Look, I'm getting older and more irritated with kids every day (and I hate rap)—but the kids say they were the only car in line and they left when asked. The report was one-sided from an involved "witness" at the business. This should NEVER have risen to the level of a police report, and, if reported, police resources should not have been wasted on the issue (and even if the police found and spoke with the kids, a citation should never have been issued).
I did similar (and probably worse) stuff as a teenager and any police involvement took the form of a "Don't do it again." and usually ended with them walking away laughing about it. This case is ridiculous and a serious waste of police and judicial resources not to mention tax dollars.
The question isn't did the kids do cause for a citation, it was did the police have the right to cite the teenagers? The answer yes, they were doing their duty, it doesn't matter if was stupid or not, police are not at fault, it is McDonalds and the stupid teenagers. If I reported something to the police and told me they aren't wasting their time on my stupid report, they better be fired.
I agree wholeheartedly with you. As a non-Mormon who lived in Utah while attending BYU, I thought many times that Utah's statutes were a bit outdated and over the top sometimes, but this is ridiculous (even though I, too, hate rap). Was anyone actually hurt in any way, shape, or form by this incident? Certainly not the business - because other than the youths who were cited, there was no immediate business. I find it difficult to understand that the State of Utah was willing to spend taxpayers money to send a police officer after these four hard-core criminals.
wait, the kids were placing an order and there were no cars in line behind them.... Are you telling me that if I place an order (speaking not singing) but I speak very slowly I am interfering with doing business too? They were placing an order the employee could just have taken it - what about the case of people that stutter but won't stutter when singing or rapping? Wouldn't they then have the right to sing their order to the benefit of all? If it were me taking the order I would have appreciated the humor and it surely would have put a smile on my face. I much rather this kind of teenage fun then destructive fun - kids have energy and need to use it....I do not see where the kids were being stupid, McDonalds on the other hand definitely overreacted - I would love it if the judge with dismiss this case and actually fined McDonalds for the waste of time and money it caused the taxpayers.... The police just acted according to the law, but they too could have left it with a warning (although I really do not know for what, but they could have done that...)
I guess McDonald's doesn't clown around anymore :-) Sorry, couldn't help myself.
Wow - what happened to McDonald's?
When I was a teen way back in the 70's, McDonald's had a promotion with the 'Big Mac' jingle. If you could sing it in under 10 seconds (or something like that) you got a free Big Mac (or fries, or something). Obviously back then they actually WANTED you to SING your order....
That's the problem with Society these days.
No one is held responsible when they do something stupid.
So what should I do when someone can't decide what they want off the menu (not exactly rocket science) and is holding me up in line? Will the police be called because they can't choose between a burger or chicken? Or they got 3 fewer fries in this package than the other. Because not be ready to order when you get in line is just as stupid!! So let's just have a police task force that waits in fast food lines for the idiots who can't even order and have them all arrested!!
what a stupid waste of time. maybe the cops can get "footloose"II made. the town elders must be angry.
I agree completely. If they didn't stick around or tell the manager to f--themselves this should've been ingored. Not disurbing the peace if you stop when asked.
Obviously, those kids should have been tasered!! That would've taught them a lesson.
Look here brother, Who you jivin' with that Cozmik Debris?
Izzat a Real Poncho, or izzat a Sears Poncho?
Arresting someone for "rapping" is one thing, for making a nuisance and essentially disturbing or preventing commerce at a place of business is another.

I agree.. this issue is so stupid.. That manager needs to be fired for waisting my hard earned tax payers money... So if it is against the law to hold up a line, the i can technically call the poice or ask a Mcdonalds manager to have a customer arrested because they are takeing to long to complete their order.. Cause waiting in line to lone is a violation of my Mcdonalds ordering rites... I sure hope the parents of those boys has a long talk with them as well as some choice words for that manager.. To the cops who may read this.. stop waisting our tax money on stupid @!$%#.. I always wait way to long at a mcdonalds drive through. Maybe I should call the cop and the people taking the order and have them cited and arested...
Have you guys actually heard the rap? It's pretty catchy really. When it first came out I heard that if you sang it at a McDonald's drive thru you'd get a free burger, but now they're citing kids for singing it? What's up with that?
if they had chosen a different genre of music say accapella, country or show-tune would they still have been cited?
The police refuse to act on reports all the time based on nothing more than their perspective of what they hear from witnesses. This should have never become official
But attorney Kasey Wright, who represented American Fork in court Wednesday, said the case isn't about free speech.
