The Fed gov't has chosen not to address the issue of protecting our borders so AZ acted in the best interest of its citizens and did something about it. This is another example of the gov't ignoring the majority of people (70+%) that want our borders secured and the illegal aliens removed.

Folks, you need to understand, there is a difference between the migrant worker that comes here legally looking for work and the gangs coming across with criminal intent. The borders must be secured against the criminal element because it could be your family member that is harmed. All countries have policies for immigrants/visitors to enter, including Mexico. We are held accountable to their laws and expect that those entering this country should be held accountable to our laws.

Certain alliances criticizing Arizona law (enforcement of aka Federal Law) needs to pressure Mexico to take into account the "human" factor - rather than denouncing America for Mexico's decades of failure. There is no need for immigration reform, the need is to aggressively enforce existing Federal laws which have been relaxed for decades. Politicians screwed it all up, they are the blame for today's out of control situation and they need to fix it now. Why don't you people realize that those dope smugglers wouldn't be here if the American appetite for marijuana and cocaine wasn't so high. Where there is a need there will be a supplier, whether it's a product for daily use or an illegal activity, i.e. drugs, gambling, homes, food, or any other human need. As for the average illegal, it's jobs that are low paying, physical work, jobs that businesses need but don't want to pay a fair wage for. You stop the drug use and the small and large farms, hotels, construction companies, etc and you stop the border crossings. Address the real problem. A migrant worker registry has been proposed in the past and would work for farms that can't afford high labor costs, but is it fair to pay people less for menial jobs.

After the Sheriff's deputy was shot here last night, any protestors in Arizona are going to look pretty stupid. Also those of you that support them; last night's shooting is just a taste of what we have going on here. Of course most are not out shooting deputies; however they are all breaking the law.

Granted, the economic meltdown derailed a lot of legislation, but there is always a lack of will to tackle hot button issues...like health care reform. And in this environment in which Republicans have made 60 votes necessary on everything, immigration reform would be even more crazy than appointing judges.

But the legislation Obama refers to would require illegals to pay fines, go to the back of the line (preferably return home until citizenship is granted), pass health tests, criminal background checks, and most important learn English. I'm not really sure why illegals are protesting in favor of immigration reform unless they think they can get the bill watered down into amnesty.

This time I think not. Americans are very aware of the problem now and won't favor anything remotely close to amnesty. I don't understand why illegals give $5,000 to Coyotes to help smuggle them across the border when that's about what it costs for an immigration lawyer to process your citizenship paperwork.

In the meantime, the shootings show how bad things are on the border. Hopefully we can actually get walls built (promised multiple times) and more guards. The flood across the southern border is a matter of sovereignty. Even Mexico has stiffer laws for illegal entry into their country.

We need to change our naturalization law too. Many are pregnant women who know that if they have the baby on the US side of the border, it will make it harder to deport them, and will give their child automatic citizenship and a better future. Unacceptable--of course people will do this when we have such a law.

And the sense of entitlement with these illegals from the south is really disturbing. That they believe they can dictate or force their desires on a country instead of the other way around is troubling. Aside from being uneducated, unskilled, with no assets, these people are not the kind of citizens we want in our country, and we all want law-abiding folks for our neighbors. It's not about race. It's about much, much more. It's about national security, economic security, and most of all sovereignty.

Note to states and the citizens of those states who believe that AZ is in the wrong and those illegals have rights - You can have them! Maybe the solution is to offer anyone caught crossing the border a one-way ticket to DC or Chicago or your front yard. Once you've lived with them, you'll understand.

Arizona's controversial immigration law is only controversial to immigrants and is targeting those Illegal Immigrants that are criminals for illegally being in the United States. The Border Patrol has less officers than the City of New York and the head of their Department is our ex-governor that vetoed this new Arizona law when she was the governor. She feels that Arizona is being a burden on her Officers and her plans, which do not include sending the illegals home. Her resignation should be demanded. Greencard

Us S/N- you have to be a citizen to get one, otherwise you just commited a felony

US Drivers License- same as the s/n; need to eb a civi to get one; broke the law again if you bought a fake ID.

Work Visa- technically same as Greencard.

Passport

Any immigrant WITHOUT one of these is here ILLEGALLY and should be deported. EVERY single other country in this world, that has a centralized government, deports non-nationals that do not have one of these, some of them even imprison them (Ala Mexico).

We are the only country that does nothing about the majority of ILLEGALS in our country.

If you don't live in AZ, you can't comment on what its like to live here. I have lived on the boarder, I know what kind of crap gets pulled every day. When I lived in Douglas, the Border Partol's heli flew over my house at least once a day searching for illegals, and I lived on 19th St. During one particularly heavy rain storm a small part of 4th St collapsed because there was a tunnel being dug underneath it and it collapsed in on itself due to the weight of the water pooling up.

I am not sure how to post, but I am so glad to finally read that there are some people who still believe this is the UNITED STATES OF AMERICA and not Mexico. Why do we not hear on the media about the people who approve of Arizona's new law and would love to have it in their state. I am tired of supporting ILLEGALS in MY country.

America is a country of immigrants, true. America is a country that is full ignorance, judging by the protester's speeches, this is also true. Before anyone takes to the streets, twitter, blogs, etc they should read whatever they are going to protest. I don't care which side you take, but in order to have intelligent debate, both sides must know what they are debating. Media coverage of this is ridiculouswhen stars and political leaders whip up a frenzy with inaccurate information. Don't be lazy people, learn to read! The government does need to act, but it is in enforcement not reform that the action needs to occur. The laws are fine, they are not biased against any race or religion and even allow for officials to use some common sense. Those that are here that are not illegal are fine, unless they are harboring illegals. Those current illegals here with legal family should be fined and given the chance to follow legal immigration immediately or face deportation. Those with criminal records should be deported without a second thought. Many countries around the world are much stricter then we. I wonder if Ms. Estefan remembers when Castro deported all his "political" prisoners that were mixed with thieves and murders, he put them in boats and sent them towards Florida without a second thought. Mexico's laws have been brought to light with El Presidente's comments which treat all immigration offenses as felonies. So sit down read the bill, follow the reference links, and if you still object then debate it reasonably.

Hopefully, Border Patrol Agents, INS, ICE, and every other law enforcement group is attending the rallies and hauling the illegals back across the border. It would be a great sting operation but no one in government is interested in following the law if it doesn't result in more taxes and power for them and fewer rights for citizens.

Probably the main reason most protesters have not read the bill (SB 1070) is because it is not printed in a language they can read or they simply can't read at all. The rest think they have some invisible right to be in the United States of America illegally simply because they have been here a while, sort of "squatter's rights" if you will.

While I will agree with those who believe "many" (not most or all) those illegal immigrants are simple hard working people trying to make a better life for themselves and or family's, that argument does nothing to distract from the fact that, like it or not, they are in this country illegally and are therefore by both federal (and soon to be Arizona law) CRIMINALS! No matter how many different names you give them nor how beautiful (or pathetic) a picture you paint of an illegal immigrant and their family, they are CRIMINALS. If we allow Obama and Congress to give them amnesty for their crime then U.S. citizens who are in jail/prisons for non-violent (white collar type crimes) should file a law suit against the United States for discrimination. After all most of them who stole money from their employers were just trying to make a better life for themselves and or families. If ICE had any balls (or if Obama would give them back to ICE) ICE would start showing up at these rallies and start doing ID checks on people. So as not to discriminate check everyone's ID regardless of the color of their skin or gender and then arrest and deport those found to be illegal. That should have a two fold effect: (1) Get rid of some of the illegal immigrants who think they have a right to be here illegally and force this country to change to suit them. (2) Greatly diminish the size of and frequency's of these rallies. Let all legal U.S. citizens who want to participate in a legal protest, do so as often as they want. It should only be the illegals that should have to worry.

It is long past time we take out country back and IF Obama and Congress are not going to be part of the solution to the problem, then they should get the hell out of the way. I strongly suspect Arizona's law will be found constitutional and if I am correct, I look for many more states to follow suit with similar laws of their own. The possible exception would be California. The illegals there have basically done their part to ruin the state's economy and the government stepped in and filled in the gaps they missed.

The people rallying in California and across the nation against the Arizona Immigration bill; are the ones who have the most to lose -Illegal Residents.

So, how is that "Change to believe in", working Out for Everyone? What, not so good? I didn't think so! President Obama doesn't have the "Appetite" to tackle the Immigration Bill Problem in this country, because he needs the Hispanic votes and volunteers for midterm elections coming up, plus, his re-election bid in 2012. It's as simple as that! Forget about all the broken and un-kept promises to the Hispanic community during his presidential bid. He will just give a few more flowery speeches, and wind his volunteers up like drones..... Left, right, Left, right......Obama, Obama, Obama...

Americans need to be worried, afraid of the current political trend in this country. Republican, Democrat, Independent, Libertarian, Greenpeace, even the new Tea Party Movement; it doesn't matter your affiliation or political view. We have a current political administration whose policy is more government, more spending, less personal freedoms for its citizen's.

