Good, those 'employees' are trusted with sensitive material (SSNs, other personal data).
Two wrongs don't make a right. However since there appears to be some questions to those on the list legal status (by employees who work for the Department of Workforce Services) why not go ahead and double check.
It's amazing the disconnect between the citizens of this Country and the Federal, state, and local governments and those that work for these institutions. Should these individuals have done what they did? Probably not. However, if the government agencies have this information and used it to arrest and deport these illegals the individuals that released this information would have had no reason to do so. Another reason we need to take this Country back!

They are in this country illegal; They are using phony social security numbers, for profit. (a major felony) They are receiving benefits by falsifying applications. ( how else could they get rent subsidy, food stamps, aid to dependant children, school lunch vouchers) a felony to receive government benefits under false pretense. No one has accused them of using phony social security numbers. Their children are American citizens, according to the US Constitution. They are therefore eligible for food stamps and assistance, just like any other American kid. You can deport their parents, but foster care costs a lot more than food stamps. The fact of the matter is that probably very few of the people on that list are doing anything illegal in relation to the agency they're dealing with. Unlike those "heroic" criminals who took it upon themselves to "out" their private information.

ILLEGAL aliens are ILLEGAL. What rights are you having violated by asking the Fed to enforce the laws already on the books? It's not like Arizona and others are passing wiretap laws to listen to international calls here. They're checking identification just like they do all of the white people they pull over in routine stops.

Their children are anchor babies, just another way to skirt and abuse the system. There is a steady flow of Mexican women crossing the border to have their babies, its pretty well documented. Please tell me how that is right, and I need to turn the other cheek while I have to pay full cost for my children if the insurance doesn't cover maternity. I also find it strange that most people who hate "illegals" so much avail of them when it is convenient for them....(Cheap labor...Daycare, Gardening, Housekeeping, etc.) My ex-carpooler use to vent every day, as you see on here all the time, about how all the illegal’s need to get out, how the country is ruined, they are to blame for everything... yada.... yada.... yada! Then one day when I mentioned that I was looking for a new housekeeper, he recommends his...who was an "illegal" from El Salvador. WTF? And who do you think he recommended when I inquired about getting my yard re-done? You guessed it! His "illegal" gardener! I find it bizarre that they could face a felony because they provided the list of illegals from the database to the immigration department. That becomes some special kind of felony, besides just releasing it to the rest of the general public.

So far no one has proved any person on that list is anything but legal. The two(+) idiots made a data base list searching for Hispanic names and pronounced them illegals. As noted, two on the list come from Puerto Rico, a US territory for nearly 100+ years which makes them US citizens! I feel like a broken record repeating the same thing over and over the past couple days discussing this. All of you who hold these state employees up as heroes are assuming that the list is accurate. It has already been shown that a number of them are here legally. How many false positives does it take?
And the argument "If you are here legally you have nothing to worry about" has never been on the receiving end of the completely irrationally abuse called racism. We all know that government records can have bad or old information. Suppose someone like me, forth generation with a Spanish last name, answered the door to the house that was listed as the home of an illegal immigrant and there was an angry racist who took the law into his own hands like the "hero" state workers? Is that racist going to wait to see my id?
I was called a fear mongerer yesterday for suggesting that could happen. I live in a part of southern California that has a higher than average level of white supremacist activity. This might be far outside the realm of possibility in your neck of woods, but here in mine its not.
Also, I feel like I need to defend my use of the word "racist". Some jump on that word and dismiss any argument it is attached to as hyperbolic. In many instances that is the correct approach. It is often over used and tossed as a blanket over an entire group when it is only a vocal minority within the group. I am not saying that if you disagree me with on the issue of the "hero" state employee you are racist. I'm saying that within the group that supports the employees there are racists. And just as the people here have jumped to the conclusion that the list is accurate, those racists can jump to the same conclusion. And they are the ones I'm concerned about.

I don't condone the actions of the employees but I do have to say something about the concentrated effort to blur the line between illegal immigration and legal immigration and painting those who are anti illegal immigrant as anti immigrant. Those on the side of illegal immigration often drop the illegal part when talking about immigration and those who are against illegal immigration as to paint those who are anti-illegal immigrant as just anti-immigrant to make them out as racists or bigots. I have seen this tactic used in multiple new articles and it's flat out not right.
If the police get a list of people suspected of dealing drugs from an informant and a couple of of the people on the list were innocent do you honestly believe the police would throw away the entire list and not investigate the rest of the people on the list? I'd bet not.

And anybody that thinks that having to" show your papers" is some new concept think again. Your "showing your papers" every time you have to provide a drivers license or ID to a police officer. Your "papers"were condensed to a little plastic card long long ago.
I cannot think of any time that I wasn't reqired to provide ID to a police officer. Even when I caught a guy pissing outside my apartment door during a local festival and flagged down one of the scores of police on the street that are there for said festival. I had to provide my ID, had it run to see if I had any outstanding warrants, and they let the guy go with a warning. The police even had the balls to ask me if I had some paper towels for the guy to wipe up his own piss as if I was responsible for the puddle myself because I reported him..

And as far the ID issue, I don't believe that only us Tanner Americans are going to be forced to produce IDs. I am just concerned that we will have to do it more frequently than the rest. I know it says that the AZ law and any future law patterned after it specifically state that racial profiling it not allowed. I also know (and this Utah story seems to collaborate) that an over zealous cop who thinks he is doing the right thing can hide racial profiling behind any number of "his word against mine" stops. I wasn't stopped because I look Mexican, but because I didn't come to a complete stop. I was driving erratically. That light wasn't yellow, it was red.
If the people on that list were here illegally, why would anyone think they should be protected under privacy laws? Utah should and most likely (on a very low key basis of course) will check those names out anyway. If they are in fact illegal, deport them ASAP and save a drain on social services that should be reserved for citizens and legal residents! Those employees should be commended for their efforts!

I see nothing wrong with going after the illegals, especially if the state has the info on where they are at. If they are not going after the illegals even though they know where they are then we the people should DEMAND that they do or face immediate impeachment from their offices...

