federal government has been trying since March 2009 to get officials to comply with its probe of alleged discrimination, unconstitutional searches and seizures, and having English-only policies in his jails that discriminates against people with limited English skills.

When in an American jail it would only make sense your jailors speak english.

In sheriff joes jail you are guilty until proven innocent, i disapprove of his practices and the way he has his employee's treat people. I myself was struck by a guard for having an inhaler for bronchitis (which was released to me at the Mesa, AZ jail by the employee's there before my transfer to Madison), the inhaler was taken away and i was left to suffer for 3 days. I was fed 3 times during my entire 7 day stay in the jail. And upon my second release they had no idea where i was and were walking from holding cell to holding cell calling my name into the rooms, i could hear them all the way down the corridor. Starving people, physically assaulting people, and losing people are bad practices in my opinion when running a jail.

The only sensible person in this entire thread is cmharmon. I came from Phoenix and moved out of state just as Arpaio won his first election. I've known people that have been wrongfully accused and incarcerated in Maricopa county and cmharmon's experience is far from isolated. I have NO problem with subjecting CONVICTED criminals to LEGAL hardships, it is, as has been said, punishment. The problem is the few days it takes for someone that is incarcerated wrongfully to be released. Those people are subjected to the same abuses as the CONVICTED criminals. The same goes for innocent people that are arrested that have no bail money. They rot in the same conditions for months waiting trial.

As for the good Sheriff making the county safer, when he conducts his infamous illegal immigrant sweeps, deputies typically only find a handful of immigrants who are in the country illegally, and for all anyone knows, this is their only crime. Meanwhile, his office is SITTING on over 40,000 outstanding FELONY warrants. That's right folks, the sheriff is ignoring 40.000 known felons to go after illegals, and these sweeps are ALWAYS accompanied by a news camera crew. THAT is how he keeps getting elected. Not to mention his practice of intimidation against any of his detractors. Imagine being a county employee and having the sheriff show up at your doorstep on a weekend, and there is NOTHING you can do about it without fearing greater reprisals.

Last point is all the money this is costing the residents on Maricopa county that have to pay to defend him from what lawsuits actually are filed, and all the tourism money that Arizona used to receive that is drying up as the state becomes the laughing stock of the entire nation. The man is a self-serving, egomaniacal waste of money who will do whatever it takes to retain his power. If you are a citizen of Maricopa county and you think Sheriff Joe gives a damn about you, you are deluding yourself. He only cares about his power.

Patrick, ignoring the fact you misspelled incarcerated even with the benefit of spell checking, since the sheriff is "apparently" making a concerted effort to rid his jurisdiction of every illegal immigrant, and it isn't racial profiling because all the illegal immigrants are Latinos from Mexico (a point so many here use to defend the sheriff against charges of racial profiling), then doesn't it just make good sense to make some accommodations for Spanish speakers in the jail population? How do you expect these inmates to understand the guards' orders and the rules? I'm not arguing that the sheriff should have a guard that speaks fluid Finnish, but if ALL the illegal immigrants are Mexican, and the sheriff's goal is to arrest ALL of them, prudent planning would dictate Spanish speaking accommodations. 1. Holder is not suing the state in this case, just the sheriff. Perhaps Driftwood and the others would like to lump them all in together, but lets keep on subject.
2. This case is not about AZ's new immigration law, it is about compelling the sheriff to fulfill his duty. However you may wish to interpret the immigration law or the Federal response to it, there is absolutely zero controversy over whether this man has a legal obligation to provide public documents when requested. Especially when subpoena by a criminal investigation.
3. The only law at issue in this case are ones which pertain to discovery procedure and freedom of information. Even if the federal government were refusing to enforce the federal immigration statute (which they demonstrably are not) it would not make the sheriffs actions less illegal.

When those who enforce the law violate it, as this sheriff has, they break the trust of everyone they represent. A majority of voters may forgive him, but the law is not there to protect the majority. The law is there to protect the One.

Personally, I think it would do him good to spend 14 days in a federal prison. He won't. That would be unprecedented. But it would be nice if a punishment could be met out that would hurt instead of simply serving as his next campaign speech.

Arizona is also being sued by Holder's department.