We have a President and Congress dreaming in the clouds and wanting to further space exploration. I am all for expanding our horizons; however, shouldn't we take care of some of the problems at home first before heading into the stars? Our national unemployment is over 12%; plus, the first quarter of 2010 reported national home foreclosure percentages on the rise. We've seen the 1st and 2nd Amendment rights trampled on via this administrations projected bills and passed bills. The 10th Amendment restricting government’s power over the people is a joke to our political wheel.

Alternately, as a nation we should be blazing mad over the current out of control national debt spending by this administration and congress. As of today, our current national debt is:

With current national population of 308.222,797, that breaks down to an individual personal liability of $41,820.60 per person in this country. Additionally, with the current spending in place, our national debt is increasing by 4.16 Billion per day.

This reckless regard for our country's economy and very financial existence can't be blamed on prior administrations. At the end of the Bush Administration, the national debt was $472 Billion Dollars. That is a mere drop in the bucket, with regards to the reckless spending this administration and congress, has spent or allocated in the last almost 17 months. It will take multiple generations to pay this debt down to reasonable levels.

Some of you may ask what any of this has to do with the Illegal’s problem and immigration problem in this country? Everything interconnects. Like it or not, we must address the illegal status of residents in this country. Some may say you are singling out the Hispanic community and racial profiling. Not so! Illegals are Illegal’s regardless of their country of origin. However, let's face facts, a very large majority of our Illegal’s are from Mexico and South America. Playing "Political Patty Cake" isn't going to change that.

Our court calendars across the nation are bogged down with crimes ranging from drunk and disorderly to gang violence and 1st Degree offenses by Illegal’s. The criminals that aren't sent to prison, thus joining a prison gang, are deported; only to cross the border again using another alias or stolen ID. Drug Cartel violence in Mexico is spilling over across the American borders; and, Americians are being kidnapped off our streets, taken across the border and held for ransom. Military personnel stationed along our southern borders, are told to keep their families on base, directly due to this threat. And our President, and the media downplay these event to the American people. No wonder Arizona has had enough! Texas, New Mexico, California; even, Louisiana and Nevada, should follow Arizona's lead by adopting similar bills!

Our local schools across the country are overburdened and financially strapped trying to teach Illegal children English and bring them up to speed with the rest of the class (and no, it is not our responsibility to offer 6 different languages in each class for various nationalities. English is the legal language of this country and every person here should have a passing understanding and use of it, regardless of what you speak at home. Plain and simple! Try going to Germany, Russia, Japan or any other foreign speaking country and ask them to change their home language to suit your needs! Right!).

Our State Welfare System and Social Security System and Medicare System nationwide, is almost bankrupt under the burden of supporting Illegal’s and their "Anchor Babies" born here after crossing the border in the 8th month of pregnancy, to milk our country's finances dry. The majority of Illegal’s haven't paid a dime into these systems, yet have learned to work the systems and drain the coffers.

Why am I so angry over this issue? Because of unemployment and home foreclosures. Some may say Illegal’s are just working the jobs Americans won't. Not so! Employers in every state across the country have begun replacing skilled American workers with Illegal’s. Why? It's cheaper to pay them; Illegal’s can be worked 50-60 hours a week without paying overtime or medical insurance. How you may ask? If the Illegal complains to any state or federal agency, they are deported due to their Illegal status. If you doubt this, what language have you heard in local fast food restaurants, gas stations, hospital kitchens, security jobs, waitresses, cooks, etc, etc, etc. Blue Collar, previous union jobs, and now White Collar Workers are being replaced with Illegal’s across the nation. Americans are losing their jobs and homes at an alarming rate directly due to this employment shift and trend.

What really gets me is the economic collapse created by this situation and liberals making excuses , holding hands across the nation, and singing “We Will Overcome"; burying their head in the sand, ignoring the legal and economic upheaval this situation is creating! Have any of you ever been to a Wal Mart or any other Western Union on Payday or the first of the months. How many Illegal’s do you see sending most of their earnings OUT Of AMERICA? I think it is wonderful anyone wanting to take care of their families; however, America cannot support the whole world while its' own financial stability and economy is collapsing. That is what is happening here, we are taking vast earnings out of our economy and these funds are shifted weekly to other nations supporting and strengthening their economies.

Some may say, Illegal’s are just immigrants like our forefathers. Not so. Do you remember a little document called the "Constitution of the United States". Our Constitution is very clear on residency and permanent status of immigrants in this country. Immigrants are to apply for residency, work visas, or legal status. Immigrants are to find gainful employment, obey all laws of the land, pay taxes, and apply for citizenship after five (5) years of residency. We have Illegal’s that have been in this country twenty (20) years or more, and haven't complied with any of these stipulations. Like it or not, Illegal’s don't have the same rights as Americans. Why? Because they are breaking the laws of the land on a daily basis; and refuse to take the necessary steps toward citizenship as outlined in our Constitution. You can't have it both ways!

You can't pick and choose what laws to obey or ignore and expect the nation to stand strong! Any illegal that doesn't want to become a legal citizen or, at the very least, legal resident subject to the laws of the land; doesn't need to be here and needs to be deported. Finally, consider the slap in the face, this issue has on legal immigrants. Many wait for years to come to America, and become citizens. Our country has to limit the number of legal immigrant applications, due to the financial drain on the nation, due to the Illegal’s problem. Plain and simple!

So you see, everything interconnects.

We have a political administration and majority controlled congress, that isn't hiding their agenda of more government control and decision making regardless of public outcry. America is at a very dangerous crossroads... If we don't take back our country during the 2010 mid elections and in 2012; we may lose the opportunity of being a "Country of the People, For the People, and, By the People". Instead we will have policies and laws in place that creates "A Country of the Government, by the Government, Regardless of the People." That doesn't sound very "Free" to me!

This is just so sad. Our country is being invaded by illegals but what is our gov't/politicians doing to combat this...NOTHING! I read like a very lengthy article this morning in regards to the drug war in Mexico and it trying to spill over into the United States.

I for one am sick of immigrants coming to the United States illegally, then being slapped on the wrist and being told to come to court in 3 months, then released from jail. Then turn around get a Visa and take our jobs for less money.............which only makes this recession worse. Not only that but once illegal immigrants get citizenship status they can retire on OUR social security without having to work a day on their life in the United States for it.

Hardly any of you know the violence and drugs that is going on in Mexico. It's unsafe to travel there. Murder or kidnapped and sold into what ever form of slavery they see fit to put you in.

So am I all for immigration laws being felonies.............yes. Am I for racial profiling in order to keep this war from spewing over to our free country? Yes.

I've seen Juarez, Mexico................even from a distance it's a scary place. (where most of the violence is going on) Politicians have no clue.....................maybe they need to switch to dictatorship..............

Oh and one more thing....................99% of construction jobs in Louisiana have gone to illegal immigrants. I have even found out that a women in the Baton Rouge area makes $100K a load to bring in a truck load of immigrants for cheap labor.

What the "sleeping giant" is forgetting is that these people are here ILLEGALLY. There is no injustice in deporting them, therefore, mainstream America is only going to see this massive protest as a frightening example of how many non-citizen, NON_VETTED, criminals (you're here illegally, you're a criminal) are in this country. Likely the protests will only make more average citizens up at arms to end the flood of illegals. Further, legal immigrants are undermined by these criminals. They are not "undocumented immigrants". MY solution for those who don't consider breaking the law by illegally entering the US as breaking the law...send em all to those states protesting. Let them take care of the burden, but take it out of their state taxes, don't make us pay federal taxes to support these individuals. And by the way Mexican is a nationality, not a race. I am a legal immigrant. My parents brought me here. They were business people. They paid a lot of money do to so. I awaited in mine country for five years till i was granted a visa. I had to sign for military selective service. When I enter collegue to learn English I have to pay outofstate tuition rate becasue I needed to be living in that state for more than a year to qualify for state resident rate. I support immigration but legal immigration. They have to pay their dues like everybody else. Yes, USA is a country of immigrant but those first immigrant didn't get their women pregnant so they could collect WIC. They didn't send all their earnings back to their country. They came here to stay. Helping to build this country. Giving and giving a lot, no taking and taking advange like many today.

This is absolutely great!! Look at all the protesters turning out! Now, perhaps the legal occupants of the United States will see just how big this problem is. Wake up America. Literally thousands of illegals are now demonstrating to be allowed to ignore our laws. They think by force of numbers to overturn legal rulings that have been in place for decades. As if, by their numbers, they can force our legal system to change immigration laws to suit them, not to protect us. It's time we asked our congressman if they are with us or against us. In most of Europe, any law enforcement organization is able and well within the scope of the law to assert migratory status and their immigration laws are not even half as forgiving as ours. In many european countries citizenship is not granted for the mere the fact that you were born in that country. The mother or father has to be citizen of that country. Even legal residents must meet certain criteria in order for their children to be considered citizens.