Regardless of how you personally feel toward illegal immigration (and I will admit I'm not especially fond of it, either), this sort of behavior belongs more to fascism than to Democracy. In this country, we are ruled by laws, not by impulse. If you want to work the system, do it legally - continue to pressure our elected officials, but lay off the "hit" lists. We're not the U.S.S.R.
We just had the 2010 national census -- should we use people's responses to deport aliens? Well, that's been made illegal itself, otherwise aliens or non-European descendants would abstain from or provide false data to the census. It's illegal b/c there is great value in having an accurate census, and privacy of responses strongly promotes accuracy. The privacy law that these 2+ Utahans illegally violated is also based on the notion that privacy strongly promotes the effectiveness of other programs. For example, school systems are in the business of education (we hope), with an educated population being the key to a strong economy & strong society; so school systems are prohibited from reporting alien children to U.S. Immigration offices. Let's see, doing the math: the Utah misdemeanor penalty of up to 6 months jail and $1,000, multiplied by 1300 names would give these state employees up to 650 years jail time and $1,300,000 fines. Our legal system often prohibits prosecuting someone based upon information that was illegally obtained [a protection that I have some disagreement with, but it's our law]. Since these names were illegally obtained (and it's not clear than any of them are in fact illegal aliens, let alone threats to our society), it might be impossible for the Utah governor or anyone to pursue this list.
What most of the bigots that are screaming in support of these two scumbags, so conveniently forget is that there were legal immigrants on the list. So when this list gets into the hands of some other rightwing nutbags that take it a step further what do we do.
These two broke the law and the American peoples trust. They are entrusted with delicate info and they made it public, a very dangerous precedent. They need to be fired.
Since it is a crime to aid and abet criminals, then it appears the Governor of Utah and Kristan Cox of Workforces Services, have been doing precisely that, and shouldn’t they be charged with a crime? After all, if there are nearly 1,300 Illegal Aliens on The List, it appears to have been the revelation of giving these illegals public benefits that upsets her and the Governor the most... not the fact they should have been processing the illegals as illegal aliens in the first place. If I didn't have to read so many vitrolic posts from so many Archie Bunkers, I'd count how many unique posters there are on each side of this argument and I would probably get a pretty good indication of the average education and intelectual level of the people in this country. On one hand, we have developed such a liberal agenda and yet on the other hand, the voice of conservative america has become xenophobic, rasict and mean spirited. I have read most of the comments everyday people wrote and it embarrasses me how uneducated and unintelligent some people are. YET we still defend their right to dissent. Firstly, let me say, that i am NOT trying to change anyones opinions. Some WILL NEVER reason. But i would like to humbly offer my opinions on the said matter:
1. "illegal immigrants" is a political term because there is NO LAW that is broken. In fact what we have is a civil code within the immigration system. its not an actual LAW in its most accurate and narrow definition.
2. it is ILLEGAL UNDER LAW to have published this information to organizations that had no business with this information.
3. Immigration MUST be reformed IMMEDIATELY because the more the federal government waits the more the local governments will try to exercise their own version of "justice."
Politically, i have leaned more to the right than to the left, however, the right has morphed more and more into an all white, southern party and it DOES NOT accurately represent America. That leaves people like me without a voice in government.
Xenophobia is NOTHING NEW in America. IN the 1800's and early 1900's we, as a nation, harshley treated the Irish, the Italians, the Germans, the blacks and the japanese. Now its the Latin Americans. What is startling is that SO MANY think illegal immigrants and immediately assume someone from Latin America. This is also inaccurate.
Our nation is in the middle of a cultural crisis as EVERYONE is trying define America's TRUE identity. Well allow me to summarize my humble opinion:

Sure, what these guys did was illegal. And they will be punished. But what the illegal immigrants are doing is also illegal and the government continues to refuse to uphold immigration laws of this country. The government should not be able to pick an choose which laws they uphold. They should uphold all laws of this country.
Our country is being overrun by illegals. Primarily from south of the boarder. Any country cannot assimulate such a large number of people that speak a different language and have a different culture. I do not care what the origin of the people is. If this was tens of millions of illegal immigrants from Cambodia it would still be wrong. If they created their own countries within the US, where you had to speak Cambodian to get a job, that would be wrong. If they brought all the lawlessness and corruption of Cambodia, that would be wrong.
No other country would allow this assault on their country. Could you imagine France letting americans come into their country illegally, and demanding rights as illegal immigrants? Could you imagine them allowing so many illegals into their country so that they made up 10% of the population?
This has to stop now, or it never will. All illegals need to be prevented from working, and deported if found. It took decades for them all to get here, so if it takes decades to get rid of them all, that is fine. Then we could have a guest worker visa where they could come for a short period of time to work, then return home and come again later. But if they can just stay illegally without fear and get a job somewhere else, then they would just use it as a safe and easy way to get into the country.

Also, maybe those millions of unemployed folks should go rob them so they can feed their families? Wouldn't that be a fair exchange? The banks are robbing us, so why can't we rob them back in return?

Amazing Voiceofreason! Since coming to the newsvine stories I have discovered a new respect for some (like miniscule amount) republicans' points of view of subjects. This must be where all the intellectual conservatives are hiding on the internet, because when I go to read posts on the yahoo news boards or cnn boards it's mostly a TON of rhetoric driven gibberish. I have read some honest, very well written and thought out posts in the 2 days I've been on newsvine. I'm not a republican, but it does give me hope to know there are those of you out there.
Immigration reform is important, but what those workers did is repugnant and reprehensible. If they were in the military and they released information like that 1.) IT'S NOT ADMISSABLE IN COURT BECAUSE A LAW WAS BROKEN TO PROVIDE THAT INFORMATION (Fruit of the Poisoned Branch) and 2.) they would lose their clearance to handle such information and would be face Uniformed Code of Military Justice action (the least of which would be a Field Grade Article 15 which would result in 45 days extra duty, 45 days restriction, forfeiture one half base pay per month for two months, and a reduction to E-1 (for E-4 and below) or one pay grade for Non-Commisioned Officers (E-5 and above).
Their children are anchor babies, just another way to skirt and abuse the system. There is a steady flow of Mexican women crossing the border to have their babies, it’s pretty well documented. I recently was doing research at the SMU Library, and came across an article in the "Dallas Star" from the mid-70s, and the headlines read "WET BACKS CONTINUE TO PLAUGE TEXAS". When the hell did we upgrade them to "Illegal Alien" status? I'm not too concerned about being politically correct or "hurting the feelings" of unwanted, undesired, illegal, law breaking parasites who suck up government benefits paid for, and meant for, US citizens. And this "anchor baby" phenomenon? Really, what's the difference between some pregnant woman squatting on my front yard, giving birth, and then expecting me to pay for that kid's nutritional, medical and educational needs till it’s at least 18, maybe 21, and perhaps indefinitely. If these opinions and beliefs make others screech that I'm a racist or a bigot, well, I guess I'll wear those labels Proudly.
And how would you feel if your name appeared on the list? Do you welcome being investigated because someone "suspected" that you were here illegally because you had an accent or "looked" illegal? I don't want a bunch of amateurs trying to do the job of law enforcement.
Average - do you have any evidence whatsoever that any of the people on the list did that? If not, have you heard of a little provision of the Constitution that says "innocent until proven guilty"? You can't impose penalties like publishing people's SS numbers and their due dates even if they were CONVICTED criminals. The fact that you're willing to do it to innocent people says a lot about your commitment to real American values.