The Sheriff hasn't violated the law. The documents were already a matter of public record and available for viewing. He's been investigated before and these same documents have been produced many times. And he's stopping and/or arresting those that commit crimes. Doing his job.

Another racism remark from someone who does not have a clue! The Mexican illegals, and those who support them are the racists!!! Every demonstration that has been covered shows it's the "brown skinned" people demanding rights they have never earned or fought for, and they have a funny habit of displaying a Mexican flag during these demonstrations. References please? The federal statute regarding foreign invasion specifically and exclusively empowers the president and the attorney general with determining if an invasion is occurring or imminent.

You may describe the inflow of illegals as an invasion, but in law things are a little more specific and what you object to does not meet the legal definition of an invasion. And even if it met the definition that determination is left to the president or the AG to make.

And even if they felt it was an invasion, the law you claim they are not upholding states that the president or AG have final say in how or even if the federal government shall respond.

We had a federal government once. With strong states rights and a very minimal central government. It failed miserably. Like within a few years after ratification they were planning out how to tear it apart and start over. But even under that system, the President would determine the response to a "foreign invasion".

If you want to wrap your ideological complaints up in the constitution it would help you immensely if you read it first. Ideally you would do well to read it slowly over the course of many years, guided by esteemed scholars, in an environment adjunct with complimentary instruction in history, law, English and French language, and rhetoric. All of this is necessary, truly necessary, for synthesis of thought on this subject.

You are reading something drafted by educated statesmen and lawyers hundreds of years ago that was heavily influenced by the history and language of England and France. Without the tools mentioned above the best you can hope for is to latch on to what someone else has said it means, repeat buzzwords, and surround yourself with like minded people who never critically analyse what you say. Joe Arpaio is directly and personally responsible for stillbirths and miscarriages; and the deaths, brain damage, and severe injuries of newborn babies. Women who go into labor while in his jail aren't allowed to hold or even see their babies after they're born, even the ones who survive.

Joe brags on TV that he only spends 40 cents a day on each inmate, and it's true; but only because in Arizona when you go to jail you have to pay the government $70 in rent for each day you spend in there. This is in addition to "fees & surcharges," and in addition to any fines or restitution.

You have to pay $70 a day to go to jail in Arizona.

Joe Arpaio's jail does not meet federal standards for accreditation by the National Commission on Correctional Health Care. His NCCHC accreditation was revoked, which means that he is operating his jail in violation of state law and health department guidelines. Arizona does not provide a remedy or punishment if and when these laws are broken, so Joe just gets away with it.

Damon Dreckmer has Crohn's disease, but Joe felt that his $4/day medication was too expensive, so he suffered many painful episodes. One time four pints of blood poured out of his mouth and rectum he had to go and get 2 surgeries. He was in on a 111-day sentence for using a fake driver license.

No the 12 execution style murders were of Phoenix residents. None of which, by the way, have been solved to date. The premise of the show is to use big-breasted women and promises of a $300 prize to get people with nonviolent warrants to show up at a nightclub taken over by Joe for this purpose, and filled with paid actors and undercover cops (all at county expense). Then they have to participate- on national television- in either a fashion show or a dancing contest. Joe hides behind a curtain or under a covered table during all this; and after the fashion show or dancing contest is over, he jumps out and arrests them. Meanwhile over 40,000 felony warrants, many of them for rape or murder, go unserved and the homicide rate has jumped 167%. I'm not making this @!$%# up.

On March 26, 1996, Jose Rodriquez, 39, died in a pool of his own vomit on a jail floor. His cries for help went ignored by Arpaio's jail employees. Rodriquez's dehydration, fever and twitching ultimately led to his death, even while inmates shouted for help.

• On June 1, 1996, Scott Norberg, 35, suffocated in one of Arpaio's restraint chairs. Detention officers wrestled Norberg into the chair and bound his mouth with a towel. They continued to beat and Taser him after he was handcuffed, surveillance video and court documents show. His family later won an $8.25 million settlement against Arpaio.

• Mentally retarded Charles Agster III, 33, was arrested for trespassing on August 6, 2001. Detention officers pulled a hood over his head and slammed him into a restraint chair. Agster was asphyxiated to the point that he became brain dead. He was pronounced legally dead three days later. In 2006, a federal court awarded $9 million to his family.