I find this all so amusing. I am an immigrant who came to this country 35 years ago, worked myself through school and more than achieved the american dream. This is my country. this is the land I protect and I am honor to call my home. I'm really tired of those that look at what arizona is doing and complains without having knowledge of the bill or what troubles that we go through. We had a rancher die last month, because illegals crossed gainned access to his ranch and killed him. One thing that does need to be understood though (even though I am ALL in favor of this bill) - not all illegals are criminals and bad people. The only thing they have against them is they are illegal - and that is important. But they are really good people otherwise. Please understand that. RonH good point. You all should know that illegals all long to become legal someday. You guys make it sound like it's fun being illegal. Stuck in a low paying job, not being able to go to College, not being able to travel.

When immigrants get to this country, legals and illegals advice you to file your income taxes if you want to become legal some day. Repeating what people in power say does not necessarily mean it's true. So this is how it happens; you file your income tax and if you are owed money the government does not refund any money because you are not in the system. If you owe money, now you count to the IRS and you mail your check or get in a payment plan. How about business owners? Some are self employed (cleaning houses / mowing the lawn for example) and because they are not business savvy they file as a sole propriator instead of forming a Corporation and save some money in taxes ....... in conclusion, they pay more taxes than an American. Ofcourse, work with me here, some do, some don't, some partially do. I know because I lived it, I'm not repeating or assuming anything here ..... there is more, wait for my next post, more info you don't know

Personally I could care less about what color their skin is. They could be albino for all I care. If they are in my country illegally, then I want them gone. As for other countries...you will not find an American in another country illegally...or at least not for very long. Most OTHER countries have far stricter immigration laws than we do.

Back again. Another important point to consider, the total # of illegals in this country is false. A lot of them have filed to become legalized, to become part of the system but the INS department takes too long to process the forms. We should put pressure on INS to push these applications through in a reasonable amount of time so that more people count. Mine took 10 years.

Keep in mind before responding with something negative that I too think rapists, dealers, murderers, and gangs should be deported (whether they are legal or not) and if one is legal they should be stripped from their status and given to someone that deserves it.

One last point to add to my 1st paragraph is that after you file for your papers, you do not get any document that at least says you are waiting for approval, you remain illegal the whole time. Even though you qualify to be legal TODAY, the system doesn't work

Once again our government is negligent in its duties and now the criminals are the victims!

How many other countries with stable governments have ever allowed an issue like this to get so out of hand? Only ours. Illegal alliens outnumber legal immigrations since the 90's. As far as profiling is concerned, 80% of all illegal immigrants are from Mexico and other Latin American countries. If there is a tendancy for illegal aliens to be from a certain ethnicity of course the suspicion will be to look for that characteristic.

As of 2006, the United States accepts more legal immigrants as permanent residents than all other countries in the world combined. The leading countries of birth of the new citizens were Mexico, India and the Philippines. Why would we do that when our country is in the middle of a severe recession? Complicate this with the number of illegal aliens, estimated between 12 and 20 million, and we have our current problem. Our government again, as it has with the wars on crime, poverty, illitearcy and drugs, is a blatant failure.

Strengthening our borders to prevent illegal immigration is paramount. The governments abhorent attempts have obviously not been enough to secure our border. We The People have a Constitutional Right to be protected from enemies. Since 2006 our nation has been in debate about illegal aliens, as of today NONE of these issues have been corrected. Four years is a VERY long time for our government to be negligent in our countries security.

It took days to pass massive legislation to pass TARP and the Stimulus package for a Crisis of only 2 years. It took less than a year to pass legislation for health care reform, yet we still dither in our illegal alien crisis. Our government, more explicitly Congress, has been useless in its obligation to secure our borders. The security of our borders is NOT about the Latinos, Indians, Asians and others that apply and become citizens legally. It's about the millions of illegals that keep abusing our laws.

I am so sick of people like you who stereotype Americans as being nothing but fat, white, and racist. Perhaps you should step outside and you will see that Americans are made up of many ethnic groups of all shapes and sizes. I don't know of any Americans who think they're too good to do any job.

I washed and detailed cars at a car dealership for 5-6 years making only minimum wage. When I first started there I was working 6 days a week for at least the first year before they let me have a day off. I even had to cut grass with a weed eater even though that was not in my job description. I would have to go and get lunch for a couple of the salesmen every now and then too which was not in my job description either. I washed cars in 100 degree weather during the summer and 40 degree weather in the winter. I had to paint a large car ramp with nothing but a paint brush in 100 degree weather.

My brother-in-law worked for a home manufacturer until last year when he was laid off because of cutbacks while there were illegal aliens there. The illegals were from Mexico and he told me how they would tell him how they illegally crossed over the border. How they would send half of their paychecks back to Mexico. How they would rent an apartment and have as many illegals as they could fit in it live there so that the rent wouldn't cost each of them that much. They would actually go to the bathroom in the corner in the bathroom at work instead of using the toilet, and it wasn't just urinating in the corner that they would do, then cover it up with a paper towel. When the manager found out he called everyone into a meeting and told them that they better not do anything like that again or they would be fired. He also told me how one of the illegals told him he didn't want to become legal because then he would have to pay taxes which means he would get less and so he would have less to send back to Mexico.

Don't you dare give me that crap about illegals paying for Americans when illegals get welfare, food stamps, free healthcare, free school, and so many other benefits that are paid for by Americans. All of those programs are meant for Americans and not illegals yet our politicians let this sort of thing keep going on so they can get that vote and another dollar in their pockets.

I am not a racist person, far from it, but I cannot stand to see illegals breaking our laws to get into this country and stay here, then our politicians letting it slide. I have had friends of many different ethnic groups, black, white, korean, phillipine, etc. My best friend who I consider to be more of a brother than just a friend is black while I am white. The bottom line - this is a legal issue with laws that substantiate the removal of illegal aliens from U.S. soil. I also see this as an international incident of mega proportions and Mexico should be taken to the World Court for neglecting it's people and forcing them to cross into a neighboring country illegally in order to "live." I believe that sanctions should be levied against Mexico because of the cross border violence and I also believe the U.N. should be sent to Mexico to deal with drug war and to monitor the border on the Mexican side. Our states should re-mobilize our National Guard garrisons and place them in smaller out-posts along our border with Mexico - and have the each state deputize members of the Guard - giving them the authority to detain and deport.

Lastly, all illegals should be rounded up and sent back to their country of origin. If they want to live in this country - there are legals way of doing so...

Tomorrow, when you leave for work, I am going to sneak into your home. I am going to eat your food, sleep in your bed, use your health care, plop myself on your couch and watch your television. I am then going to sneak my 9 month pregnant wife into your home. Upon doing so, she goes into labor and gives birth to a beautiful baby boy within YOUR HOME. Also, during the time in your home, I mopped the floor and ironed your clothes.

When you come home you see all this going on in YOUR HOME. You immediately call the police claiming there are intruders in your home. The police arrive at your door. You tell them about the entire situation. The police then tell you that the people did nothing wrong. You are now perplexed. The police explain that the intuders established residence within your home and they cant throw them out. They tell you the the man within your home is a hard worker and not a criminal. When you tell the police that the intruders ate your food and watched your television, the police tell you that they are entitled to those things because they also cleaned your floor and ironed your clothes. When you ask the police to at least identify the people, the police say that they cannot do that either because the intruders HAVE RIGHTS and that they cannot ask them who they are because THEY DONT WANT TO VIOLATE THEIR RIGHTS! You then ask the police how you can get the people out of your home. The police tell you that you cant get them out. And not only that, you now have to take care of the entire family. David (post 1.125) makes excellent points re: the multitude of benefits illegal aliens receive in US Tax dollars. Given all these benefits, it is easy to see why they will fight relentlessly (through "civil rights groups" and bribery of our politicians) to remain in the US.

If one legal immigrant who works houses numerous illegal aliens, they will all be eligible for a wide array of public assistance, and the state workers who process benefits are prohibited from reporting anyone to ICE (even though they are required to verify legal status re: citizenship).

Thus, it is worth any risks for them to remain in the U.S. Those who believe that drying up the job market for them will stop them from coming to the U.S. are wrong.

This has become a scenario of "bleeding the beast," and our politicians obviously gain more politically and financially by supporting this fiasco than by enforcing our laws. Until voters make it clear that they will OUT anyone who supports this travesty, it will continue. Unfortunately, it appears that "amnesty" will be the only "reform" considered by our current administration and congress.

I hope that the November elections will usher in change in congress and that those elected will understand that voter outcry means they must act to enforce our laws and deport those who are here illegally. I'm not holding my breath on that one, however....