I'd feel the same as if I were pulled over in another country and they asked for my ID and passport. I'm sure they don't ask the ones who look local and speak with local dialect for passports, but I don't get all emotional and scream racism.
As for a bunch of amateurs doing the work of law enforcement, I'd settle for law enforcement doing the job period. Then you wouldn't have "amateurs" being that fed up. Would you like to be required to walk around with your birth certificate and naturalization papers on a daily basis in your own country to produce whenever asked because you look suspicious (dark skin and hair etc.)? I can understand having to carry a passport in a foreign country for a short trip, but even there you are not generally being looked upon as a possible criminal and you aren't usually asked to show a passport to an official unless you are entering or exiting a country. They don't otherwise bother you. The reason you don't scream racism is because those countries don't have a red hot immigration issue going on and they aren't putting you in the hot seat.
We are just lucky so far that violence wasn't involved, but that does not mean that it couldn't happen like that even now. Take that list with all the personal data on it, even their home addresses--if your name were on the list, would you feel safe knowing there are probably people out there who have that list who are angry and might try to take the law into their own hands if the government doesn't take action? What would stop a "concerned citizen" from gunning down some of those alleged illegals? There is great potential here for an escalation to violence. Many of these posting for this and other articles are full of expressions of hate and threats of violence. If it were my name on the list I would consider my life to be in danger. I would not sleep at night.
Two wrongs don't make a right. Who do you think the local gendarmerie will scrutinize closely when they stop them for traffic violations: people that look like you if in fact you are Swedish, or someone who has what i would call a Mediterranean complexion? And to post personal information including date of birth and SS numbers is a violation of the law! I guess it is OK to assume those people are guilty until and unless they are definitely proven innocent. Jerk!

Ever hear of "fruit from the poison tree"? Since this list of names was compiled by state employees illegally, even if the state investigated the people on the list and found every one of them were actually illegal immigrants, the state could do nothing about it because the evidence was obtained illegally. These employees tied the state's hands with this, and effectively gave these people what amounts to amnesty. This is why amateurs shouldn't be doing the job of professional law enforcement. Pros know when a warrant is needed to obtain information so it can be used in legal proceedings such as deportation hearings.
The point of freedom is NOT that if you don't give it up you must have something to hide. Not many of us would be pleased to let these vigilantes give our personal information to anyone else.

The data base used to assemble The List is admitted by the Utah officials that it's a list of illegal aliens only part of which had "Hispanic" names. And then they put two of their own employees on "administrative leave" (for snitching) who had access to their data base. So, this certainly isn’t casual bunkum.
Tell me this. One thousand three hundred names, carefully enumerated, are not exactly an impulsive task. What on earth would be the motivation of (two employees and possibly more) risking their jobs without substantial evidence for their subject matter.

Then those people cans sue the people that released the list as well as the state for not adequately protecting their privacy. However, the state and the feds should be investigating all the names on the list to see if any are illegal immigrants. But they are not. They are only deciding whether to charge the state employees with a crime. Those that released the list should be prosecuted only for each record that was released where the person was here legally. The list of "illegals" is a list that the public assistance group gets where the Social Security number is rejected for various reason. These reasons can be the number / name do not match up. The number has been used by multiple individuals or the number is invalid. None of these reasons can definitively say the person is in the Country illegally. Therefore some of the people on the list could be her legallly but had reasons for the SS# being rejected like getting married and their name changed. They put down the wrong SS#. This is why some of the people are here legally eventhough they are on the list. If you read the article you would see -

This means that this people may or may not be here illegally. It does not state that the government group has a list that specifically says which are in fact here illegally. These employees violated the trust of the American people and should be punished accordingly. People who were on the list may not want others to know they are having finacial hardships and now their rights have been violated. This government agency does not investigate these issues because they are not a policing agency. They are set up to help with assistance for the poor. The information is turned over to other agencies which then choose to investigate based on the information provided. Agencies like the INS and IRS are better suited to deal with these types of issues.
These employees should be fired and punished by the governing agencies.

Everybody is missing something. They say some of the people on this list are here legally, if so, that means they have checked the list and know who is illegal! So, if some are legal than most are illegal. Furthermore if they could make that determination this fast, than not deporting all the illegals is a choice not a matter of difficulty.