• In 2003, Phillip Wilson was serving two months in Tent City for a nonviolent offense. Wilson was attacked by the Aryan Brotherhood prison gang and bludgeoned into a coma. He never recovered.

• Deborah Braillard, 46, was documented as a diabetic in the jail's health records. Her cellmates say a nurse did not give Braillard insulin, and then detention officers ignored her when she went into diabetic shock. Braillard died on January 23, 2005, ultimately from lack of insulin.

• Legally blind and serving a short sentence in Tent City for shoplifting, Brian Crenshaw, 40, was transferred to solitary confinement after a tussle with Arpaio's detention officers. Six days later, he was found comatose in his solitary cell with a broken neck, ruptured intestines, broken toes, and severe internal injuries. Arpaio maintains Crenshaw sustained the injuries when he fell off his four-foot bed. Crenshaw died on March 14, 2005.

• In December 2005, Clint Yarbrough suffocated in a jail restraint chair. On April 18, 2007, the Maricopa County Board of Supervisors approved an undisclosed settlement payout to Yarbrough's family in excess of $1 million.

• Months before Thomas Bruce Cooley, 44, was found hanging by the bed sheets in his jail cell, a federal inspector had warned Arpaio that the jail psych ward was a suicide waiting to happen. A 1996 Department of Justice report specifically cautioned that inmates could use "overhanging structures" to hang themselves.

A U.S. Department of Labor Investigation concluded that Sheriff Arpaio failed to pay $2 million of overtime pay to his employees. The Phoenix New Times reported, “Since August, 2009, the Department of Labor had been investigating whether Arpaio was illegally, and systematically, refusing to compensate detention officers for overtime. It appears that was, in fact, the case: Thanks to Labor's intervention, the county will be forced to make good with a total of 1,900 detention officers. They'll receive back pay for the work in their next paycheck, Smith said.”

Arpaio Suspected of Misspending $50M in Taxpayer Funds, Refuses to Turn Over Records[xv]

After Arpaio refused to turn over financial documents to Maricopa County supervisors or attend a county board meeting on concerns over his budget, the board voted to freeze some of his funds until it could investigate his misspending. According to the Arizona Republic, “The board wants the records to help set Arpaio's budget but also believes he may be misspending or misusing public funds, though to what extent is uncertain. Officials suggested there are ‘substantial problems’ with transactions from at least one fund that may need to be paid back.” Some feared Arpaio had overspent up to $50 million. The children were left in the parking lot with an adult passenger of the car while their mother was taken to jail for an unpaid parking ticket. Though the mother paid the fine, Arpaio was able to keep her in jail because of his 287(g) agreement with Immigration and Customs Enforcement (ICE) on the grounds that she was a “criminal alien.”

Arpaio Conducts “Crime Suppression” Sweeps in Latino Communities[xx]

Sheriff Arpaio has inspired terror in Latino communities by engaging in highly controversial “crime suppression sweeps” of Latino communities, allegedly hunting for undocumented immigrants. It is unknown how many U.S. citizens and legal immigrants have been interrogated by deputies and volunteer members of Arpaio’s “posse,” but it has been widely reported that the sweeps have been highly ineffective at actually suppressing crime.[xxi]

In a story reported by Telemundo in 2009, Sheriff Arpaio forced Alma Minerva Chacon to give birth while she was in shackles. Latina.com detailed at the time, “Once she reached the hospital, nurses repeatedly begged the Sheriff's staff to allow them to unchain the mother, but they refused and Chacon was forced to give birth while still shackled to the bed. At one point, the nurse asked for them to release her so that she could be escorted to the bathroom for a urinalysis, but even that request was denied. But the worst came once Chacon gave birth to her baby girl.” Following the birth, Chacon was told that unless someone came to pick up the newborn in 72 hours, her child would be turned over to state custody.

