This is a politically motivated prosecution not a valid charge. If the two people that the official shot were both armed it would seem that his use of deadly force was reasonable and necessary to keep from being killed himself. In addition, diplomatic immunity should have precluded the person's arrest or at least resulted in his immediate release once his status was verified, unless the consulate waives immunity, which would be highly unlikely in this case. Normally what would happen is that the official would be declared persona non grata and forced to leave the country. This whole thing sounds like the Pakistani government pandering to the anti-American factions in the country in order to keep them from attacking the government. I would expect the US government to will soon file a formal protest against the detention and charging of the official and that the person will wind up leaving the country. In addition, the US may pay some "restitution" blackmail money to the families as a way of appeasing the Pakistanis, although I hope this does not happen because it will only encourage future prosecutions motivated by money.
Let's just flip the storyline around. Pakistani diplomat kills two people in New York who were walking up to his vehicle. The Pakistani diplomat said it was self defense because he thought they were going to rob him. A third citizen was killed when he was accidentally run over by Pakistani aids rushing to the scene to protect the diplomat. The Paikistani diplomat is set to fly back tommorrow to Pakistan because of diplomatic immunity. Americans would be crying out for justice, just like the people in Pakistan want.

The embassy said the man was acting in self-defense when he shot and killed two armed men as they approached his car. It said the men wanted to rob him, something police also have said.

If a Pakistani consulate employee killed two armed men trying to rob/attack him here in the U.S., we would scream for an investigation at the very least. If an American man with a gun permit, killed two men trying to rob/attack him here, he would go to jail (or have to post a bond) until the matter was settled.
I think since the police have agreed that the men were out to rob/attack the American, they should allow him to go back to the embassy until the matter is resolved.
craig - Are you really that naive. What you propose would turn every foreign service employee into a target for use as a pawn in international disagreements. They could be held on trumped up charges to extort all manner of concessions, money, support, etc. by a foreign government. We would only be able to have diplomats in place in countries where w have long standing friendly relationships, which is where we need them the least. If a country feels that their representative really did something wrong and deserves punishment they can either prosecute them when they return home or they can waive the person's immunity and allow their prosecution in the country where they committed the offense. There have been many times where countries have waved diplomatic immunity and allowed their citizens to be prosecuted for major crimes like murder, rape, drug trafficking, etc. Diplomatic immunity belongs to the nation, not the individual, so no individual would think they could use it as a shield to knowingly commit crimes and snub their noses at authorities.

Why is The United States claiming he did this in Self Defense when America does NOT reconize the plain defense of self defense anymore. Some states have now allowed that all you need do, to use deadly force is to prove the enetered your home or car and did so forcefully. However, some states allow this, others do not, some allow the car and others just the home breakin while you are in the home, some say the hours of break in determine your risk.

First diplomatic immunity is only a get-out-of-jail-free in the host country; you're not a diplomat at home in the US and yes, you are placed on leave, subjected to prosecution after PNG (persona-non-grata) from the host country (leaving everything, including pets and possessions behind, by the way, unless the host government decides to give you some time). The immunity must be a blanket coverage per the Vienna Conventions, which all countries that the US has representation in have recognized and agreed to respect and, by the way, use (hence the heinous traffic fine nonpayments) themselves. The reason is that there are laws that diplomats are not AWARE that they are breaking - in some countries a woman without a man is breaking the law and diplomats cannot conduct the business of state under fear of constant arrest, particularly if relations are ... tentative. I am not here to defend Jeff, but from his post you can tell he didn't serve in the military because of...what exactly? His post, like it or not, is about how Obama doesn't present much of a concern to our Middle Eastern friends, or enemies. All of this supposed love for the USA by replacing the evil Bush with the caring Obama seems to have been more fantasy than anything else. And fantasy, when dealing with people who would happily cut your head off, isn't the stuff of good foreign policy.
I don't think Jeff argued for invading Pakistan at all, though that might be his point, just unstated. I think he instead was looking to highlight the distance as a nation we have travelled from Machiavellian teachings. Right or wrong, we will not get this guy from Pakistan for any reason other than the government there will see some benefit--money or power or who knows what--for releasing him. But fear of a powerful America isn't one of their potential motivations.

How about we just continue to follow international law on these types of cases? We shouldn't go after their diplomats illegally, unless it's our goal to end international diplomacy. And we can't apply tariffs on imports without all nations affected by them from being able to apply tariffs to our exports to them as well. Before you say that is a great idea consider that one of the many causes of the great depression was isolationist trade policy. But heck, it's been more than 70 years since that recession so it seems a silly idea to think we should learn from our mistakes then. We are so much smarter now anyhow. Doing the same bad things today wouldn't have the same consequences because we are smarter, better, and care more.