While I don't know this for sure, it appears from the people who are checking the list are the media who were also sent copies. The stories on msnbc and the SLC newpaper website I checked weren't very clear on who was doing the checking.
I do not see how anyone can call them vigilantes. They did not string up or assault anyone. Do you call someone who has information about a crime and reports it to police a vigilante?
Did the people produce and distribute the list commit a crime? Probably, but one would wonder if whistle blower statutes can come into play. If an (Government or private) organization that you work for knowingly abets/supports a crime, isn’t it the responsibility of members of that organization to report it. Isn’t that often done by a whistle blower via the press to bring public condemnation of the act and right a wrong? Are we to condemn these “whistle blowers” because we do not agree on them publicizing information about the support the state and/or federal government gives to illegal immigrates?
It has been stated that there are legal immigrates on the list and therefore they could sue the releasers of the list? I am curious as to the grounds. Slander? Are individuals libel when the statements they make are based on what they are believed as fact? (I do not know the criteria they used to select the information from the Utah database.) If the information was stored incorrectly (that somehow that individuals who were in the country legally but were flagged as an illegal) isn’t the issue more about why does the state government classify incorrectly those individuals who are in the country legally? Are all individuals who report a crime or provide witness testimony and believing they are correct, but as a result of further investigation by the appropriate authorities found to be incorrect because of misunderstanding or mistaken identity sued? Now if the people who produced the list added names of individuals knowing they were in the country legally to cause them harm, then I think one would have a legal basis to sue.

How do you know that these people aren't legal citizens? Sure, some of them are probably not, but I'll bet you that a lot of them are. When the Constitution was written the founding fathers envisioned the rights granted therein as inherent to all human beings, and believed that they applied to all people, not just the ones lucky enough to be born here. All of the people on that list are entitled to due process, which this was not. It is intimidation and harassment and I would not be shocked to find out that it was racially motivated, making it a hate crime as well.
We sell our country as a land of freedom and opportunity, then make it nearly impossible for anyone to get in. Maybe if we want to keep illegals out we should just start an "America Sucks" campaign. We can focus on how political polarization and intolerance has made it nearly impossible for any decent legislation to be passed, how awful our economy is, and then we can follow it up with the, "Even I Go to Mexico When I Am Trying to Escape the American Grind" campaign. We can put GW on the poster with a big thumbs up on the beaches of Puerto Vallarta.

There was a story a few months ago on MSN about a lady who had her identity stolen and was being used by an illegal immigrant. He was putting money away in a 401K that she also had and turned out also had bought a house, cars, and credit cards with her number. What happened, no body wanted to help her.

People like me don't understand. HA! My husband served 3 years in Afghanistan, and has been military for more than 16 years. My brother has done 2 tours to Iraq and was awarded the Bronze Star for Valor in Combat. Not only that, I have a sister-in law AND a brother-in-law who are naturalized citizens. So when you are talking about "people like me" perhaps you should look a little deeper into what you are accusing me of. I love America. I think America is a great place. I think it is a great place because of the Constitution. It really bothers me how much political polarization has driven our country to a standstill. It bothers me that my father-in-law uses the word "Republican" the way racists toss around the N-word. It is literally the worst insult in his mind that he can throw at a person. My point was that there really wasn't any way to know how many of those people on the lists are in fact illegal. I don't think that they should be harassed because people with no moral fortitude don't like illegal immigrants. I don't like that they are here illegally any more than anyone else, and if discovered then yes, they should be deported. BUT the motives of the people who put the list together are so incredibly questionable (not to mention that their actions were illegal), that I don't think that the list should be given any weight or be used to further terrorize the people who are on it.
Utah is in the works to pass their own immigration law, and at that time THEN the state can use the resources at their disposal to uncover illegal immigrants. But as it stands right now, what happened was wrong.

Since we don't know the real state of legal or illegal or what if anything those people on the list might have done, it would be better if everyone tampered down. Making the list and publishing it was illegal. That for sure needs investigation and prosecution. Too many posters are accusing the people on the list of things that are simply not known to be true. Imagination and truth are not the same. All of these negative comments and threats of violence are a sad commentary on our current culture. I think the whole direction we've taken about immigration is deeply regrettable and seems to be getting worse. It wouldn't suprise me if we ended up in another civil war with every street in America awash with blood.
Perhaps the folks in this discussion should be able to read the earlier article that gave information they don't have.
First, The List was assembled by a data base that hundreds of people had access to. It apparently did not have a Security block.
Second, it was my understanding the data base already identified which persons were illegal aliens.
Third, the persons, employees of the Workforce Services, who were identified as two of those who had compiled The List, had legitimate access to the data base.
(I am irked that the “work force” data base included names of verified illegals, certainly showing the Utah officials knew who were, and who were not illegals.) “Workforce Services” provided food stamps “and other public benefits” to its data base clientele. Work and Welfare, Incorporated?
Now, I should like to share what a friend of mine, a Constitutional Lawyer, suggested to me. It is legally challengeable that babies born to illegal aliens here in the United States are "citizens." He quoted our 14th Amendment (ratified in 1868):
"Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside." If the baby is not subject to "thereof" (the United States :) ), then they are not "born" as American citizens.
He pointed out that the parent(s) are "illegal" because they are citizens of another country. Therefore, the illegal parentage is subject to the jurisdiction of the country in which the parents actually are citizens.
Thus, their babies are subject to their jurisdiction, not America's. Their country's laws, like ours for us, come first for the illegals giving those country's their allegiance, not the United States. Our own citizenship laws provide the same for us citizens if we have a baby abroad. Our baby is under the same jurisdiction as we are, and therefore become American also.
The countries we are dealing with, especially Mexico, have the jurisdiction and our laws do not let us override another country's jurisdiction.
So, the "anchor babies" do not anchor any entitlements to their parents at all, according to this legal interpretation. It would be an act of compassion to transport parent and child back to Mexico. A newborn nurses so the baby will be OK. The parent(s) have been documented as sending $$ back to "family" in Mexico; they, their family, or their country should cover the expense of transport and reimburse us.

Careful now. You're revealing that you don't read newspapers or research what you believe. Ever hear the list of people who were arrested on the radio or read it in the paper? That's the following day and weeks or even months before the trial. Even if you don't read the paper or listen to local news, how do you explain all of us hearing about what Michael Jackson, Mel Gibson, Tiger Woods, etc were charged with before being convicted?
I learned early on that vigilante "justice" isn't justice at all. It is not right for people to exact their own brand of justice outside of the law. If there was a concern about people who were likely illegals, they should have called INS. INS would have investigated and their investigation would at least have been legal. This was more about sensationalism and terrorism than anything else. We don't need vigilantes. Vigilantes belong in jail. We need law abiding citizens who treat others with respect and compassion. That is why we have the power of citizen's arrest. Make sure a cop is handy to take care of reading rights and taking them into custody. Make sure you know EXACTLY what crime/offense you are going to charge them with. If the cop refuses to arrest your governor then get his badge number and sue him and his police force, and make a big deal about dereliction of duty (of the cop AND the governor) in the newspapers and other media. When police won't perform their duties I think you are also supposed to report them to the FBI and/or the US Marshall's office. It just takes a pair of balls.

