you go, and they do whatever they can to maintain solidarity with their frontline cop brethren, i.e., "...if they brought you in here in the first place, you must be guilty of something."
If you're "trespassing", why does simply showing an ID let you off the hook? This wasn't "trespass." It was intimidation. PIGS.
Where I live, we just had a newsflash about a man arrested for his second murder. His first one netted him 20 years. He served 3 and was released, to kill again. But, we're OK with PIGS arresting and jailing people for "trespass" in a public park because they have no ID? Sick, sorry, and don't ask the taxpayers for raises if this is how you're going to conduct "law enforcement."

I honestly think what happened to this girl was overkill and shouldn't have happened, but the cop did not violate her right to liberty. She was trespassing in a park after hours. And if seeing the Hudson makes her happy, she can see it in her own town. The article said it runs near her home too. Or she could come back to the park when it is open.
If killing people made me happy (which it doesn't, but this is a hypothetical), and the cops stopped me, would they be violating my right to pursue happiness? Of course not, because I would be breaking the law.

It is clear there are some here who will defend the actions of the police no matter what. Perhaps they are police or a close family member or friend is. I get it. But, allegiance should not prevent you from seeing right from wrong. If they were pursuing tresspassing charges, then logic dictates they "detain" her friend. They did not. They let him go. So too the "tresspassing" charge goes out the window as well. What is left? No ID?? Maybe having ID on you in public is the law, maybe it is not. What we know from the article is the officer, per the department regs., is allowed to let someone go and get the ID they requested. Since the friend was allowed to leave (because he had his ID) they could have easily waited or better yet escorted them to the hotel for the ID. That did not happen. Why? Bad cop or good cop having a bad day and decided to make this person's life miserable for a night (or two). Can you tell right from wrong in this scenario or will you just blindly defend wrong because of who committed the deed?
I agree with the young lady. If so many in the precinct knew what she was being held for was bogus, why keep her there? Even more, why would the DA even consider these charges to begin with?

in all seriousness, I find it very disturbing that some people here believe that simply being in a public park ( there is no indication that they did ANYTHING else "wrong") and not having ID on her person means that a young woman can be detained by police for over a full day...there are some CONVICTED criminals who do not spend that much time in jail...imo they should have been told to vacate the park, and when she could not produce ID, then the cop could had followed them to the hotel ( a whole 2 blocks) to get her ID...I find it ridiculus that tax dollars were wasted on this, and that the other police knew something was not right but went along with it anyway...you cannot tell me that every person here has not gone out with out ID, either on purpose or by mistake, and that you review all the laws of the towns you ever visit..this whole thing is idiotic and shameful.

Many illegals do pay taxes because it acts in their favour when they try to become legal.
They stimulate the economy by shopping for huge barrels of groceries, clothing etc and shipping back home, some also have businesses that employ people.
They cannot take advantage of the social benefits like welfare, foodstamps and disability insurance because they do not have social security and they live with the constant fear of being caught. The ones who are brave enough or can afford to purchase false IDs are few.
Very many Mexicans in this area have an official Mexican ID card, the Matricula Counselor. They are officially registered as being in this country by the office of the Mexican Counsel in Atlanta, so they can use this to open bank accounts, cash checks, etc. Of course, the Mexican government has no legal authority to allow anyone to enter the U.S. This makes for a very awkard situation. (Can you imagine a U.S. counselar office assiting in Americans being in Mexico illegally and what the outcry would be?) Let's face it, their citizens receiving money from the U.S. is one of Mexico's largest "industries", and without it there would be far more pressure on the government for real reform and the creation of better jobs there.
Are we slipping into a police state? I'm afraid of what might happen to OWS when orders come down from the wealthy puppet masters. I know the police will follow those orders, even when they know there wrong. I'm hoping that if those orders come, someone will call in the national guard to protect the protesters.

I completed my master's degree in NYC in the mid-1970s. While there, I participated in a study of the NYC judicial system, particularly monitoring how quickly people moved through the justice system. It was not uncommon for people to get "lost" in the system for days, sometimes even weeks, being moved from precinct holding to court and back. Hearings did not get held as paperwork was lost or unavailable, officers did not show up, etc.
What we are seeing today is no different than the games played for decades or longer. And NYC police are no different than police in many cities; they get a position with authority and it goes to their heads. Common sense and good judgment are lost; the public and innocent people suffer as a result. It is long past time to rethink our entire justice system and how it operates.