Arpaio’s Deputies Deploy Heavy Duty Machine Guns[xxiii]

Despite the fact that crime rates have been flat or have decreased in the Arizona border region, the Philadelphia Examiner reports that, “Arpaio ordered the deployment of a powerful belt-fed .50 caliber machine gun to be on site during the operation to ensure deputies' safety, as there have been recent reports of violence in the desolate desert areas. Thursday's crime sweep coincided with the very first federal hearing regarding Arizona's new immigration law, but Arpaio denied any connection between the two. The next planned sweep is set to take place July 29th, the same day Senate Bill 1070 is scheduled to take effect.”

When the actions of an elected official are more grievous than the crimes of the criminals the elected official needs to be in jail.

Illegal immigrants are not "given" much of anything by this country, be it a social security card, welfare, or anything else. Even if they somehow got their hands on a social security card, they could not use it for anything other than false "identification". They can not claim actual SS benefits, if that is what you were implying.

Welfare, social security, etc. requires government knowledge of where you live. It's fairly obvious that illegals do not want to risk exposing themselves, even for money or benefits. That's because the money and benefits won't last once they are discovered, but the job they hold WILL last if they are not. Most illegals aren't here for benefits or entitlements; all they want to do is work. Since they mostly perform work that Americans, by and large, do not want to do, I don't really see a problem with it. The cheap labor they provide actually help keep prices lower than they would otherwise be.

If we were suddenly successful in deporting all illegal immigrants, this country would come to a virtual standstill, with the exception of "upwardly mobile" prices. Some companies can only stay in business because of the cheap illegal labor, but those companies also employ legitimate workers who would ALSO lose their jobs if the company shuts down. We would have food shortages, higher prices, and possibly even higher overall unemployment if these illegals all went home. That's the unintended consequence of shutting down illegal immigration, and THAT'S why the feds only pay lip service to enforcement actions. THAT is why Obama feels Arizona and Sheriff Joe are missing the bigger immigration picture.

The AZ law is short-sighted, and so is Sheriff Joe Arapaio, and anyone who supports his actions.

You realize that the Mexican government (or local municipalities) would be providing most of that to you if they had as large of a labor shortage as we do.

Don't believe me? Go get an advanced degree in nuclear science or in cardiology. They have a comparable shortage in those fields and will give you most of what you wish to get you there.

The unemployment in this country is not found in the same sector that most illegals are coming over to do. And even if it were, our need for these unskilled employees has historically far outpaced our ability to produce them domestically because people do not wish to spend $ for a head of lettuce.

If you are going to defend the sheriff's actions against charges of racial profiling by stating that ALL illegal immigrants are Latinos from Mexico, and defend the sheriff's actions that would naturally result in a very large jail population of Spanish speaking inmates, it would be prudent to have some Spanish speaking guards so that the inmates understand the rules and the guards' orders, would it not? No one (well, I hope no one) is suggesting that every dialect in China is represented, but you can't have it both ways. If you approve of the sheriff's policies that will result in a very bloated Spanish population, and find NO problem with this, you have to make the accommodations. That's more than a little inaccurate, Brokinarrow. The DOJ has been asking for MONTHS for these documents, long before the "Papers, Please" law, which they are entitled to. The DOJ has MANY complaints about civil rights violations, which they are supposed to look into (that's sort of their JOB), and this sheriff is basically giving the feds the bird. NOT his right. He is supposed to comply with ALL federal rules and regulations, including giving up any and all documents when asked. He is not doing it, and the feds have the right to slap back at him. He took an oath to uphold the laws of the land, ALL of them, not just the ones he wants to. He's wrong on this one, and should go to jail if he won't comply. Too bad it won't be one of his own work gangs instead of a nice, cushy federal prison. My guess is the largest cause of the unemployment crisis in our country is not illegal immigrants stealing jobs within our borders, it is companies stealing jobs FROM within our borders and sending them overseas. But I take your point and agree that our citizens have lost some employment opportunities, primarily in the construction trades, to illegal immigrants.

Federal Government needs to get it's act together and pass a law that levies a LARGE fine for companies found hiring illegals. Perhaps make it a good chunk of the company's annual income...

Lisa Murkowski's uncertain future and John McCain's victory in Arizona's GOP primary this week are reminders that in the summer of 2006 -- four long years ago – there was a Republican immigration reform bloc which voted for allowing illegal immigrants to become legal residents.