I agree, Illegal is illegal. So, the 2 people who broke the law and stole the list and did so knowingly should also be pursued to the fullest extent of the law. If they broke federal law, then they should face that as well. This doesn’t excuse the illegal immigrants in the country illegally and every LEGAL measure should be taken to track them down and take what steps are allowed by law. If its illegal, then its illegal and anyone standing up for the the people who broke the law to get the list are just as bad as those who stand up for the illegal immigrants.

The story of today's deficits starts in January 2001, as President Bill Clinton was leaving office. The Congressional Budget Office estimated then that the government would run an average annual surplus of more than $800 billion a year from 2009 to 2012. Today, the government is expected to run a $1.2 trillion annual deficit in those years.

It wasn't stolen, there was no security block on it, hundreds of people had access to the data base, it was staff who did the humongous job of finding those listed who are illegals, and they sent it to LAW ENFORCEMENT AND THEIR OWN BOSSES.

Babies born to illegal alien mothers within U.S. borders are called anchor babies because under the 1965 immigration Act, they act as an anchor that pulls the illegal alien mother and eventually a host of other relatives into permanent U.S. residency. (Jackpot babies is another term).

The original intent of the 14th Amendment was clearly not to facilitate illegal aliens defying U.S. law at taxpayer expense. Current estimates indicate there may be over 300,000 anchor babies born each year in the U.S., thus causing illegal alien mothers to add more to the U.S. population each year than immigration from all sources in an average year before 1965.
The correct interpretation of the 14th Amendment is that an illegal alien mother is subject to the jurisdiction of her native country, as is her baby.

If so, then if you are so sure of yourselves, then let those who have determined that no investigations will be done, list their respective names and proudly stand with their proclaimations. I would bet that not all the names were illegal aliens - some were probably children born in the U.S. - those kids, like it or not, are United States citizens. A huge problem for some, indeed. Read the US Supreme Court decisions in US v. Wong Kim Ark and Plyler v. Doe. They ARE citizens under the 14th Amendment. Unless you consider yourself a Supreme Court of your own authority.

Hank, in this case I would disagree with you that the evidence was obtained illegally. That is because the state already had access to this information before it was stolen and disseminated to the public. You cannot make the argument that the evidence is illegal because it was stolen from the state and then given back to the state with the request to prosecute these people. The state already had access to this information and chose not to pursue investigating if any of these people were illegal.

No one has accused them of using phony social security numbers. Their children are American citizens, according to the US Constitution. I was called a fear mongerer yesterday for suggesting that could happen. I live in a part of southern California that has a higher than average level of white supremacist activity. This might be far outside the realm of possibility in your neck of woods, but here in mine its not.
Also, I feel like I need to defend my use of the word "racist". Some jump on that word and dismiss any argument it is attached to as hyperbolic. In many instances that is the correct approach. It is often over used and tossed as a blanket over an entire group when it is only a vocal minority within the group. I cannot think of any time that I wasn't reqired to provide ID to a police officer. Even when I caught a guy pissing outside my apartment door during a local festival and flagged down one of the scores of police on the street that are there for said festival. I had to provide my ID, had it run to see if I had any outstanding warrants, and they let the guy go with a warning. The police even had the balls to ask me if I had some paper towels for the guy to wipe up his own piss as if I was responsible for the puddle myself because I reported him..

And as far the ID issue, I don't believe that only us Tanner Americans are going to be forced to produce IDs. I am just concerned that we will have to do it more frequently than the rest. I know it says that the AZ law and any future law patterned after it specifically state that racial profiling it not allowed. I also know (and this Utah story seems to collaborate) that an over zealous cop who thinks he is doing the right thing can hide racial profiling behind any number of "his word against mine" stops. I wasn't stopped because I look Mexican, but because I didn't come to a complete stop. I was driving erratically. That light wasn't yellow, it was red.
If the people on that list were here illegally, why would anyone think they should be protected under privacy laws? Utah should and most likely (on a very low key basis of course) will check those names out anyway. If they are in fact illegal, deport them ASAP and save a drain on social services that should be reserved for citizens and legal residents! Those employees should be commended for their efforts!

Well, that's been made illegal itself, otherwise aliens or non-European descendants would abstain from or provide false data to the census. It's illegal b/c there is great value in having an accurate census, and privacy of responses strongly promotes accuracy. The privacy law that these 2+ Utahans illegally violated is also based on the notion that privacy strongly promotes the effectiveness of other programs. For example, school systems are in the business of education (we hope), with an educated population being the key to a strong economy & strong society; so school systems are prohibited from reporting alien children to U.S. Immigration offices. Let's see, doing the math: the Utah misdemeanor penalty of up to 6 months jail and $1,000, multiplied by 1300 names would give these state employees up to 650 years jail time and $1,300,000 fines. Our legal system often prohibits prosecuting someone based upon information that was illegally obtained [a protection that I have some disagreement with, but it's our law]. Since these names were illegally obtained (and it's not clear than any of them are in fact illegal aliens, let alone threats to our society), it might be impossible for the Utah governor or anyone to pursue this list.
What most of the bigots that are screaming in support of these two scumbags, so conveniently forget is that there were legal immigrants on the list. So when this list gets into the hands of some other rightwing nutbags that take it a step further what do we do.
These two broke the law and the American peoples trust. They are entrusted with delicate info and they made it public, a very dangerous precedent. They need to be fired.

Surely it is as logical as pursuing the whistleblowers instead of the illegals. There are laws to protect whistleblowers and I hope it helps these folks.
After all, if there are nearly 1,300 Illegal Aliens on The List, it appears to have been the revelation of giving these illegals public benefits that upsets her and the Governor the most... not the fact they should have been processing the illegals as illegal aliens in the first place. They are prime enablers of as many crimes as are illegals on the list at the least, and of all the illegals in the State of Utah, for that matter.