So I agree we should not have as our first goal to be liked by people who deep down hope we can all be killed and our nation destroyed.
The only thing we would succeed in doing by forcing imports down is killing off millions of jobs at retailers that sell items from places like China, loading docks, customs check points, and putting even more tension on some of our IR with countries that heavily export to us.

Why don't you ponder this for awhile. I was over in the middle-east a total of 20 months. I was in Bahrain.
Me being an American, and if I was driving a car and stopped at a stop legally like I'm supposed to be and a Middle-easterner rear ends me. I am automatically at fault just because that is not my country and if I hadn't been there, that other driver wouldn't have rear ended me.
The Ideals of the people of the middle-east are lopsided. Primarily these ideals reside in the minds of the people ruling the countries. Those that make up the laws and those that enforce them.
I never met a middle-eastern person that wasn't polite and friendly with me and dealt honestly with me. I've seen far more Americans over there being rude and arrogant towards them. We do have a lot of Americans that need a good dose of humble pie.
However, it's the laws and attitudes of the Authorities in the middle-east that screw things up. They are living by laws that were written 1400 years ago.
America-Today-Anthony: You miss a slight detail in your wishful thinking: Pakistan has nuclear capabilities, either for peaceful purposes and otherwise. That's the only reason we're interested in helping them out. Because regardless of what side of the aisle you may be, you don't want nuclear weapons to fall into the hands of religious radicals. Do you think that it would lapse five years before these genius launch a nuclear attack on us if we walk out of Pakistan and leave their nuclear arsenal open to be taken?
If an Iranian or Muslim diplomat, shot and killed 2 robbers in Washington, would you want him to simply get on the next airplane out, or would you want him questioned? Of course we would want him questioned. The reason people don't like Americans is because there is one set of rules "them" and another set of rules for Americans. Do we like it when there is one set of rules for "us" and another set of rules for government workers?
This is a politically motivated prosecution not a valid charge. If the two people that the official shot were both armed it would seem that his use of deadly force was reasonable and necessary to keep from being killed himself. In addition, diplomatic immunity should have precluded the person's arrest or at least resulted in his immediate release once his status was verified, unless the consulate waives immunity, which would be highly unlikely in this case. Normally what would happen is that the official would be declared persona non grata and forced to leave the country. This whole thing sounds like the Pakistani government pandering to the anti-American factions in the country in order to keep them from attacking the government. I would expect the US government to will soon file a formal protest against the detention and charging of the official and that the person will wind up leaving the country. In addition, the US may pay some "restitution" blackmail money to the families as a way of appeasing the Pakistanis, although I hope this does not happen because it will only encourage future prosecutions motivated by money.

Let's just flip the storyline around. Pakistani diplomat kills two people in New York who were walking up to his vehicle. The Pakistani diplomat said it was self defense because he thought they were going to rob him. A third citizen was killed when he was accidentally run over by Pakistani aids rushing to the scene to protect the diplomat. The Paikistani diplomat is set to fly back tommorrow to Pakistan because of diplomatic immunity. Americans would be crying out for justice, just like the people in Pakistan want.

These weren't two people who just happened to be walking up to his car.
The embassy said the man was acting in self-defense when he shot and killed two armed men as they approached his car. It said the men wanted to rob him, something police also have said.
This puts everything into a completely different light. Two innocent pedestrians or two armed robbers.
The Pakistani police agreed that they were armed robbers.
Koldwindblows: Semantics aside, my position is that there shouldn't be diplomatic immunity, period. Let the courts decide if it was self defense or not. If a country uses underhand tactics to set up diplomats, then countries can pull out their embassies. That's my opinion on the matter.
If a Pakistani consulate employee killed two armed men trying to rob/attack him here in the U.S., we would scream for an investigation at the very least. If an American man with a gun permit, killed two men trying to rob/attack him here, he would go to jail (or have to post a bond) until the matter was settled.
I think since the police have agreed that the men were out to rob/attack the American, they should allow him to go back to the embassy until the matter is resolved.
craig - Are you really that naive. What you propose would turn every foreign service employee into a target for use as a pawn in international disagreements. They could be held on trumped up charges to extort all manner of concessions, money, support, etc. by a foreign government. We would only be able to have diplomats in place in countries where w have long standing friendly relationships, which is where we need them the least. If a country feels that their representative really did something wrong and deserves punishment they can either prosecute them when they return home or they can waive the person's immunity and allow their prosecution in the country where they committed the offense. There have been many times where countries have waved diplomatic immunity and allowed their citizens to be prosecuted for major crimes like murder, rape, drug trafficking, etc. Diplomatic immunity belongs to the nation, not the individual, so no individual would think they could use it as a shield to knowingly commit crimes and snub their noses at authorities.
Nice to see that some people get it. It's simply political necessity and reality to hold the guy, for a while. We would do the exact same thing if it happened in America, if only for appearances and to get his statement on the record before he slips out of the country. People here would be going nuts if the guy was just allowed to board a plane and fly home before some kind of investigation was completed.