A New Jersey man took his case all the way to the US Supreme Court. He was stopped for suspect DUI and the test showed otherwise. He was still kept in a jail cell for a time rather than let go.
SCOTUS ruled law enforcement could do that even though it was proven he didn't break a law.
In fact, it's actually law enforcement and thereafter prosecutors who decides who broke a crime, who to arrested, it's at their discretion.
And the SCOTUS has almost virtually destroyed Miranda. It doesn't take affect until law enforcement decides to tell you that you're officially under arrest. Most people believe the arrest starts once you're handcuff. Not so according to SCOTUS.
So once they tell you they're taking you in, say nothing other than make a demand for a lawyer.
You have the right to remain silent at all times. You don't need Miranda rights said to you. If you are handcuffed then you can ask if you are under arrest. Most people are not handcuffed but depending on the situation an officer can place you in cuffs.
I know that but people watch tv and think otherwise. They also believe they're under arrest when law enforcement puts them in the vehicle.

Considering it was two sandwiches which equates to $10.00 and their grocery bill was $50.00 so they stole/ate 20% of the groceries they bought. I dont know about you but if it was my grocery store I would have had them arrested too. A business cannot run if folks are "accidentally" consuming 20% of what they are spending. The pregnant woman and husband were arrested because they "stole" food from the store and this girl was arrested because she failed to produce an ID showing who she is. No different.

Um, no, you can not tell that someone is a veteran by looking at him. I just think the fact that he served his country should give him a bit of respect from the jerk cops. The wife needed food, she was faint in her advanced pregnancy. They kept the wrappers while they shopped and intended on paying for the sandwiches, but were not allowed to correct their mistake by paying for the sandwiches, instead they were arrested and their child was physically removed from them by social services. The whole thing is ridiculous. I am totally against shoplifting, but the story about the student and this story just proves that common sense is a thing of the past for law enforcement. During long shopping trips, I have let my kids start munching on a snack and paid for the snack while going through the line. It is a pretty common thing. So the couple forgot, let's traumatize their kid!!!
The article stated that the woman "munched" on the sandwich while continuing to shop. If she were faint she would have "munched" on the sandwich while sitting down. Her husband could have gone to the checkout to pay for the sanwiches while she recovered from her faintness.
I don't think these two cases are similar. If the two were in the park at night they could have easily missed the signs. I've seen some of these signs-very small.

It was not just in New York City, this is now look like the way American Government Proctice right now. Well, that's one NY cop who's tired of being a "hero". The judge was probably already overloaded with cases but it's a shame he couldn't make a phone call and demand the cop make an immediate appearance in his/her courtroom to explain himself.
Well you see judge, it's policy that when someone breaks a law we ask for ID and if they can't provide one we detain them until we can find out who they are. If you don't like that policy talk to the police commissioner but that's what I have been told to do.
There is no law that says one must carry an ID. To hold someone for such a petty "crime" shows idiocy on the cop's part. I guess that's why he's a cop.

Also she was not held for the petty crime of trespassing. She was held because she did commit a crime and could not prove who she was.

Let's highlight the important part of what you stated in bold... Now, here's the issue, the officer in question knowingly released the young man with her because he had ID right? Now using common sense the officer likely knew that she was a student too, and if he didn't then he easily could have found out that fact for certain in less than two minutes time with a simple phone call, which he didn't do. If he was not inclined to accept a phone call as proof of her ID then he easily could have had the young man who had been with her bring back her ID as proof, maybe taking 20 minutes of his time. Instead the officer chose to spend taxpayer money to the tune of approximately 20,000 dollars after you take into consideration the two nights in cells, two trips back and forth to booking from Harlem, the officer's, who took over for him, time while he was off duty, court cost, and meals.
Her actions may have constituted a crime, I wonder if the time of closing was posted where the young people entered the park, since the officer didn't argue about them not knowing it was closed, but let's be honest, who committed the bigger offense. I vote the officer did.