Sure, what these guys did was illegal. And they will be punished. But what the illegal immigrants are doing is also illegal and the government continues to refuse to uphold immigration laws of this country. The government should not be able to pick an choose which laws they uphold. They should uphold all laws of this country.
Our country is being overrun by illegals. Primarily from south of the boarder. Any country cannot assimulate such a large number of people that speak a different language and have a different culture. I do not care what the origin of the people is. If this was tens of millions of illegal immigrants from Cambodia it would still be wrong. If they created their own countries within the US, where you had to speak Cambodian to get a job, that would be wrong. If they brought all the lawlessness and corruption of Cambodia, that would be wrong.
No other country would allow this assault on their country. Could you imagine France letting americans come into their country illegally, and demanding rights as illegal immigrants? Could you imagine them allowing so many illegals into their country so that they made up 10% of the population?
This has to stop now, or it never will. All illegals need to be prevented from working, and deported if found. It took decades for them all to get here, so if it takes decades to get rid of them all, that is fine. Then we could have a guest worker visa where they could come for a short period of time to work, then return home and come again later. But if they can just stay illegally without fear and get a job somewhere else, then they would just use it as a safe and easy way to get into the country.

Amazing Voiceofreason! Since coming to the newsvine stories I have discovered a new respect for some (like miniscule amount) republicans' points of view of subjects. This must be where all the intellectual conservatives are hiding on the internet, because when I go to read posts on the yahoo news boards or cnn boards it's mostly a TON of rhetoric driven gibberish. I have read some honest, very well written and thought out posts in the 2 days I've been on newsvine. I'm not a republican, but it does give me hope to know there are those of you out there.
Immigration reform is important, but what those workers did is repugnant and reprehensible. If they were in the military and they released information like that 1.) IT'S NOT ADMISSABLE IN COURT BECAUSE A LAW WAS BROKEN TO PROVIDE THAT INFORMATION (Fruit of the Poisoned Branch) and 2.) they would lose their clearance to handle such information and would be face Uniformed Code of Military Justice action (the least of which would be a Field Grade Article 15 which would result in 45 days extra duty, 45 days restriction, forfeiture one half base pay per month for two months, and a reduction to E-1 (for E-4 and below) or one pay grade for Non-Commisioned Officers (E-5 and above).

I recently was doing research at the SMU Library, and came across an article in the "Dallas Star" from the mid-70s, and the headlines read "WET BACKS CONTINUE TO PLAUGE TEXAS". When the hell did we upgrade them to "Illegal Alien" status? I'm not too concerned about being politically correct or "hurting the feelings" of unwanted, undesired, illegal, law breaking parasites who suck up government benefits paid for, and meant for, US citizens. And this "anchor baby" phenomenon? Really, what's the difference between some pregnant woman squatting on my front yard, giving birth, and then expecting me to pay for that kid's nutritional, medical and educational needs till it’s at least 18, maybe 21, and perhaps indefinitely. If these opinions and beliefs make others screech that I'm a racist or a bigot, well, I guess I'll wear those labels Proudly.

Average - do you have any evidence whatsoever that any of the people on the list did that? If not, have you heard of a little provision of the Constitution that says "innocent until proven guilty"? You can't impose penalties like publishing people's SS numbers and their due dates even if they were CONVICTED criminals. The fact that you're willing to do it to innocent people says a lot about your commitment to real American values.
I'd feel the same as if I were pulled over in another country and they asked for my ID and passport. I'm sure they don't ask the ones who look local and speak with local dialect for passports, but I don't get all emotional and scream racism.
As for a bunch of amateurs doing the work of law enforcement, I'd settle for law enforcement doing the job period. Then you wouldn't have "amateurs" being that fed up. Would you like to be required to walk around with your birth certificate and naturalization papers on a daily basis in your own country to produce whenever asked because you look suspicious (dark skin and hair etc.)? I can understand having to carry a passport in a foreign country for a short trip, but even there you are not generally being looked upon as a possible criminal and you aren't usually asked to show a passport to an official unless you are entering or exiting a country. They don't otherwise bother you. The reason you don't scream racism is because those countries don't have a red hot immigration issue going on and they aren't putting you in the hot seat.
We are just lucky so far that violence wasn't involved, but that does not mean that it couldn't happen like that even now. Take that list with all the personal data on it, even their home addresses--if your name were on the list, would you feel safe knowing there are probably people out there who have that list who are angry and might try to take the law into their own hands if the government doesn't take action? What would stop a "concerned citizen" from gunning down some of those alleged illegals? There is great potential here for an escalation to violence. Many of these posting for this and other articles are full of expressions of hate and threats of violence. If it were my name on the list I would consider my life to be in danger. I would not sleep at night.

Who do you think the local gendarmerie will scrutinize closely when they stop them for traffic violations: people that look like you if in fact you are Swedish, or someone who has what i would call a Mediterranean complexion? And to post personal information including date of birth and SS numbers is a violation of the law! Ever hear of "fruit from the poison tree"? Since this list of names was compiled by state employees illegally, even if the state investigated the people on the list and found every one of them were actually illegal immigrants, the state could do nothing about it because the evidence was obtained illegally. These employees tied the state's hands with this, and effectively gave these people what amounts to amnesty. This is why amateurs shouldn't be doing the job of professional law enforcement. Pros know when a warrant is needed to obtain information so it can be used in legal proceedings such as deportation hearings.