Both Murkowski and McCain were members of that pro-reform bloc, as was Republican Senate Leader Mitch McConnell.
Twenty-three Republican senators voted for the 2006 McCain-Kennedy comprehensive immigration reform, which passed the Senate by a vote of 62 to 36.

At most, only seven of those 23 GOP senators will still be members when the Senate convenes next January.

They are: McCain, McConnell, Lindsey Graham, Maine's Susan Collins and Olympia Snowe, and Richard Lugar of Indiana. Add Murkowski, if she prevails once absentee ballots are tallied in Alaska.

But the other 16 Republican reform supporters from 2006 are gone from the Senate, or soon will be.

Defeated this year were Robert Bennett of Utah and former Republican Arlen Specter of Pennsylvania. Retiring at year's end are three more: Sam Brownback, Judd Gregg, and George Voinovich. Mel Martinez left the Senate last year.

Defeated in 2008 were Norm Coleman, Gordon Smith, and Ted Stevens. Another five GOP senators retired that year. Two more were defeated in 2006.
In a few cases, the pro-reform GOP senators were replaced by liberal Democrats who'd support an immigration measure along the lines of the McCain-Kennedy bill. For instance, liberal Republican Lincoln Chafee of Rhode Island, who voted for the McCain-Kennedy bill, was defeated in 2006 by liberal Democrat Sheldon Whitehouse, who voiced support for the legislation.

By the way, the then junior senator from Illinois, Barack Obama, voted for the 2006 McCain-Kennedy bill.

It included a provision that said state and local police and sheriffs "have the inherent authority of a sovereign entity to investigate, apprehend, arrest, detain, or transfer to Federal custody" non-citizens in order to help enforce "the criminal provisions of the immigration laws of the United States in the normal course of carrying out the law enforcement duties of such personnel."

It added, "This State authority has never been displaced or preempted by a Federal law."

The exact extent of that state authority is one issue in the Obama administration's legal battle to block enforcement of Arizona's much-debated SB 1070 which sets up an immigration status-verification system to be used by police.

Joe Arpaio is one man who stands against the crime that has flowed into Arizona as a result of the millions of illegal aliens here. He has gone after the gangs that have sprouted up as a result of the recruitment of American youth by those who are fueling the drug war. He has gone after the human smugglers who put lives at risk by transporting 50 or more humans in shipping containers in the hot Arizona sun. He is standing on the law, unwavering in his duty which is something that many no longer do as a Sheriff.

I live in Arizona and I see the result of Joe's dilligence. This man may be controversial, he may be hard-line against crime, but isn't that what we should expect out of a Sheriff? It is his apparent effectiveness that is painting a target on him by the Federal Government in doing what they have not done for 20 or more years.

Being the minority opinion in a roomful of people blinded by propaganda isn't such a bad thing. I don't judge morality or legality using majority opinion. I would also argue on which side of this argument is ignorant. Most (not all) of the people that have problems with sheriff Arpaio's tactics used reasoned arguments and seem to do a better job of citing statistics, referencing sources and so on. This is just patently false. It has never been a significant problem but the issue was extinguished in 1996 with the Personal Responsibility and Work Opportunity Reconciliation Act of 1996.

From that point on it is nearly impossible for an illegal to receive any needs based welfare or subsidy from the government. Not even student loans and grants.

So, what I want to know, is did you publish that lie out of ignorance and academic laziness? Or out of some toddler-esque inability to spend 7 seconds googleing? Or did you know that it was a lie and spread it willfully because it furthers your ideological message.

I kinda go with JD's list as being more correct than not. If you will check around your locality, you will find that most hospitals & even real estate rental companies have been intimidated via threat of expensive lawsuits from even asking about citizenship, much less requiring verifiable proof.

Threat of expensive & ongoing lawsuits via the DOJ or the ACLU, regardless of their merits, prevents almost any state or local govt agency from going against the current federal policy of blocking all attempts to ask or verify proof of citizenship. Check out Georgia's recent lawsuit defending their right to require proof of citizenship for voting if you want a bird's eye view of the heavy-handedness the federal govt via the DOJ & the ACLU can & will apply.