"This is not a First Amendment case," he said. "This is disturbing the peace. It's interrupting a business."
This guy is an idiot. Did they damage the property or steal anything? No? Then give me a break. It would be one thing if the restraunt called the cops and the cops arrived to find a bunch of kids causing a problem. But unless there's a lot more to this story, all I see here is a long list of idiots, the cops involved, the McDonals manager, and the town that just needs to let this drop quickly.
Wright said he's open to working out a deal in the case "if it can serve the demands of justice and the public interest."
The "demands of justice and the public interest"??? Are you serious? I wouldn't take a deal either, dragging this out longer makes you look like more and more of an idiot.
If the manager at Micky"The Crack Cop Kill'n" D's didn't didn't like the crap, he didn't have to serve them.
RAP "that is CRAP, that you can't "C"", started out as cop killer music. So if generation "DUMB,FAT, and LAZY" wants their super sized bag of garbage, then maybe they should learn that not everyone wants to listen to C"RAP"(CRAP).
Remenber the sign that states,
NO SHIRT!
NO SHOES!
NO SERVICE!
Maybe, NO C"RAP"(CRAP), should be added to it!
Everyone whines about respect but the truth be told this citation will lose respect among those four youths because it shows a lack of judgement on the part of the officer. He could have just as well talked to the young men and said "poor decesion making skills this time but not a big deal, just try to not let it happen again. Kids warned, McDonalds Happy and Police Department not looking like a bunch of out of touch boobs. McDonalds must just be reeling from the publicity nightmare this is creating. "Make it go away, Make it go away."
Simple solution.
Every teen and preteen in the area stop going to that restaurant. I'm sure that the other restaurants in the area could use the business. Not to mention the complaining manager of the McDonalds could explain the drop in revenue to his bosses.
Absolutely, Brian K, as there is no justification for the police reacting in this manner. Teenagers would respect the police officers and the law if they had been given a warning. Oh, do I remember my two boys and the foolishness. The officer would just bring them home. Actually, I think it is pretty cute that they rapped their order - wish I had been there.
I have the video saved to one of my email folders, it's hilarious. I've shared it with allot of people. MickeyDee's was just nit picking that day, those boys didn't cuss, and they were not rude.
unbelievable! I might hate rap but this is totally wrong from the point that they even called the cops, but even then to site them and take it to court! they were just having a little harmless fun during lunch for the sound of it and when asked, they left. so what did they do wrong then that is worth all this?
and for a last comment, man Jerry-352313 get a life! what, you were never a teenager and did something that others may not thought funny but did no harm at all? its not like they egged your car or teepeed your house! althought it sounds like you need it done! just lay off man, they are just kids being kids for crying out loud.
Maybe they got "uppity" with the police. We are only seeing one side of this.
That's true, but I mean really, how bad can it be? They were just trying to make the McDonald's people laugh. I probablly would have. WHy call the police in the first place?
I might not be a fair judge because I have six sons, but singing at McDonald's would have been mild compaired to some of the things I (and the boys) lived though. The police would bring one or more boys home and give them a talking to, but I can't imagine the police even bothering with this kind of deplorable behavior. LOL. Get a life McDonalds manager and Utah Police.
Oh for pete's sake....just chill and sing along with them...er..rap with them...kids...like no one was ever a kid before..and if this is the worse they do....then have fun.....we live in a very uptight world these days.
kids having fun, Manager who obviously hates the youtube video and must not have been too busy, since he took all the info for the police, police with nothing to do, and court system with no sense than to throw the case out...welcome to Utah.
good point, if they were so busy, how did he have time to take down the information.
I cannot believe that the taxpayers of Utah are standing for such a blatant waste of the taxpayers money. If in fact there were no other customers on line, how were they interferring with a business? It is obvious that McDonalds thinks so little of their customers to pursue this. And the local government must really need the money to waste the gas in the police cruiser to pursue this dangerous felons. Someone needs to get a life and I don't think it is the kids
What blatant waste are you talking about?
It's not like the cops only get paid when they do something, they're getting paid whether they answer the call or not. Not going to the McDonalds on the complaint would not have saved the taxpayers one red cent.
Depends. The first story said they were told repeatedly to stop and they refused. Now it sounds like they did it once, stopped when told and left.
If they stopped when told and left, then give em a scare and send em home.
They had to be told several times, charge em.
I have 10 years of management experience. Annoying customers are a part of life, its what you get paid for.
