Case in point: I came from a very abusive household with a very manipulative father. My father wouldn't let go of one opportunity to bash my mother, both mentally and physically. For years, he would say that she was out to cheat on him, out to embarrass him, etc. His mental dysfunctions and dillusions could fill a book. Ever since I was a little girl. Somehow, the closer I got to my mother (due to a few nervous breakdowns that finally led to her schizophrenia and bipolar disorder) - and realized that my father was the real villain.

And what exactly is the child supposed to say? He will be accompanied by a lawyer chosen by the step father and his family, and therefore will probably not feel free to speak freely about his own father!
I cannot imagine my child being taken away from me, and having no legal recourse to get my child back. I hope this child gets to spend time with his father since he is there, but I know that is doubtful. A sad, sad situation, no matter how one looks at it!

What's worse is that now the boy's step-family has been granted a hearing on whether the boy's own testimony ie. does he want to stay in Brazil or return to the US., should be heard. Because of this ruling, and because the court is officially in recess, at best this whole thing won't be heard until February of next year.

The problem is that a Brazilian lawyer most likely has the means, legal and otherwise, to kidnap the child back! And you are right. They would not want to the child to speak, unless they were reasonably sure what he would say.
I can remember seeing this story on 60 Minutes, what it feels like is decades ago. I it so very unfortunate, bu I hope the Brazilian Supreme court will see reason and reunite this father and his son. Now. Think of all the mother's and father's who are faced with the international kidnapping of a child or children, but don't have the financial means to fight as this father does.

Case in point: I came from a very abusive household with a very manipulative father. My father wouldn't let go of one opportunity to bash my mother, both mentally and physically. For years, he would say that she was out to cheat on him, out to embarrass him, etc. His mental dysfunctions and dillusions could fill a book. Ever since I was a little girl. Somehow, the closer I got to my mother (due to a few nervous breakdowns that finally led to her schizophrenia and bipolar disorder) - and realized that my father was the real villain.
Love finds a way - and repairs can be made - but the ones that truly fair poorly are the ones that restrict and distort the truth. When the child finally chooses who will be his family, there are going to be a lot of disapointed people. Time will tell.

Boggles the mind. At the very least these idiots need to realize they are dealing with a child being kept from his father and this should be expedited. This is not some criminal that is better off in jail so if they take their sweet time no one is harmed. I'm with you, this just doesn't make sense. The child was kidnapped and the Brazillian government did nothing in the beginning in regards to the kidnapping and then the mother died. Pax - You might be forgetting that the mother "went on vacation" with the boy and never returned, effectively kidnapping the boy. That being the case I couldn't understand how anybody could side with the mother. If she wanted to move back to Brazil with her son she should have filed for divorce, fought for custody, and then left. Even then I don't believe she could leave the country with the boy without his permission.
This whole story is confusing. Why did the Mother do this? Was she protecting herself and child? She may or may not have had a good reason. We just dont know who is the victim. Let's get one thing straight, there has never been any issues that have ever been addressed regarding that particular issue. It's obvious that David loves his son more than life itself, otherwise he would have just moved on and found another woman and started another family. A lot of men have done it and turned their backs on their past lives. David isn't one of those or abusive. He's a dad that wants his son to come home so they can live their lives again.

This is so unfair. This poor man has been fighting for years to get his son back and has been flying back and forth to and from Brazil over and over, and getting jerked around by the Brazil authorities. Its time to hand over this man's child before the kid is too old. It seems that that is what Brazil is waiting for and is alienating the child's affections from the rightful father. Brazil needs to do the decent and humane thing for both father and son and return the son to the father NOW. Or sanction Brazil from any further economic trade from the U.S.
The grandmother has flat-out said that she will appeal and stall the process until he's of age.

His wife took the boy on a vacation and stayed.. this is cross border kidnapping... what is the problem here? Is the stepfather's family "connected".. What about an international court of law rather than a Brazilian court..? And of course they know that the longer they keep the father away the less likely the boy will want to leave the Brazilian "family".. He is DAvid Goldman's son for god's sake.

Reminds me of the Elian Gonzalez case. Only in reverse. If memory serves, people were lobbying to keep him here away from his father in Cuba, despite the fact that his father was never shown to be an unfit parent and his other relatives in Florida had no legal rights to keep him here.

And I feel Brazil is flaunting international law because, as the news said, his Brazilian kidnappers are wealthy and connected in the Brazilian courts. I travel a lot for work and fun. I promise you, neither myself nor company will be traveling to Brazil. It's a small step but I hope more people take it.
Whenever something like this happens there will always be people voicing their opinion on both sides. What is important is the child was returned like he was supposed to be. Also there is a huge difference between the two cases. Elian Gonzalez's father sent him and his mother here illegally on a raft. He was not kidnapped. The problem with the Elian custody was the mother did not survive the raft ride over to this country. With Sean he was kidnapped by the mother when she refused to return to the United States with her son after her "vacation".
Sean belongs with his father, it's as simple as that. Bruna had no right to keep Sean there in the first place, and how she was never charged with kidnapping is beyond me.
From what the article says, David Goldman WAS trying to get her charged with kidnapping, but she died before that could happen.

This is completely OUTRAGEOUS. Mr. Goldman's son was KIDNAPPED from him by his unscrupulous, selfish ex-wife - and now some jerk who has no biological connection to Sean is trying to keep him away from his father? It just makes me want to cry - I was so hoping that Sean would be spending Christmas with his father this year. I hope that the relatives in Brazil realize that if and when Mr. Goldman finally DOES win back custody of Sean, they will probably never see him again - or will only be able to see him if they come to the US and are closely supervised every second they are with him.