Section 1. Intent 2
The legislature finds that there is a compelling interest in the 3
cooperative enforcement of federal immigration laws throughout all of 4
Arizona. The legislature declares that the intent of this act is to make 5
attrition through enforcement the public policy of all state and local 6
government agencies in Arizona. The provisions of this act are intended to 7
work together to discourage and deter the unlawful entry and presence of 8
aliens and economic activity by persons unlawfully present in the United 9
States. 10
Sec. 2. Title 11, chapter 7, Arizona Revised Statutes, is amended by 11
adding article 8, to read: 12
ARTICLE 8. ENFORCEMENT OF IMMIGRATION LAWS 13
11-1051. Cooperation and assistance in enforcement of 14
immigration laws; indemnification 15
A. NO OFFICIAL OR AGENCY OF THIS STATE OR A COUNTY, CITY, TOWN OR 16
OTHER POLITICAL SUBDIVISION OF THIS STATE MAY ADOPT A POLICY THAT LIMITS OR 17
RESTRICTS THE ENFORCEMENT OF FEDERAL IMMIGRATION LAWS TO LESS THAN THE FULL 18
EXTENT PERMITTED BY FEDERAL LAW. 19
B. FOR ANY LAWFUL CONTACT MADE BY A LAW ENFORCEMENT OFFICIAL OR AGENCY 20

D. NOTWITHSTANDING ANY OTHER LAW, A LAW ENFORCEMENT AGENCY MAY 32

G. A PERSON MAY BRING AN ACTION IN SUPERIOR COURT TO CHALLENGE ANY 11
OFFICIAL OR AGENCY OF THIS STATE OR A COUNTY, CITY, TOWN OR OTHER POLITICAL 12
SUBDIVISION OF THIS STATE THAT ADOPTS OR IMPLEMENTS A POLICY THAT LIMITS OR 13
RESTRICTS THE ENFORCEMENT OF FEDERAL IMMIGRATION LAWS TO LESS THAN THE FULL 14
EXTENT PERMITTED BY FEDERAL LAW. IF THERE IS A JUDICIAL FINDING THAT AN 15
ENTITY HAS VIOLATED THIS SECTION, THE COURT SHALL ORDER ANY OF THE FOLLOWING: 16

H. A COURT SHALL COLLECT THE CIVIL PENALTY PRESCRIBED IN SUBSECTION G 23

MISSION APPROPRIATION. MONIES IN THE SPECIAL SUBACCOUNT ARE SUBJECT TO 21

ENFORCEMENT AND FOR COUNTY JAIL REIMBURSEMENT COSTS RELATING TO ILLEGAL 23

F. THIS SECTION DOES NOT APPLY TO A PERSON WHO MAINTAINS AUTHORIZATION 25
FROM THE FEDERAL GOVERNMENT TO REMAIN IN THE UNITED STATES. 26
G. A VIOLATION OF THIS SECTION IS A CLASS 1 MISDEMEANOR, EXCEPT THAT A 27
VIOLATION OF THIS SECTION IS: 28
1. A CLASS 3 FELONY IF THE PERSON VIOLATES THIS SECTION WHILE IN 29
POSSESSION OF ANY OF THE FOLLOWING: 30
(a) A DANGEROUS DRUG AS DEFINED IN SECTION 13-3401. 31
(b) PRECURSOR CHEMICALS THAT ARE USED IN THE MANUFACTURING OF 32
METHAMPHETAMINE IN VIOLATION OF SECTION 13-3404.01. 33
(c) A DEADLY WEAPON OR A DANGEROUS INSTRUMENT, AS DEFINED IN SECTION 34

Sec. 4. Section 13-2319, Arizona Revised Statutes, is amended to read: 1
13-2319. Smuggling; classification; definitions 2
A. It is unlawful for a person to intentionally engage in the 3
smuggling of human beings for profit or commercial purpose. 4
B. A violation of this section is a class 4 felony. 5
C. Notwithstanding subsection B of this section, a violation of this 6
section: 7
1. Is a class 2 felony if the human being who is smuggled is under 8
eighteen years of age and is not accompanied by a family member over eighteen 9
years of age or the offense involved the use of a deadly weapon or dangerous 10
instrument. 11
2. Is a class 3 felony if the offense involves the use or threatened 12
use of deadly physical force and the person is not eligible for suspension of 13
sentence, probation, pardon or release from confinement on any other basis 14
except pursuant to section 31-233, subsection A or B until the sentence 15
imposed by the court is served, the person is eligible for release pursuant 16
to section 41-1604.07 or the sentence is commuted. 17
D. Chapter 10 of this title does not apply to a violation of 18
subsection C, paragraph 1 of this section. 19
E. NOTWITHSTANDING ANY OTHER LAW, A PEACE OFFICER MAY LAWFULLY STOP 20
ANY PERSON WHO IS OPERATING A MOTOR VEHICLE IF THE OFFICER HAS REASONABLE 21
SUSPICION TO BELIEVE THE PERSON IS IN VIOLATION OF ANY CIVIL TRAFFIC LAW AND 22
THIS SECTION. 23
E. F. For the purposes of this section: 24
1. "Family member" means the person's parent, grandparent, sibling or 25
any other person who is related to the person by consanguinity or affinity to 26
the second degree. 27
2. "Procurement of transportation" means any participation in or 28
facilitation of transportation and includes: 29
(a) Providing services that facilitate transportation including travel 30
arrangement services or money transmission services. 31
(b) Providing property that facilitates transportation, including a 32
weapon, a vehicle or other means of transportation or false identification, 33
or selling, leasing, renting or otherwise making available a drop house as 34
defined in section 13-2322. 35
3. "Smuggling of human beings" means the transportation, procurement 36
of transportation or use of property or real property by a person or an 37
entity that knows or has reason to know that the person or persons 38
transported or to be transported are not United States citizens, permanent 39
resident aliens or persons otherwise lawfully in this state or have attempted 40
to enter, entered or remained in the United States in violation of law. 41

Sec. 5. Title 13, chapter 29, Arizona Revised Statutes, is amended by 1
adding sections 13-2928 and 13-2929, to read: 2
13-2928. Unlawful stopping to hire and pick up passengers for 3
work; unlawful application, solicitation or 4
employment; classification; definitions 5
A. IT IS UNLAWFUL FOR AN OCCUPANT OF A MOTOR VEHICLE THAT IS STOPPED 6
ON A STREET, ROADWAY OR HIGHWAY TO ATTEMPT TO HIRE OR HIRE AND PICK UP 7
PASSENGERS FOR WORK AT A DIFFERENT LOCATION IF THE MOTOR VEHICLE BLOCKS OR 8
IMPEDES THE NORMAL MOVEMENT OF TRAFFIC. 9
B. IT IS UNLAWFUL FOR A PERSON TO ENTER A MOTOR VEHICLE THAT IS 10
STOPPED ON A STREET, ROADWAY OR HIGHWAY IN ORDER TO BE HIRED BY AN OCCUPANT 11
OF THE MOTOR VEHICLE AND TO BE TRANSPORTED TO WORK AT A DIFFERENT LOCATION IF 12
THE MOTOR VEHICLE BLOCKS OR IMPEDES THE NORMAL MOVEMENT OF TRAFFIC. 13
C. IT IS UNLAWFUL FOR A PERSON WHO IS UNLAWFULLY PRESENT IN THE UNITED 14
STATES AND WHO IS AN UNAUTHORIZED ALIEN TO KNOWINGLY APPLY FOR WORK, SOLICIT 15
WORK IN A PUBLIC PLACE OR PERFORM WORK AS AN EMPLOYEE OR INDEPENDENT 16
CONTRACTOR IN THIS STATE. 17
D. A VIOLATION OF THIS SECTION IS A CLASS 1 MISDEMEANOR. 18
E. FOR THE PURPOSES OF THIS SECTION: 19
1. "SOLICIT" MEANS VERBAL OR NONVERBAL COMMUNICATION BY A GESTURE OR A 20
NOD THAT WOULD INDICATE TO A REASONABLE PERSON THAT A PERSON IS WILLING TO BE 21
EMPLOYED. 22
2. "UNAUTHORIZED ALIEN" MEANS AN ALIEN WHO DOES NOT HAVE THE LEGAL 23
RIGHT OR AUTHORIZATION UNDER FEDERAL LAW TO WORK IN THE UNITED STATES AS 24
DESCRIBED IN 8 UNITED STATES CODE SECTION 1324a(h)(3). 25
13-2929. Unlawful transporting, moving, concealing, harboring 26
or shielding of unlawful aliens; vehicle 27
impoundment; classification 28
A. IT IS UNLAWFUL FOR A PERSON WHO IS IN VIOLATION OF A CRIMINAL 29
OFFENSE TO: 30
1. TRANSPORT OR MOVE OR ATTEMPT TO TRANSPORT OR MOVE AN ALIEN IN THIS 31
STATE IN A MEANS OF TRANSPORTATION IF THE PERSON KNOWS OR RECKLESSLY 32
DISREGARDS THE FACT THAT THE ALIEN HAS COME TO, HAS ENTERED OR REMAINS IN THE 33
UNITED STATES IN VIOLATION OF LAW. 34
2. CONCEAL, HARBOR OR SHIELD OR ATTEMPT TO CONCEAL, HARBOR OR SHIELD 35
AN ALIEN FROM DETECTION IN ANY PLACE IN THIS STATE, INCLUDING ANY BUILDING OR 36
ANY MEANS OF TRANSPORTATION, IF THE PERSON KNOWS OR RECKLESSLY DISREGARDS THE 37
FACT THAT THE ALIEN HAS COME TO, HAS ENTERED OR REMAINS IN THE UNITED STATES 38
IN VIOLATION OF LAW. 39
3. ENCOURAGE OR INDUCE AN ALIEN TO COME TO OR RESIDE IN THIS STATE IF 40
THE PERSON KNOWS OR RECKLESSLY DISREGARDS THE FACT THAT SUCH COMING TO, 41
ENTERING OR RESIDING IN THIS STATE IS OR WILL BE IN VIOLATION OF LAW. 42
B. A MEANS OF TRANSPORTATION THAT IS USED IN THE COMMISSION OF A 43
VIOLATION OF THIS SECTION IS SUBJECT TO MANDATORY VEHICLE IMMOBILIZATION OR 44
IMPOUNDMENT PURSUANT TO SECTION 28-3511. 45