Calling the police is excessive, and unneccessary. I deal with hundreds of cars a day, about 30% don't turn off their stereos, or are talking on their phones while ordering...should I start calling the cops on them too?
"If they stopped when told and left, then give em a scare and send em home."
If they really left when asked, then I don't see why they deserve even a 'scare'. They did nothing wrong. Last I checked, joviality is no crime.
Embarassing story, in any case.
The Police weren't there at the time and made the wrong decision to believe the McSupervisor. It sounds like Utah is a borring place. Soo boring they are chasing teenagers who rap their order in a fast food place. Now how dumb does this sound? Terrorist lurking, Healthcare, Iraq, Afganistan and real criminal activity in Utah like drug distribution????? Charges w/be dropped and the police a laughing stock for filing the complaint and charges. Gotta be right wingers lurking here.
? What kind of comment is that to hid behind MORSAW. Your bigotry shines through.
Right on, Mormon people are ALL RACIST BIGOTS! Who have multiple white wifes, worship GW Bush and Orrin Nazihatch and they molest children yearning for that zion (penis). They own corrupt companies such as Slaveway Randalls. Have you ever seen a Hispanic Mormon? I will give you some time to think about answering that question. How about an Asian Mormon? The correct answer is NO. They only had 1 African American join their fellowship and it took until 1978 to "allow blacks in their churches" (they outdid MC Bigot Jerry Fartwell) The mother is committing treason by not filling a lawsuit against McDonalds to pay for their Bologna trial and hiring their sons defense attorneys. I would at least call Jesse Jackson because it was about rap, could it be reasonable to believe that if they displayed the song as country would the officer cite them? no Even though the kids are white they can sue McDonalds for racial discrimination because blacents and ebonics and slang are culture in nature among black racial tribes McDonalds supervisor committed the racist act by calling the police because he was rapping and after they left when told he insisted on filing charges. Add 1 count of Harassment and 1 count of wrongful arrest if they were detained. The mother should sue for at least 1 million dollars in punitive damages unless tort reform was past by the NaziTah's Repubinazis. I wonder if the court has the flag of the fuhrer in the court room. The kids should do a hi Hitler salute to the Judge after the guilty verdict has been read followed by fkk you puritans. (I wonder if they will get the death penalty for doing that.)
" Have you ever seen a Hispanic Mormon? I will give you some time to think about answering that question "
I don't have to think about that very long, considering that Mexicans are from the Spanish take over of central and south america. The catholic influence upon the hispanics is overwelming, just like the mormon's control Utah.
So, how many catholic churchs are there in OGDEN, beside the one's the momon's burned down.
"How about an Asian Mormon?"
One of my good friends from college and her entire Chinese family are Mormons in SLC.
I am surprised the red neck cop did not taser them. McDonald's sucks even before this incident.
A redneck is a farmer! How could this cop be a farmer and a cop? People use the word redneck for anything and everything and it is actually a farmer! You know, the sun beating on the back of his neck!
You might check a dictionary before you correct people on their use of words. "narrow, prejudiced, or reactionary: a redneck attitude."

–adjective
3.
Also, red-necked. narrow, prejudiced, or reactionary: a redneck attitude.
that might be where the term redneck originated but now it means white trash dead beat uneducated hillbillies, but that doesn't stop rednecks from being proud(git' r' dun) it's stupid really a whole class of people proud of their social shortcomings. no better than people that think its "gangsta" to live in a ghetto and hustle crack all day while their families fall to pieces but hey.....somewhere the real news is rolling in it's grave.....
"it's stupid really a whole class of people proud of their social shortcomings"
Ebonics comes to mind when you say that.... what a shame THAT was...trying to dumb down the school system for the inner city kids, instead of helping them reach their full potential!
Give me a break they got cited for rapping McDonald's owes those kids some gift certificates and an apology.
This is stupid. I think the store manager needs to up his meds. No police should have been called, no report, no DA or judge or court time involved.
Kids rapping an order at a fast-food restaurant? Sounds like fun-like an idea for a commercial. I would like to know kids whose idea of fun doesn't include guns or drugs, but singing.
I wish I could be in that court-room to congratulate the kids when this is thrown out and everyone goes home.
Knowing how (*&^ up Utah is though, they may shoot them at dawn.
PS I am a grandmother, with a singing family!