Ninety-nine and 44/100% of you reading this DO THAT ALREADY! Can you cash a check without your Driver's License? Can you drive your vehicle without that handy dandy IDENTIFICATION? It has your photo and fingerprints on it. Have you ever been stopped by a law officer for a broken tail light? Or not having your seat belt fastened? And did he just glance at it and wave you on your way? Or did he go back to his vehicle and run the data on it?
The interminable question on this issue is... What part of "illegal" can you not define? So, again: it means criminal. Breaking the law. The data base used to assemble The List is admitted by the Utah officials that it's a list of illegal aliens only part of which had "Hispanic" names. And then they put two of their own employees on "administrative leave" (for snitching) who had access to their data base. So, this certainly isn’t casual bunkum.
Tell me this. One thousand three hundred names, carefully enumerated, are not exactly an impulsive task. What on earth would be the motivation of (two employees and possibly more) risking their jobs without substantial evidence for their subject matter.
Rather a large risk for something trivial and not exactly a cui bono for them, would you say?
Perhaps the trouble makers should be deported. We cannot become vigilantes and take the law into our own hands - regardless of how emotional we may be about it. Then those people cans sue the people that released the list as well as the state for not adequately protecting their privacy. However, the state and the feds should be investigating all the names on the list to see if any are illegal immigrants. But they are not. They are only deciding whether to charge the state employees with a crime. Those that released the list should be prosecuted only for each record that was released where the person was here legally. As for the remainder on the list, that are here illegally, why are they recieving foods stamps and not being deported?
I live in Utah and some of those people were proven to be here legally. These state employees make me sick. Without immigration none of you would be here.
The list of "illegals" is a list that the public assistance group gets where the Social Security number is rejected for various reason. These reasons can be the number / name do not match up. The number has been used by multiple individuals or the number is invalid. None of these reasons can definitively say the person is in the Country illegally. Therefore some of the people on the list could be her legallly but had reasons for the SS# being rejected like getting married and their name changed. They put down the wrong SS#. This is why some of the people are here legally eventhough they are on the list. If you read the article you would see -
This means that this people may or may not be here illegally. It does not state that the government group has a list that specifically says which are in fact here illegally. These employees violated the trust of the American people and should be punished accordingly. People who were on the list may not want others to know they are having finacial hardships and now their rights have been violated. This government agency does not investigate these issues because they are not a policing agency. They are set up to help with assistance for the poor. The information is turned over to other agencies which then choose to investigate based on the information provided. Agencies like the INS and IRS are better suited to deal with these types of issues.
These employees should be fired and punished by the governing agencies.
I do believe anyone illegal should be deported however this method is not the manner in which to do it. How would you guys like common citizens pulling over drivers that were speeding or that had a tail light out. Chaos would rein.

I do not see how anyone can call them vigilantes. They did not string up or assault anyone. Do you call someone who has information about a crime and reports it to police a vigilante?
Did the people produce and distribute the list commit a crime? Probably, but one would wonder if whistle blower statutes can come into play. If an (Government or private) organization that you work for knowingly abets/supports a crime, isn’t it the responsibility of members of that organization to report it. Isn’t that often done by a whistle blower via the press to bring public condemnation of the act and right a wrong? Are we to condemn these “whistle blowers” because we do not agree on them publicizing information about the support the state and/or federal government gives to illegal immigrates?
It has been stated that there are legal immigrates on the list and therefore they could sue the releasers of the list? I am curious as to the grounds. Slander? Are individuals libel when the statements they make are based on what they are believed as fact? (I do not know the criteria they used to select the information from the Utah database.) If the information was stored incorrectly (that somehow that individuals who were in the country legally but were flagged as an illegal) isn’t the issue more about why does the state government classify incorrectly those individuals who are in the country legally? Are all individuals who report a crime or provide witness testimony and believing they are correct, but as a result of further investigation by the appropriate authorities found to be incorrect because of misunderstanding or mistaken identity sued? Now if the people who produced the list added names of individuals knowing they were in the country legally to cause them harm, then I think one would have a legal basis to sue.

When the Constitution was written the founding fathers envisioned the rights granted therein as inherent to all human beings, and believed that they applied to all people, not just the ones lucky enough to be born here. All of the people on that list are entitled to due process, which this was not. It is intimidation and harassment and I would not be shocked to find out that it was racially motivated, making it a hate crime as well.
We sell our country as a land of freedom and opportunity, then make it nearly impossible for anyone to get in. Maybe if we want to keep illegals out we should just start an "America Sucks" campaign. We can focus on how political polarization and intolerance has made it nearly impossible for any decent legislation to be passed, how awful our economy is, and then we can follow it up with the, "Even I Go to Mexico When I Am Trying to Escape the American Grind" campaign. People like me don't understand. HA! My husband served 3 years in Afghanistan, and has been military for more than 16 years. My brother has done 2 tours to Iraq and was awarded the Bronze Star for Valor in Combat. Not only that, I have a sister-in law AND a brother-in-law who are naturalized citizens. So when you are talking about "people like me" perhaps you should look a little deeper into what you are accusing me of. I love America. I think America is a great place. I think it is a great place because of the Constitution. It really bothers me how much political polarization has driven our country to a standstill. My point was that there really wasn't any way to know how many of those people on the lists are in fact illegal. I don't think that they should be harassed because people with no moral fortitude don't like illegal immigrants. I don't like that they are here illegally any more than anyone else, and if discovered then yes, they should be deported. BUT the motives of the people who put the list together are so incredibly questionable (not to mention that their actions were illegal), that I don't think that the list should be given any weight or be used to further terrorize the people who are on it.
Utah is in the works to pass their own immigration law, and at that time THEN the state can use the resources at their disposal to uncover illegal immigrants. But as it stands right now, what happened was wrong.

Since we don't know the real state of legal or illegal or what if anything those people on the list might have done, it would be better if everyone tampered down. Making the list and publishing it was illegal. That for sure needs investigation and prosecution. Too many posters are accusing the people on the list of things that are simply not known to be true. Imagination and truth are not the same. All of these negative comments and threats of violence are a sad commentary on our current culture. I think the whole direction we've taken about immigration is deeply regrettable and seems to be getting worse. Perhaps the folks in this discussion should be able to read the earlier article that gave information they don't have.
First, The List was assembled by a data base that hundreds of people had access to. It apparently did not have a Security block.
Second, it was my understanding the data base already identified which persons were illegal aliens.
Third, the persons, employees of the Workforce Services, who were identified as two of those who had compiled The List, had legitimate access to the data base.
(I am irked that the “work force” data base included names of verified illegals, certainly showing the Utah officials knew who were, and who were not illegals.) “Workforce Services” provided food stamps “and other public benefits” to its data base clientele. Work and Welfare, Incorporated?
Now, I should like to share what a friend of mine, a Constitutional Lawyer, suggested to me. It is legally challengeable that babies born to illegal aliens here in the United States are "citizens." He quoted our 14th Amendment (ratified in 1868):
"Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside." If the baby is not subject to "thereof" (the United States :) ), then they are not "born" as American citizens.
He pointed out that the parent(s) are "illegal" because they are citizens of another country. Therefore, the illegal parentage is subject to the jurisdiction of the country in which the parents actually are citizens.
Thus, their babies are subject to their jurisdiction, not America's. Their country's laws, like ours for us, come first for the illegals giving those country's their allegiance, not the United States. Our own citizenship laws provide the same for us citizens if we have a baby abroad. Our baby is under the same jurisdiction as we are, and therefore become American also.
The countries we are dealing with, especially Mexico, have the jurisdiction and our laws do not let us override another country's jurisdiction.
So, the "anchor babies" do not anchor any entitlements to their parents at all, according to this legal interpretation. It would be an act of compassion to transport parent and child back to Mexico. A newborn nurses so the baby will be OK. The parent(s) have been documented as sending $$ back to "family" in Mexico; they, their family, or their country should cover the expense of transport and reimburse us.