C. A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A CLASS 1 1
MISDEMEANOR AND IS SUBJECT TO A FINE OF AT LEAST ONE THOUSAND DOLLARS, EXCEPT 2
THAT A VIOLATION OF THIS SECTION THAT INVOLVES TEN OR MORE ILLEGAL ALIENS IS 3
A CLASS 6 FELONY AND THE PERSON IS SUBJECT TO A FINE OF AT LEAST ONE THOUSAND 4
DOLLARS FOR EACH ALIEN WHO IS INVOLVED. 5
Sec. 6. Section 23-212, Arizona Revised Statutes, is amended to read: 6
23-212. Knowingly employing unauthorized aliens; prohibition; 7
false and frivolous complaints; violation; 8
classification; license suspension and revocation; 9
affirmative defense 10
A. An employer shall not knowingly employ an unauthorized alien. If, 11
in the case when an employer uses a contract, subcontract or other 12
independent contractor agreement to obtain the labor of an alien in this 13
state, the employer knowingly contracts with an unauthorized alien or with a 14
person who employs or contracts with an unauthorized alien to perform the 15
labor, the employer violates this subsection. 16
B. The attorney general shall prescribe a complaint form for a person 17
to allege a violation of subsection A of this section. The complainant shall 18
not be required to list the complainant's social security number on the 19
complaint form or to have the complaint form notarized. On receipt of a 20
complaint on a prescribed complaint form that an employer allegedly knowingly 21
employs an unauthorized alien, the attorney general or county attorney shall 22
investigate whether the employer has violated subsection A of this section. 23
If a complaint is received but is not submitted on a prescribed complaint 24
form, the attorney general or county attorney may investigate whether the 25
employer has violated subsection A of this section. This subsection shall 26
not be construed to prohibit the filing of anonymous complaints that are not 27
submitted on a prescribed complaint form. The attorney general or county 28
attorney shall not investigate complaints that are based solely on race, 29
color or national origin. A complaint that is submitted to a county attorney 30
shall be submitted to the county attorney in the county in which the alleged 31
unauthorized alien is or was employed by the employer. The county sheriff or 32
any other local law enforcement agency may assist in investigating a 33
complaint. When investigating a complaint, the attorney general or county 34
attorney shall verify the work authorization of the alleged unauthorized 35
alien with the federal government pursuant to 8 United States Code section 36
1373(c). A state, county or local official shall not attempt to 37
independently make a final determination on whether an alien is authorized to 38
work in the United States. An alien's immigration status or work 39
authorization status shall be verified with the federal government pursuant 40
to 8 United States Code section 1373(c). A person who knowingly files a 41
false and frivolous complaint under this subsection is guilty of a class 3 42
misdemeanor. 43

C. If, after an investigation, the attorney general or county attorney 1
determines that the complaint is not false and frivolous: 2
1. The attorney general or county attorney shall notify the United 3
States immigration and customs enforcement of the unauthorized alien. 4
2. The attorney general or county attorney shall notify the local law 5
enforcement agency of the unauthorized alien. 6
3. The attorney general shall notify the appropriate county attorney 7
to bring an action pursuant to subsection D of this section if the complaint 8
was originally filed with the attorney general. 9
D. An action for a violation of subsection A of this section shall be 10
brought against the employer by the county attorney in the county where the 11
unauthorized alien employee is or was employed by the employer. The county 12
attorney shall not bring an action against any employer for any violation of 13
subsection A of this section that occurs before January 1, 2008. A second 14
violation of this section shall be based only on an unauthorized alien who is 15
or was employed by the employer after an action has been brought for a 16
violation of subsection A of this section or section 23-212.01, subsection A. 17
E. For any action in superior court under this section, the court 18
shall expedite the action, including assigning the hearing at the earliest 19
practicable date. 20
F. On a finding of a violation of subsection A of this section: 21
1. For a first violation, as described in paragraph 3 of this 22
subsection, the court: 23
(a) Shall order the employer to terminate the employment of all 24
unauthorized aliens. 25
(b) Shall order the employer to be subject to a three year 26
probationary period for the business location where the unauthorized alien 27
performed work. During the probationary period the employer shall file 28
quarterly reports in the form provided in section 23-722.01 with the county 29
attorney of each new employee who is hired by the employer at the business 30
location where the unauthorized alien performed work. 31
(c) Shall order the employer to file a signed sworn affidavit with the 32
county attorney within three business days after the order is issued. The 33
affidavit shall state that the employer has terminated the employment of all 34
unauthorized aliens in this state and that the employer will not 35
intentionally or knowingly employ an unauthorized alien in this state. The 36
court shall order the appropriate agencies to suspend all licenses subject to 37
this subdivision that are held by the employer if the employer fails to file 38
a signed sworn affidavit with the county attorney within three business days 39
after the order is issued. All licenses that are suspended under this 40
subdivision shall remain suspended until the employer files a signed sworn 41
affidavit with the county attorney. Notwithstanding any other law, on filing 42
of the affidavit the suspended licenses shall be reinstated immediately by 43
the appropriate agencies. For the purposes of this subdivision, the licenses 44
that are subject to suspension under this subdivision are all licenses that 45

are held by the employer specific to the business location where the 1
unauthorized alien performed work. If the employer does not hold a license 2
specific to the business location where the unauthorized alien performed 3
work, but a license is necessary to operate the employer's business in 4
general, the licenses that are subject to suspension under this subdivision 5
are all licenses that are held by the employer at the employer's primary 6
place of business. On receipt of the court's order and notwithstanding any 7
other law, the appropriate agencies shall suspend the licenses according to 8
the court's order. The court shall send a copy of the court's order to the 9
attorney general and the attorney general shall maintain the copy pursuant to 10
subsection G of this section. 11
(d) May order the appropriate agencies to suspend all licenses 12
described in subdivision (c) of this paragraph that are held by the employer 13
for not to exceed ten business days. The court shall base its decision to 14
suspend under this subdivision on any evidence or information submitted to it 15
during the action for a violation of this subsection and shall consider the 16
following factors, if relevant: 17
(i) The number of unauthorized aliens employed by the employer. 18
(ii) Any prior misconduct by the employer. 19
(iii) The degree of harm resulting from the violation. 20
(iv) Whether the employer made good faith efforts to comply with any 21
applicable requirements. 22
(v) The duration of the violation. 23
(vi) The role of the directors, officers or principals of the employer 24
in the violation. 25
(vii) Any other factors the court deems appropriate. 26
2. For a second violation, as described in paragraph 3 of this 27
subsection, the court shall order the appropriate agencies to permanently 28
revoke all licenses that are held by the employer specific to the business 29
location where the unauthorized alien performed work. If the employer does 30
not hold a license specific to the business location where the unauthorized 31
alien performed work, but a license is necessary to operate the employer's 32
business in general, the court shall order the appropriate agencies to 33
permanently revoke all licenses that are held by the employer at the 34
employer's primary place of business. On receipt of the order and 35
notwithstanding any other law, the appropriate agencies shall immediately 36
revoke the licenses. 37
3. The violation shall be considered: 38
(a) A first violation by an employer at a business location if the 39
violation did not occur during a probationary period ordered by the court 40
under this subsection or section 23-212.01, subsection F for that employer's 41
business location. 42
(b) A second violation by an employer at a business location if the 43
violation occurred during a probationary period ordered by the court under 44