I have the right to carry or not carry ID as I see fit, not some pissed-off-because-I-have-to-work-nights police officer. I hope this young lady sues the officer in question, his shift supervisor, the precinct Captain, the Commissioner, and the Mayor for allowing this individual who is obviously not suited to be a police officer to wander the streets with a weapon and on the payroll of the city.
Nick... You are a cop or a cop's son or both aren't you? I mean, you are going way out on a very fragile limb to defend this one officer's actions. Are you capable of seeing how unrealistic this one officer's actions are? OK, so maybe it is policy, but like most policies, there is gray areas. After all, according to the department rep, he could have allowed the friend to get the ID back at the hotel.
As a cop, please tell us what good reason is there to not allow that to happen in this harmless situation? He couldn't have felt threatened. He was armed. He was not alone (he was the 2nd cop on the scene).

I think that the responses to this article are completely contradictory to the responses that we normally get in the cases with African-American men that are abused in the same way.
For example, go outside of a club where the majority of the crowd is Black and I would bet more than half of the crimes charged have to deal with possession of marijuana and had only come to surface after a non-threatening and much more trivial offense had been cited (as is the case with this young woman being in the park past its closing). Now, I'm not trying to say that not having an ID is as bad as the crime of possession of marijuana. There's a whole lot more involved in the latter. But I do think the situation here is useful for understanding how a crimes punishment might make a situation worse off. Of course, sometimes there are crimes that need to be dealt with in a harsher manner, but this is not my point.
Why are non-threatening and for the most part "poor-judgement crimes" allowed to be tried so harshly in the justice system, further solidifying the trend that the law is above good judgement? According to NY law, the cop was completely justified in his actions. But interestingly enough, most people can see quite clearly that his actions did nothing to help the situation.
It seems quite obvious that the justice system is broken because it causes people to enter a system that is retributive rather than rehabilitative, even though a vast majority of the crimes that are committed are non-threatening in the way that they do not harm society.I think this story is important, and am actually in a round about way glad that it happened, if not just but to bring to light the harsh manner in which the justice system deals with these types of crimes, many of them committed disproportionately by Black men.
The fact remains that this cop did not break any laws and was fully justified in his actions according to NY law. The deeper and more interesting question however should be, why do we live in an America where this kind of ineffectiveness has been allowed to continue for so long? And speaking even more to institutionalized racism, why is it only when THIS young lady gets put in this position is their such a huge response to the issue?
Even more what I wonder is, how many situations like this have become complete non-issues and altogether dismissed, simply because a police officer decided that the crime a young white woman committed was not equal to the level of punitive actions he were fully justified by law in taking?
@S.T.-3384625..the officer may not have broken any laws, but why did he let the male trespasser go?? why wasnt she allowed to get her I.D. at the hotel??? the trespass was no longer an issue after the other person was let go, but her not having I.D warranted over 30 hours of police time and her time?? it would have been cleared up in ten minutes if they took her to the hotel...i dont think anyone should be treated like a criminal for these kind off little things, and i know what your saying about race playing a big role in those kind of situations..

Your saying exactly the point that I was trying to get across. Sometimes crimes (as in not carrying your ID) are just...well, not that serious. Also, the crime of not carrying her ID was in fact found out only after the non-threatening and more trivial, 'poor judgement crime' of being in the park after closing occurred. This happens a lot. In other words, many times police officers go out looking for trouble thereby actually initiating it, when it most likely never would have occurred in the first place.
To your point though: In this case, obviously the punishment of two nights in jail did not fit the crime of not carrying an ID. Something else could have been done to resolve the situation so that a more positive result could have been achieved. Most people are making this determination with very little effort. But its just funny to me that people are reacting this way, when this kind of situation goes on everyday for Blacks and has been unfair, in this way for years. Basically, I'm just making an analogy.
So then: What would be wrong with legalizing marijuana, and government effort to change the way society views the drug's use? This would actually do a whole lot to counter the effect the justice system has on the erosion of blacks' life chances IMO, and would help to reduce the effect of institutionalized racism.
St - It is NOT A CRIME TO NOT CARRY ID, it is not a crime to NOT have ID. Don't believe me??? If it is a crime to not have ID, then 99 percent of kids between 1 day old and 15 are criminals as most kids don't have ID until they get a drivers license..........Most homeless don't have ID as most states require an address to issue an ID, No address no ID..........are all these people criminals??????????
So then my2cents70, more to your point....If you looked at your rationality behind not wanting to have this young lady treated as a criminal for this type of crime....what I'm saying is..... this same way of thinking would most likely explain quite nicely why drug users (specifically marijuana users) should not be treated the way they are treated in the American justice system.
We can't just have people getting harsh punishments for not carrying their IDs. The intent of a punishment should be to inspire order and obedience toward the law. I'm sure the young lady would have learned her lesson had the police officer had her go to the hotel. In other words, the "punishment" of having her go back to the hotel would have been sufficient to in the future, deter the "crime" of not carrying her ID.
So when I make the analogy to the justice system, saying that the punishments are retributive rather than rehabilitative, I'm merely saying the punishments right now do not reflect a genuine desire to inspire obedience and order.