I learned early on that vigilante "justice" isn't justice at all. It is not right for people to exact their own brand of justice outside of the law. If there was a concern about people who were likely illegals, they should have called INS. INS would have investigated and their investigation would at least have been legal. This was more about sensationalism and terrorism than anything else. We don't need vigilantes. Vigilantes belong in jail. We need law abiding citizens who treat others with respect and compassion. I understand that people are upset about their taxpayer dollars being spent on social services for illegal immigrants. They should only be charged with the number of counts where they released private information such as DOB or SSN's. Names, addresses, and phone numbers are public information in the public domain (telephone books and directories). Also, for each illegal on the list, one count should be removed because they are here illegally. Only charge them for the names on the list that are not illegal.

Well its nice to see people taking action when the US government won't. Long time ago this was called Vigilante Justice. Call it what you will, but more people in the USA are being concerned (rightly so) about who is being let in both legally and illegally. The sadness is the working middle class has to pay for everything and become a victim of idenity theft.
I'm not against immigration, it just another program that our beloved government talks a good game about fixing and has shown little in correcting. Shame on all the people who are taking pot shots at Arizona for taking a little action.

I'm sure that they believe that they did no wrong. I can understand why they did it but they do deserve to be fired at the very least. They used a position of trust that they have in their jobs to send this information out. Even if every name on the list turns out to be someone that is illegal, they still did wrong. They took the risk knowing full well if they were caught that they would be fired. I applaud their conviction in putting their jobs on the line for what they believe in. I hope ICE used the list instead of just ignoring it.
They had a legitimate access to the data base which identified those who were illegals. The ones who should be fired are the Governor and the Director of the Workforces... who supplied food stamps and "public benefits" to known illegals.
Aiding and abetting is also a crime. If "those two" had not done their duty, they, as staff members, would be aiding and abetting also.
They did what they had to do, and they were obeying the law. The ones who put them on administrative leave were not. They should be fired by .... hmm the State's Legislature.

That is why we have the power of citizen's arrest. Make sure a cop is handy to take care of reading rights and taking them into custody. Make sure you know EXACTLY what crime/offense you are going to charge them with. If the cop refuses to arrest your governor then get his badge number and sue him and his police force, and make a big deal about dereliction of duty (of the cop AND the governor) in the newspapers and other media. When police won't perform their duties I think you are also supposed to report them to the FBI and/or the US Marshall's office. It just takes a pair of balls.

Because their children are American citizens, according to the US Constitution. So they're eligible for food stamps. If you're going to spend time screaming about defending the Constitution you should actually read it first and know what it means.

Allen - then why are there over 500,000 children in US foster care already? Could it be because 2/3 of them are African American? RealAmericaFirst Actually the Constitution does not say the babies are citizens at all. The parents are the citizens of the the country which has their loyalty, why we call them illegals. The baby is the citizenship of the parents.

You know, I think it took a lot of guts to put this list together. Wish they had made sure everyone on the list is an illegal though. It kind of blows the list's credibility if some people are here legally. None-the-less, I think this should be a pretty darn clear indication of how frustrated the American public is with the shenanigans of the Obama clique and other illegal alien supporters. I agree, Illegal is illegal. So, the 2 people who broke the law and stole the list and did so knowingly should also be pursued to the fullest extent of the law. If they broke federal law, then they should face that as well. This doesn’t excuse the illegal immigrants in the country illegally and every LEGAL measure should be taken to track them down and take what steps are allowed by law. If its illegal, then its illegal and anyone standing up for the the people who broke the law to get the list are just as bad as those who stand up for the illegal immigrants.

Stealing confidential data from the government and leaking it to the media is a serious crime, not to mention the moral and ethical implications of persecuting individuls and their families who may or may not have committed a crime. It wasn't stolen, there was no security block on it, hundreds of people had access to the data base, it was staff who did the humongous job of finding those listed who are illegals, and they sent it to LAW ENFORCEMENT AND THEIR OWN BOSSES.

The 14th Amendment to the U.S. Constitution reads in part:

Babies born to illegal alien mothers within U.S. borders are called anchor babies because under the 1965 immigration Act, they act as an anchor that pulls the illegal alien mother and eventually a host of other relatives into permanent U.S. residency. (Jackpot babies is another term).

I think it is much more important to investigate and find the people who violated the law and the terms of their employment. None of us should feel safe to learn that our private information can be published without recourse against the violators, regardless of their motivation.

If so, then if you are so sure of yourselves, then let those who have determined that no investigations will be done, list their respective names and proudly stand with their proclaimations. We need more "whistle blowers", not fewer. That is true in all facets of government, including local, state and federal. Don't hide behind your bureaucratic shield. Be bold. Stand up and be counted and identified. Otherwise, you are not being useful to the citizenry in general.

Hank, in this case I would disagree with you that the evidence was obtained illegally. That is because the state already had access to this information before it was stolen and disseminated to the public. You cannot make the argument that the evidence is illegal because it was stolen from the state and then given back to the state with the request to prosecute these people. The state already had access to this information and chose not to pursue investigating if any of these people were illegal.