this subsection or section 23-212.01, subsection F for that employer's 1
business location. 2
G. The attorney general shall maintain copies of court orders that are 3
received pursuant to subsection F of this section and shall maintain a 4
database of the employers and business locations that have a first violation 5
of subsection A of this section and make the court orders available on the 6
attorney general's website. 7
H. On determining whether an employee is an unauthorized alien, the 8
court shall consider only the federal government's determination pursuant to 9
8 United States Code section 1373(c). The federal government's determination 10
creates a rebuttable presumption of the employee's lawful status. The court 11
may take judicial notice of the federal government's determination and may 12
request the federal government to provide automated or testimonial 13
verification pursuant to 8 United States Code section 1373(c). 14
I. For the purposes of this section, proof of verifying the employment 15
authorization of an employee through the e-verify program creates a 16
rebuttable presumption that an employer did not knowingly employ an 17
unauthorized alien. 18
J. For the purposes of this section, an employer that establishes that 19
it has complied in good faith with the requirements of 8 United States Code 20
section 1324a(b) establishes an affirmative defense that the employer did not 21
knowingly employ an unauthorized alien. An employer is considered to have 22
complied with the requirements of 8 United States Code section 1324a(b), 23
notwithstanding an isolated, sporadic or accidental technical or procedural 24
failure to meet the requirements, if there is a good faith attempt to comply 25
with the requirements. 26
K. IT IS AN AFFIRMATIVE DEFENSE TO A VIOLATION OF SUBSECTION A OF THIS 27
SECTION THAT THE EMPLOYER WAS ENTRAPPED. TO CLAIM ENTRAPMENT, THE EMPLOYER 28
MUST ADMIT BY THE EMPLOYER'S TESTIMONY OR OTHER EVIDENCE THE SUBSTANTIAL 29
ELEMENTS OF THE VIOLATION. AN EMPLOYER WHO ASSERTS AN ENTRAPMENT DEFENSE HAS 30
THE BURDEN OF PROVING THE FOLLOWING BY CLEAR AND CONVINCING EVIDENCE: 31
1. THE IDEA OF COMMITTING THE VIOLATION STARTED WITH LAW ENFORCEMENT 32
OFFICERS OR THEIR AGENTS RATHER THAN WITH THE EMPLOYER. 33
2. THE LAW ENFORCEMENT OFFICERS OR THEIR AGENTS URGED AND INDUCED THE 34
EMPLOYER TO COMMIT THE VIOLATION. 35
3. THE EMPLOYER WAS NOT PREDISPOSED TO COMMIT THE VIOLATION BEFORE THE 36
LAW ENFORCEMENT OFFICERS OR THEIR AGENTS URGED AND INDUCED THE EMPLOYER TO 37
COMMIT THE VIOLATION. 38
L. AN EMPLOYER DOES NOT ESTABLISH ENTRAPMENT IF THE EMPLOYER WAS 39
PREDISPOSED TO VIOLATE SUBSECTION A OF THIS SECTION AND THE LAW ENFORCEMENT 40
OFFICERS OR THEIR AGENTS MERELY PROVIDED THE EMPLOYER WITH AN OPPORTUNITY TO 41
COMMIT THE VIOLATION. IT IS NOT ENTRAPMENT FOR LAW ENFORCEMENT OFFICERS OR 42
THEIR AGENTS MERELY TO USE A RUSE OR TO CONCEAL THEIR IDENTITY. THE CONDUCT 43
OF LAW ENFORCEMENT OFFICERS AND THEIR AGENTS MAY BE CONSIDERED IN DETERMINING 44
IF AN EMPLOYER HAS PROVEN ENTRAPMENT. 45

A. An employer shall not intentionally employ an unauthorized alien. 7
If, in the case when an employer uses a contract, subcontract or other 8
independent contractor agreement to obtain the labor of an alien in this 9
state, the employer intentionally contracts with an unauthorized alien or 10
with a person who employs or contracts with an unauthorized alien to perform 11
the labor, the employer violates this subsection. 12
B. The attorney general shall prescribe a complaint form for a person 13
to allege a violation of subsection A of this section. The complainant shall 14
not be required to list the complainant's social security number on the 15
complaint form or to have the complaint form notarized. On receipt of a 16
complaint on a prescribed complaint form that an employer allegedly 17
intentionally employs an unauthorized alien, the attorney general or county 18
attorney shall investigate whether the employer has violated subsection A of 19
this section. If a complaint is received but is not submitted on a 20
prescribed complaint form, the attorney general or county attorney may 21
investigate whether the employer has violated subsection A of this section. 22
This subsection shall not be construed to prohibit the filing of anonymous 23
complaints that are not submitted on a prescribed complaint form. The 24
attorney general or county attorney shall not investigate complaints that are 25

it during the action for a violation of this subsection and shall consider 30
the following factors, if relevant: 31
(i) The number of unauthorized aliens employed by the employer. 32
(ii) Any prior misconduct by the employer. 33
(iii) The degree of harm resulting from the violation. 34
(iv) Whether the employer made good faith efforts to comply with any 35

suspended under this subdivision for failing to file a signed sworn affidavit 4
shall remain suspended until the employer files a signed sworn affidavit with 5
the county attorney. For the purposes of this subdivision, the licenses that 6
are subject to suspension under this subdivision are all licenses that are 7
held by the employer specific to the business location where the unauthorized 8
alien performed work. If the employer does not hold a license specific to 9
the business location where the unauthorized alien performed work, but a 10
license is necessary to operate the employer's business in general, the 11
licenses that are subject to suspension under this subdivision are all 12
licenses that are held by the employer at the employer's primary place of 13
business. On receipt of the court's order and notwithstanding any other law, 14
the appropriate agencies shall suspend the licenses according to the court's 15
order. The court shall send a copy of the court's order to the attorney 16
general and the attorney general shall maintain the copy pursuant to 17
subsection G of this section. 18
2. For a second violation, as described in paragraph 3 of this 19
subsection, the court shall order the appropriate agencies to permanently 20

location where the unauthorized alien performed work. If the employer does 22

received pursuant to subsection F of this section and shall maintain a 40
database of the employers and business locations that have a first violation 41
of subsection A of this section and make the court orders available on the 42
attorney general's website. 43
H. On determining whether an employee is an unauthorized alien, the 44
court shall consider only the federal government's determination pursuant to 45
S.B. 1070
- 13 -
8 United States Code section 1373(c). The federal government's determination 1
creates a rebuttable presumption of the employee's lawful status. The court 2
may take judicial notice of the federal government's determination and may 3
request the federal government to provide automated or testimonial 4
verification pursuant to 8 United States Code section 1373(c). 5
I. For the purposes of this section, proof of verifying the employment 6
authorization of an employee through the e-verify program creates a 7
rebuttable presumption that an employer did not intentionally employ an 8
unauthorized alien. 9
J. For the purposes of this section, an employer that establishes that 10
it has complied in good faith with the requirements of 8 United States Code 11
section 1324a(b) establishes an affirmative defense that the employer did not 12
intentionally employ an unauthorized alien. An employer is considered to 13
have complied with the requirements of 8 United States Code section 1324a(b), 14
notwithstanding an isolated, sporadic or accidental technical or procedural 15
failure to meet the requirements, if there is a good faith attempt to comply 16
with the requirements. 17
K. IT IS AN AFFIRMATIVE DEFENSE TO A VIOLATION OF SUBSECTION A OF THIS 18
SECTION THAT THE EMPLOYER WAS ENTRAPPED. TO CLAIM ENTRAPMENT, THE EMPLOYER 19
MUST ADMIT BY THE EMPLOYER'S TESTIMONY OR OTHER EVIDENCE THE SUBSTANTIAL 20
ELEMENTS OF THE VIOLATION. AN EMPLOYER WHO ASSERTS AN ENTRAPMENT DEFENSE HAS 21
THE BURDEN OF PROVING THE FOLLOWING BY CLEAR AND CONVINCING EVIDENCE: 22
1. THE IDEA OF COMMITTING THE VIOLATION STARTED WITH LAW ENFORCEMENT 23
OFFICERS OR THEIR AGENTS RATHER THAN WITH THE EMPLOYER. 24
2. THE LAW ENFORCEMENT OFFICERS OR THEIR AGENTS URGED AND INDUCED THE 25
EMPLOYER TO COMMIT THE VIOLATION. 26
3. THE EMPLOYER WAS NOT PREDISPOSED TO COMMIT THE VIOLATION BEFORE THE 27
LAW ENFORCEMENT OFFICERS OR THEIR AGENTS URGED AND INDUCED THE EMPLOYER TO 28
COMMIT THE VIOLATION. 29
L. AN EMPLOYER DOES NOT ESTABLISH ENTRAPMENT IF THE EMPLOYER WAS 30
PREDISPOSED TO VIOLATE SUBSECTION A OF THIS SECTION AND THE LAW ENFORCEMENT 31
OFFICERS OR THEIR AGENTS MERELY PROVIDED THE EMPLOYER WITH AN OPPORTUNITY TO 32
COMMIT THE VIOLATION. IT IS NOT ENTRAPMENT FOR LAW ENFORCEMENT OFFICERS OR 33
THEIR AGENTS MERELY TO USE A RUSE OR TO CONCEAL THEIR IDENTITY. THE CONDUCT 34
OF LAW ENFORCEMENT OFFICERS AND THEIR AGENTS MAY BE CONSIDERED IN DETERMINING 35
IF AN EMPLOYER HAS PROVEN ENTRAPMENT. 36
Sec. 8. Section 23-214, Arizona Revised Statutes, is amended to read: 37
23-214. Verification of employment eligibility; e-verify 38
program; economic development incentives; list of 39
registered employers 40
A. After December 31, 2007, every employer, after hiring an employee, 41
shall verify the employment eligibility of the employee through the e-verify 42
program AND SHALL KEEP A RECORD OF THE VERIFICATION FOR THE DURATION OF THE 43
EMPLOYEE'S EMPLOYMENT OR AT LEAST THREE YEARS, WHICHEVER IS LONGER. 44