Why is The United States claiming he did this in Self Defense when America does NOT reconize the plain defense of self defense anymore. Some states have now allowed that all you need do, to use deadly force is to prove the enetered your home or car and did so forcefully. However, some states allow this, others do not, some allow the car and others just the home breakin while you are in the home, some say the hours of break in determine your risk.
To all American's just do not rest on the thought that claiming self defense is an all in one protection. It does depend on your state, where you live in the state and then a multitude of factors not know to very many.

While I can appreciate that diplomats seem so last century, you cannot really get the lay of the land from afar.
and some states have an equal force law. so if your in bed sleepin and you hear someone in house and grab your 45 but the person has a knife and charges you your suppose to drop the gun and get a knife to defend yourself.

First diplomatic immunity is only a get-out-of-jail-free in the host country; you're not a diplomat at home in the US and yes, you are placed on leave, subjected to prosecution after PNG (persona-non-grata) from the host country (leaving everything, including pets and possessions behind, by the way, unless the host government decides to give you some time). The immunity must be a blanket coverage per the Vienna Conventions, which all countries that the US has representation in have recognized and agreed to respect and, by the way, use (hence the heinous traffic fine nonpayments) themselves. The reason is that there are laws that diplomats are not AWARE that they are breaking - in some countries a woman without a man is breaking the law and diplomats cannot conduct the business of state under fear of constant arrest, particularly if relations are ... tentative. I pray Mac101 is correct and this turns into a show, then they say that yes, they're playing with the big boys and really are civilized mostly, and PNG him. He will face charges, investigation and prosecution - although probably not for the innocent who the local driver killed en route to the scene. They have drivers for official business, but not to and from work. Can you imagine the outrage the taxpayers would raise to find out that diplomats got picked up and home and driven in to work and on errands? I am not here to defend Jeff, but from his post you can tell he didn't serve in the military because of...what exactly? I don't think Jeff argued for invading Pakistan at all, though that might be his point, just unstated. I think he instead was looking to highlight the distance as a nation we have travelled from Machiavellian teachings. How about we just continue to follow international law on these types of cases? We shouldn't go after their diplomats illegally, unless it's our goal to end international diplomacy. And we can't apply tariffs on imports without all nations affected by them from being able to apply tariffs to our exports to them as well. Before you say that is a great idea consider that one of the many causes of the great depression was isolationist trade policy. But heck, it's been more than 70 years since that recession so it seems a silly idea to think we should learn from our mistakes then. We are so much smarter now anyhow. Doing the same bad things today wouldn't have the same consequences because we are smarter, better, and care more.
And our motto has been what you say it is before. Carter was a perfect example of this. Woodrow Wilson too. Clinton, a little, but not all the way. None of those episodes worked well for us either. So I agree we should not have as our first goal to be liked by people who deep down hope we can all be killed and our nation destroyed.

The only thing we would succeed in doing by forcing imports down is killing off millions of jobs at retailers that sell items from places like China, loading docks, customs check points, and putting even more tension on some of our IR with countries that heavily export to us.

I do not know the i's and t's of the international laws but I am willing to bet there is a clause some where about property protection, just like there is in the US. If someone robs your house here, even if they are not armed you can shoot and kill them in self defense if you want to.

On a SpyBoy mission and there was an altercation. He out QuickDrawed them and called for help. His team hit heavy traffic and congestion, ran over and killed another person on the way to the rescue. P.O-d the whole pack of marketplace shoppers and they would not let them escape.

As far as it being a frequent occurence, I don't know. But if the threat isn't high then why would diplomats need DSS agents everywhere they go? Maybe they use the same level of security in Japan, or Canada, but I doubt it.

1 ) Law & order situation in Pakistan is obvious to all of you. Can sombody tell me that if he is a real diplomat then why he was travelling alone on the streets of Lahore, in a private car with fake number plates, armed with non licenssed weapon?
2 ) Violating diplomatic norms, prior to travelling, why he did not inform local authorities so he could get protection?
It's quite possible that he acteded in self deffence & he might have diplomatic immunity but one thing is for sure. He is not a diplomat, he is from CIA or XE or Black Water. So he has to pay the price for being exposed.
