When I first heard about this international kidnapping, I wrote to the Brazilian Supreme Court (in Portuguese) and reminded them that we returned a CUBAN NATIONAL back to Cuba. In fact, because his American family would not give him up, our attorney general authorized police action to retrieve the child.

I hope that everyone writes to these people and demand the return of this boy to his natural father. It would be best if it were in Portuguese and there are free translation sites everywhere.

Brazil has a high crime rate and is known for homeless abandoned children on the street. Looks like they might be planning a little extorsion.

What a bunch of rubbish from the Brazilian courts, to even allow this! The stepfather and his family are grasping at straws. A nine year old child, who has been denied access to his biological father for five years; isn't capable of making a life changing decision as custody. The bottom line; this child was stolen from his legal and biological father. The biological mother is dead and the stepfather isn't the next of kin, legally. The biological father has been fighting the Brazilian courts for over five years for his son's return. Enough is Enough! This child needs to be returned to his real father and now!

The bottom line here is the Brazilian stepfather. He doesn't have the legal right to withhold this child. However, as an attorney, he knows how to throw up legal road blocks to gain more time with the child; at the child's and biological fathers' expense. I think the stepfather is deliberately wasting court time and asking for continuances with the hope, the courts will say too much time has past and the child is too old to be returned. What a nice way to gain a son! Steal it from another man and create legal roadblocks until you to keep the stolen child. Doesn't say much about Brazil for allowing this to continue, does it?

This is a travesty and everytime I hear what Brazil is doing this father and son, it boils my blood. I would bet anything that this man's family is buying everyone off. It must not be illegal there because otherwise the courts decision would hold up and the father and son would be permanently reunited. The appeals thing is absurb. The bottom line is the father wants his son, that he's been trying to get back for 5 years, and Brazil isn't complying. This is international kidnapping.

What's worse is that now the boy's step-family has been granted a hearing on whether the boy's own testimony ie. does he want to stay in Brazil or return to the US., should be heard. Because of this ruling, and because the court is officially in recess, at best this whole thing won't be heard until February of next year.

The problem is that a Brazilian lawyer most likely has the means, legal and otherwise, to kidnap the child back! And you are right. They would not want to the child to speak, unless they were reasonably sure what he would say.

I can remember seeing this story on 60 Minutes, what it feels like is decades ago. I it so very unfortunate, bu I hope the Brazilian Supreme court will see reason and reunite this father and his son. Now. Think of all the mother's and father's who are faced with the international kidnapping of a child or children, but don't have the financial means to fight as this father does.

Case in point: I came from a very abusive household with a very manipulative father. My father wouldn't let go of one opportunity to bash my mother, both mentally and physically. For years, he would say that she was out to cheat on him, out to embarrass him, etc. His mental dysfunctions and dillusions could fill a book. Ever since I was a little girl. Somehow, the closer I got to my mother (due to a few nervous breakdowns that finally led to her schizophrenia and bipolar disorder) - and realized that my father was the real villain.

Love finds a way - and repairs can be made - but the ones that truly fair poorly are the ones that restrict and distort the truth. When the child finally chooses who will be his family, there are going to be a lot of disapointed people. Time will tell.

That Judge needs to be removed form the bench. Not only was it ruled on by three other judges, he is breaking international law by not turning the boy back to his father.

A number of governmental layers in both the U.S. and Brazilian systems need to be adequately paid off before the boy is released. The paperwork is staggering, but the real issue is money.

I'm with you, this just doesn't make sense. The child was kidnapped and the Brazillian government did nothing in the beginning in regards to the kidnapping and then the mother died. How/Why the Brazillian government see's that the step father has more rights than the biological father, I'll never get. This is a very sad story.

Pax - You might be forgetting that the mother "went on vacation" with the boy and never returned, effectively kidnapping the boy. That being the case I couldn't understand how anybody could side with the mother. If she wanted to move back to Brazil with her son she should have filed for divorce, fought for custody, and then left. Even then I don't believe she could leave the country with the boy without his permission.

The boys mother is dead. She died giving birth last year. This is the STEP father doing this.

Are you serious Ron for implying that David might be abusive? I'm not exactly putting words in your mouth but the implication is there. Let's get one thing straight, there has never been any issues that have ever been addressed regarding that particular issue. It's obvious that David loves his son more than life itself, otherwise he would have just moved on and found another woman and started another family. A lot of men have done it and turned their backs on their past lives. David isn't one of those or abusive. He's a dad that wants his son to come home so they can live their lives again.

Not all people. There were many of us who felt that Elian should be sent back to his father - that even if his life MIGHT be better here in the U.S., that it was inappropriate to keep him from his biological father.

I always thought Elian should be with his dad.

And I feel Brazil is flaunting international law because, as the news said, his Brazilian kidnappers are wealthy and connected in the Brazilian courts. I travel a lot for work and fun. I promise you, neither myself nor company will be traveling to Brazil. It's a small step but I hope more people take it.

Whenever something like this happens there will always be people voicing their opinion on both sides. What is important is the child was returned like he was supposed to be. Also there is a huge difference between the two cases. Elian Gonzalez's father sent him and his mother here illegally on a raft. He was not kidnapped. The problem with the Elian custody was the mother did not survive the raft ride over to this country. With Sean he was kidnapped by the mother when she refused to return to the United States with her son after her "vacation".

From what the article says, David Goldman WAS trying to get her charged with kidnapping, but she died before that could happen.