B. In addition to any other requirement for an employer to receive an 1
economic development incentive from a government entity, the employer shall 2
register with and participate in the e-verify program. Before receiving the 3
economic development incentive, the employer shall provide proof to the 4
government entity that the employer is registered with and is participating 5
in the e-verify program. If the government entity determines that the 6
employer is not complying with this subsection, the government entity shall 7
notify the employer by certified mail of the government entity's 8
determination of noncompliance and the employer's right to appeal the 9
determination. On a final determination of noncompliance, the employer shall 10
repay all monies received as an economic development incentive to the 11
government entity within thirty days of the final determination. For the 12
purposes of this subsection: 13
1. "Economic development incentive" means any grant, loan or 14
performance-based incentive from any government entity that is awarded after 15
September 30, 2008. Economic development incentive does not include any tax 16
provision under title 42 or 43. 17
2. "Government entity" means this state and any political subdivision 18
of this state that receives and uses tax revenues. 19
C. Every three months the attorney general shall request from the 20
United States department of homeland security a list of employers from this 21
state that are registered with the e-verify program. On receipt of the list 22
of employers, the attorney general shall make the list available on the 23
attorney general's website. 24
Sec. 9. Section 28-3511, Arizona Revised Statutes, is amended to read: 25
28-3511. Removal and immobilization or impoundment of vehicle 26
A. A peace officer shall cause the removal and either immobilization 27
or impoundment of a vehicle if the peace officer determines that a person is 28
driving the vehicle while any of the following applies: 29
1. The person's driving privilege is suspended or revoked for any 30
reason. 31
2. The person has not ever been issued a valid driver license or 32
permit by this state and the person does not produce evidence of ever having 33
a valid driver license or permit issued by another jurisdiction. This 34
paragraph does not apply to the operation of an implement of husbandry. 35
3. The person is subject to an ignition interlock device requirement 36
pursuant to chapter 4 of this title and the person is operating a vehicle 37
without a functioning certified ignition interlock device. This paragraph 38
does not apply to a person operating an employer's vehicle or the operation 39
of a vehicle due to a substantial emergency as defined in section 28-1464. 40
4. THE PERSON IS IN VIOLATION OF A CRIMINAL OFFENSE AND IS 41
TRANSPORTING, MOVING, CONCEALING, HARBORING OR SHIELDING OR ATTEMPTING TO 42
TRANSPORT, MOVE, CONCEAL, HARBOR OR SHIELD AN ALIEN IN THIS STATE IN A 43
VEHICLE IF THE PERSON KNOWS OR RECKLESSLY DISREGARDS THE FACT THAT THE ALIEN 44
HAS COME TO, HAS ENTERED OR REMAINS IN THE UNITED STATES IN VIOLATION OF LAW. 45

B. A peace officer shall cause the removal and impoundment of a 1
vehicle if the peace officer determines that a person is driving the vehicle 2
and if all of the following apply: 3
1. The person's driving privilege is canceled, suspended or revoked 4
for any reason or the person has not ever been issued a driver license or 5
permit by this state and the person does not produce evidence of ever having 6
a driver license or permit issued by another jurisdiction. 7
2. The person is not in compliance with the financial responsibility 8
requirements of chapter 9, article 4 of this title. 9
3. The person is driving a vehicle that is involved in an accident 10
that results in either property damage or injury to or death of another 11
person. 12
C. Except as provided in subsection D of this section, while a peace 13
officer has control of the vehicle the peace officer shall cause the removal 14
and either immobilization or impoundment of the vehicle if the peace officer 15
has probable cause to arrest the driver of the vehicle for a violation of 16
section 4-244, paragraph 34 or section 28-1382 or 28-1383. 17
D. A peace officer shall not cause the removal and either the 18
immobilization or impoundment of a vehicle pursuant to subsection C of this 19
section if all of the following apply: 20
1. The peace officer determines that the vehicle is currently 21
registered and that the driver or the vehicle is in compliance with the 22
financial responsibility requirements of chapter 9, article 4 of this title. 23
2. The spouse of the driver is with the driver at the time of the 24
arrest. 25
3. The peace officer has reasonable grounds to believe that the spouse 26
of the driver: 27
(a) Has a valid driver license. 28
(b) Is not impaired by intoxicating liquor, any drug, a vapor 29
releasing substance containing a toxic substance or any combination of 30
liquor, drugs or vapor releasing substances. 31
(c) Does not have any spirituous liquor in the spouse's body if the 32
spouse is under twenty-one years of age. 33
4. The spouse notifies the peace officer that the spouse will drive 34
the vehicle from the place of arrest to the driver's home or other place of 35
safety. 36
5. The spouse drives the vehicle as prescribed by paragraph 4 of this 37
subsection. 38
E. Except as otherwise provided in this article, a vehicle that is 39
removed and either immobilized or impounded pursuant to subsection A, B or C 40
of this section shall be immobilized or impounded for thirty days. An 41
insurance company does not have a duty to pay any benefits for charges or 42
fees for immobilization or impoundment. 43
F. The owner of a vehicle that is removed and either immobilized or 44
impounded pursuant to subsection A, B or C of this section, the spouse of the 45

owner and each person identified on the department's record with an interest 1
in the vehicle shall be provided with an opportunity for an immobilization or 2
poststorage hearing pursuant to section 28-3514. 3
Sec. 10. Title 41, chapter 12, article 2, Arizona Revised Statutes, is 4
amended by adding section 41-1724, to read: 5
41-1724. Gang and immigration intelligence team enforcement 6
mission fund 7
THE GANG AND IMMIGRATION INTELLIGENCE TEAM ENFORCEMENT MISSION FUND IS 8
ESTABLISHED CONSISTING OF MONIES DEPOSITED PURSUANT TO SECTION 11-1051 AND 9
MONIES APPROPRIATED BY THE LEGISLATURE. THE DEPARTMENT SHALL ADMINISTER THE 10
FUND. MONIES IN THE FUND ARE SUBJECT TO LEGISLATIVE APPROPRIATION AND SHALL 11
BE USED FOR GANG AND IMMIGRATION ENFORCEMENT AND FOR COUNTY JAIL 12
REIMBURSEMENT COSTS RELATING TO ILLEGAL IMMIGRATION. 13
Sec. 11. Severability, implementation and construction 14
A. If a provision of this act or its application to any person or 15
circumstance is held invalid, the invalidity does not affect other provisions 16
or applications of the act that can be given effect without the invalid 17
provision or application, and to this end the provisions of this act are 18
severable. 19
B. The terms of this act regarding immigration shall be construed to 20
have the meanings given to them under federal immigration law. 21
C. This act shall be implemented in a manner consistent with federal 22
laws regulating immigration, protecting the civil rights of all persons and 23
respecting the privileges and immunities of United States citizens. 24
Sec. 12. Short title 25
This act may be cited as the "Support Our Law Enforcement and Safe 26
Neighborhoods Act". 27

It is very possible that some of the illegals crossing the unsecured borders could be international terrorists. If you have never lived in Arizona you cannot possibly know all of the consequences of having an unprotected border, and I find it very interesting that so many people, including our president can so readily criticize what Arizona has done. Far be it from me to think that the groups I stated above are anywhere near the majority (11-12M of illegals). I believe that 99.9 % are from Mexico and other central and south American countries.

However; if ICE Agents are on hand and a demonstrator is arrested then the ICE Agents can legally by federal law ascertain their citizenship and if they are illegal, haul them off. Border patrol however at a federal level do have the right to setup checkpoints to cover all exits away from these rally... The persons they are stopping and checking are no longer at a protest, and hopefully they are not dumb enough to drive without a drivers license and insurance.

Actually the check point can be for driver's license, registration, and insurance, by local law, anyone found without gets detained, with ICE officers on scene to validate identity. I've gone thru a few of those checkpoints in California and they were impounding cars too. The only additional step needed there is for ICE officers to be present and witness the lack of identification, to establish the reasonable suspicion at a federal level :)

If you like this idea forward it to your local law enforcement, especially if they have a MOA with ICE. Have them setup a coordinated effort where they remove uninsured drivers and catch illegals in the process. This is also major revenue generator from impound fees, and car auctions. The checkpoint is strictly to enforce the state laws of insurance, drivers license, and registration, which is not a right but a necessity to participate in the privilege of driving on American roads.

Let's use one of those mandate laws to our advantage for once, and let the illegals come to us vs. us trying to chase them ;)

We can solve illegal immigration through Mexico rather easily, turn the marines in Ca south and let them take everything to ourside of the ismus of Panama. We'd have a lot shorter and much easier border to defend.

We have to educate them, take care of them when they go to the ER, they do not pay taxes and they send most all their money back to Mexico. You should really talk to your local civil rights leaders and ask them what happens if in a lawsuit that reaches the Supreme Court this law stands and is deemed constitutional on its merits... Ask them based on the current court, if they believe they should really be risking this ;)

I am angry that the country has come to this, unable to act. I am angry to think that not only do we provide many services for illegals, but we are also allowing them to attend our colleges and universities, too. Where does it stop? Why can't the legislators make the tough decisions and choices?