S.T...what im saying is the crime was trespassing, you dont need to carry I.D there is no law for that, however because she couldnt prove who she is she was detained wich is very legal for the police to do..but she was with someone who could and also could help her get her proof of I.D, that should be enough for her to be done with the situation in less then an hour at most...

It's up to the top brass to make sure this officer deeply regrets his actions - and change the 'group-think' to challenge this sort of abuse of power, not tolerate it. Every force has a few fascists but we rely on the rest to stand up to them.
Policing required the consent of the community, and this officer has reduced the available goodwill. Police are not an 'occupying force', they must remain accountable to the public or we're all in deep trouble. I hope this lady makes a formal complaint and that this officer is hung out to dry.

I applaud Police Officer Durrell of the 26th Precinct, New York Police Department = he probably saved both of these worthless pieces of shvts lives that night by catching them trespassing there. And these two, woman and man were up to no good, AFTER 3 AM and in a City Park = either going to have sex in the park or do dope and this police officer read right through them and their lies, etc. Way to go, Officer Durrell.
IT IS AGAINST THE LAW TO NOT CARRY YOUR STATE PHOTO ID in every State of the United States of America. Besides being common sense. Follow the Law OR get arrested and spend time in jail, etc. A Judge might throw it out = for time served = but that LEO got credit for an arrest; which every department uses toward awarding raises, promotions, etc. and who keeps their jobs in times of cut backs, layoffs, etc.
Where I live now, to be considered for a raise or promotion, etc. LEOs have to issue so many traffic violation tickets a month = yes this includes not using your turn signal, following too closely, going to slow in fast lane, any and all State traffic violations; write so many tickets for failing to wear a bicycle helmet and all other laws regarding riding a bicycle off or your private property = front and rear lights, reflectors, etc; make so many DUI and Drug arrests per year; domestic violence, prostitution and even broken down as to customers and prostitutes; felony arrests a year; etc. It is all broken down. Which I totally agree with because many LEOs choose not to be bothered arresting criminals for certain crimes and some are just down right afraid to.
I guess this idiot student and her idiot supporters would rather that if anything happened to her, she would be left unidentified. Like if her nude, dead body was found in the East River with no ID. No way of knowing who she was after fish ate off fingers , no jaw bone with teeth found and other body parts. Then she would be buried in a pauper's mass grave. This woman and man were trespassing, which is a criminal offense, also in all States of the United States of America. The Park closes at 1 am and then she got him "to walk with her a few blocks to the park, at about 3 a.m." They purposely entered into a closed park 2 hours after closing time and no one thinks this is a crime. Then "We said, ‘O.K., we didn’t know" = what liars these two are. All parks has signs posted at all entrances with the times they are open and closed and most people in any City, especially New York has common sense to know that you do not go walking into or around any park at night time, let alone after midnight; unless you are up to no good.

well i think the majority of the posts agree that it was a little to extreme for this girl to spend 36 hours in custody over a petty crime off trespass due to not having an I.D..also a waste of law enforcement time, given the outcome... however law enforcement did have the right to detain her to keep the public safe from a possible fugitive on the loose???hmmmm...you may want to know what your fourth amendment rights are if you are found in a situation like this.