What is with everyone hatin on Utah? This is not a thing that happens all the time jsut a case of one uptight person who doesn't know how to have fun! I live in Utah and my husband and I always have a little fun when we go through drive throughs everyone laughs and has fun! So do't blame it on all of Utah because this isn't happening all over Utah!
kisses4cc post #10.1,
"I live in Utah and my husband and I always have a little fun when we go through drive throughs everyone laughs and has fun!"
You better not try that at McDummys, the busy Stupidviser will take the time to write down your license number, and report you to the busy police; who will take the time to chase you down and cite you.
They have nothing more important to do.
What a bunch of Dummy's.
Well, now I sure have heard everything-
A fast food order you cannot sing -
Next time kids try Burger King!!!
BOO McDonalds!!
Well just another case of the cops pulling outh thier favorite charge. It si hard to beat them in court. They use it if you standing on the street minding your own business. Hmmmmm wonder if rapping is against the law there.
The Truth is Now, IT IS NaziTah is a racist state that black people and hispanics don't live in. That is where the Ku Klux Klan congregates, and the favorite state of vacation for George W Bush, Bill O'Reilly, and Sean Hannity. That is where Faux News is on the free local digital tv stations. They probably have several channels airing the following lineup Hitler,O'Reilly Factor, Liberty University reruns, Lenin, John Hagee, Jimmy Swaggart, Stalin, Jack Abrnaoff live from prison, Pat Roberson and paid advertising by Rush Limbaugh "How to: Doctor Shop" ALL ON ONE NETWORK!
I have never heard of anything more rediculous in my life. Can't kids have fun anymore. My husband cussed out a burger king worker once for making him repeat his order over and over the kid couldn't understand. When my husband drove thru the drive-thru my girls and I were so embarrassed that we through brown paper bags over our heads and waved as we drove by. It's a good thing we didn't get arrested. We laugh everytime we think of that night. It's a shame things have come to this. And yes as adults we toilet papered our daughters coach's house!
You are my kind of Grandma GMA4, I am also a GMA5 and more people need to laugh and not take life so seriously. Kids can stop good clean fun and spend more time in parked cars steaming up windows, setting fires freebasing or something equally nasty like rapping at MickyDees.
The kids were being 'wise guy' idoits ! They thought it was 'cute', and funny; but, most adults, and ownere/managers of businesses, would not be amused ! Kick them out, and ask, not to come back. The charges should not hold, unless they are changed to 'idiot on display', which would have to be admitted in court !
And, McDonald's is not for kids, friarjac? Since when? Remember the clown, the slide, and the toys or do you get happy meals?
What a mundane existence you must lead if even so negligible a deviation from the norm as singing an order is called idiotic. It's a dumpy fastfood chain, not the Senate.
"most adults, and ownere/managers of businesses, would not be [amused]"
I doubt this very much.
This is the most assinine thing I've heard of; if I was these kids I'd never step foot on Mcdonald's property again, and the same for the parents of these boys. I could see the supervisor complaining, and understand if there had been a line of cars but from what I read the boys were the only one's there.
I feel the police should have tracked the kids down...if no other reason than because the Mcdonalds filed a complaint. That is how it works. A complaint is made and charges are filed. then all the parties go to court and it is decided who is right.
However, if this McDonalds knows what's good for them they would drop the charges and even hold a teen rap event in the parking lot or something. if these kids actually get punished they are going to make a name for them selves very fast. Teenagers can be vengeful creatures...I only hope it isn't too late for them.
Give me a break!!!! If it were my restaurant, I would tell the kids that I would only serve them if they stoped singing and placed their order. If they refused, I would ignore them as long as they were not holding up traffic and not bothering other customers. If they were being ignorant and continued to stop customers from purchasing my product, I would then call the police to remove them. Arresting them seems just stupid. Seems more like an official wants to be noticed.
Harry
Lottie-dah
Lottie-dah is right...cops NEVER should have been called, but since they were...the KIDS SHOULD SUE FOR FREE SPEECH RIGHTS...MCDONALDS SHOULD BE SUED...THE MANAGER SHOULD BE SUED...THEN...THE TOWN SHOULD APOLOGIZE.
ok... McD being sued... I can see that (sue the manager and franchisee - you can't sue McD Corp 'cuz they don't own the restaurant).
sue the cop? Depends on whether the cop pressed the citation, or was forced to by the McD manager laying a complaint.
Sue the town??? WTF? Why should the TOWN apologize? Did the mayor insult the kids? Give the police sensitivity training, maybe, but force the TOWN to apologize - ridiculous!