Its crazy in California, the state is broke, 22K teachers are being cut, but the state assembly passed a resolution for no-cussing week! Now it awaits a vote in the senate. The legislators do nothing about our own big problems with illegals, and don't demand the feds do anything, either.

If the dems were in any way going to support Arizona, or enforce federal immigration law (not in favor of illegals), then the Hispanic communities are going to boycott the elections! They obviously believe that their votes directly affect the outcome of dem seats! They've made it pretty clear, that any politician who wishes to retain his position, better start kissing their asses and ignore the rest of the population who want reform!

Funny you should mention the Mexican Army, in Southern California the actual Mexican Army has been as far as 14 miles into our nation on a mans ranch where he caught them and called the border patrol! They had UN stamped weapons and was in uniform! The border patrol called the state department and they turned them loose and demanded their weapons be returned to them! They were escorting undesirables across the border! Yeah our government will secure the border, "HOLD YOUR BREATH!"

Americans need to be worried, afraid of the current political trend in this country. We have a current political administration whose policy is more government, more spending, less personal freedoms for its citizen's.

We have a President and Congress dreaming in the clouds and wanting to further space exploration. I am all for expanding our horizons; however, shouldn't we take care of some of the problems at home first before heading into the stars? Our national unemployment is over 12%; plus, the first quarter of 2010 reported national home foreclosure percentages on the rise. We've seen the 1st and 2nd Amendment rights trampled on via this administrations projected bills and passed bills. The 10th Amendment restricting government’s power over the people is a joke to our political wheel.

Alternately, as a nation we should be blazing mad over the current out of control national debt spending by this administration and congress. As of today, our current national debt is:

$12, 890,060,880,610.00 (yes, your reading this right, that's almost 13 TRILLION DOLLARS)

With current national population of 308.222,797, that breaks down to an individual personal liability of $41,820.60 per person in this country. Additionally, with the current spending in place, our national debt is increasing by 4.16 Billion per day.

This reckless regard for our country's economy and very financial existence can't be blamed on prior administrations. At the end of the Bush Administration, the national debt was $472 Billion Dollars. That is a mere drop in the bucket, with regards to the reckless spending this administration and congress, has spent or allocated in the last almost 17 months. It will take multiple generations to pay this debt down to reasonable levels.

Some of you may ask what any of this has to do with the Illegal’s problem and immigration problem in this country? Everything interconnects. Like it or not, we must address the illegal status of residents in this country. Some may say you are singling out the Hispanic community and racial profiling. Not so! Illegals are Illegal’s regardless of their country of origin. However, let's face facts, a very large majority of our Illegal’s are from Mexico and South America. Playing "Political Patty Cake" isn't going to change that.

Our court calendars across the nation are bogged down with crimes ranging from drunk and disorderly to gang violence and 1st Degree offenses by Illegal’s. The criminals that aren't sent to prison, thus joining a prison gang, are deported; only to cross the border again using another alias or stolen ID. Drug Cartel violence in Mexico is spilling over across the American borders; and, Americians are being kidnapped off our streets, taken across the border and held for ransom. Military personnel stationed along our southern borders, are told to keep their families on base, directly due to this threat. And our President, and the media downplay these event to the American people. No wonder Arizona has had enough! Texas, New Mexico, California; even, Louisiana and Nevada, should follow Arizona's lead by adopting similar bills!

Our local schools across the country are overburdened and financially strapped trying to teach Illegal children English and bring them up to speed with the rest of the class (and no, it is not our responsibility to offer 6 different languages in each class for various nationalities. English is the legal language of this country and every person here should have a passing understanding and use of it, regardless of what you speak at home. Plain and simple! Try going to Germany, Russia, Japan or any other foreign speaking country and ask them to change their home language to suit your needs! Right!).

Our State Welfare System and Social Security System and Medicare System nationwide, is almost bankrupt under the burden of supporting Illegal’s and their "Anchor Babies" born here after crossing the border in the 8th month of pregnancy, to milk our country's finances dry. The majority of Illegal’s haven't paid a dime into these systems, yet have learned to work the systems and drain the coffers.

Why am I so angry over this issue? Because of unemployment and home foreclosures. Some may say Illegal’s are just working the jobs Americans won't. Not so! Employers in every state across the country have begun replacing skilled American workers with Illegal’s. Why? It's cheaper to pay them; Illegal’s can be worked 50-60 hours a week without paying overtime or medical insurance. How you may ask? If the Illegal complains to any state or federal agency, they are deported due to their Illegal status. If you doubt this, what language have you heard in local fast food restaurants, gas stations, hospital kitchens, security jobs, waitresses, cooks, etc, etc, etc. Blue Collar, previous union jobs, and now White Collar Workers are being replaced with Illegal’s across the nation. Americans are losing their jobs and homes at an alarming rate directly due to this employment shift and trend.

What really gets me is the economic collapse created by this situation and liberals making excuses , holding hands across the nation, and singing “We Will Overcome"; burying their head in the sand, ignoring the legal and economic upheaval this situation is creating! Have any of you ever been to a Wal Mart or any other Western Union on Payday or the first of the months. How many Illegal’s do you see sending most of their earnings OUT Of AMERICA? I think it is wonderful anyone wanting to take care of their families; however, America cannot support the whole world while its' own financial stability and economy is collapsing. That is what is happening here, we are taking vast earnings out of our economy and these funds are shifted weekly to other nations supporting and strengthening their economies.

Some may say, Illegal’s are just immigrants like our forefathers. Not so. Do you remember a little document called the "Constitution of the United States". Our Constitution is very clear on residency and permanent status of immigrants in this country. Immigrants are to apply for residency, work visas, or legal status. Immigrants are to find gainful employment, obey all laws of the land, pay taxes, and apply for citizenship after five (5) years of residency. We have Illegal’s that have been in this country twenty (20) years or more, and haven't complied with any of these stipulations. Like it or not, Illegal’s don't have the same rights as Americans. Why? Because they are breaking the laws of the land on a daily basis; and refuse to take the necessary steps toward citizenship as outlined in our Constitution. You can't have it both ways!

You can't pick and choose what laws to obey or ignore and expect the nation to stand strong! Any illegal that doesn't want to become a legal citizen or, at the very least, legal resident subject to the laws of the land; doesn't need to be here and needs to be deported. Finally, consider the slap in the face, this issue has on legal immigrants. Many wait for years to come to America, and become citizens. Our country has to limit the number of legal immigrant applications, due to the financial drain on the nation, due to the Illegal’s problem. Plain and simple!

So you see, everything interconnects.

We have a political administration and majority controlled congress, that isn't hiding their agenda of more government control and decision making regardless of public outcry. America is at a very dangerous crossroads... If we don't take back our country during the 2010 mid elections and in 2012; we may lose the opportunity of being a "Country of the People, For the People, and, By the People". Instead we will have policies and laws in place that creates "A Country of the Government, by the Government, Regardless of the People." That doesn't sound very "Free" to me!

Bottom line, the choice is yours! Use your next few votes wisely. This may be the last real opportunity; we have as a nation of voters, to "Take Back" what is being stripped away from us! Schwarzenegger is out of office in a matter of months. He's a fool (and no, I'd NEVER vote in a foreigner, for any reason.), who's given the state nothing instead of common sense legislation. He's a lame duck Governor in a gerrymandered to death in favor of the Democratic state legislation. Both are worthless to us in California. People here are now voting for the skin color of the politician, instead of the worth of the politician. None of these reflect the TRUE values of the people who live in the state.

Well the answer to the illegal problem does not lie in driving them out of one state into another. All Arizona is doing is that. Other States have tried similar approaches that have failed. The governor of this state and the senators from there are afraid of their own shadow and caved in to this stupid bill which just ticked off a votin block that is 16% of the population. The answer is a national effort aimed at the people who employ illegals. In my state which is a farming state and cannery we have more illegals in the summer than Arizona has.

Dave-I have pressed for the Catholic church to pay taxes as they benefit financially from business ventures. I was told they are not a business and do not have to pay taxes. Are you sure your not confusing illegals with Migrants that are here legally either as citizens or on visas? I am from Wisconsin and our Latino population rises during the growing/harvesting seasons to but not many are illegals compared to the ratio of illegals/permanent Latino residents.

I'm a confirmed Catholic and was educated K-12 in Catholic schools so I know a thing or two about this. When I was a kid the parish at the school I attended was supported by a core group of elderly whites. That was 15 years ago and most of them have passed on. Now they say Mass in Spanish, Vietnamese, and Tagalog.

This is precisely the reason why there's supposed to be a separation between church and state. Bishops and priests are weighing in on this in favor of the illegals because their loyalty is first and foremost to one of the world's oldest bureaucracies, the only religion that has representation at the United Nations and is one of the wealthiest landholding organizations in the world.

They'll use their image as moral authorities to advance their own position at the expense of the rest of us, and the nation as a whole. They don't care about the illegals any more than the Democrats who see full ballot boxes and the Republicans who see cheap labor for their corporate contributors. It's all about power.
