My biggest question is, what kind of information about the train and transit system could this guy have given them that isn't public knowledge or easily researched through the internet or public records? Is there something about the transportation system that is "TOP SECRET" and this guy would have privy to that information?
I want to know, what kind of person defends guys like this??
There will be lawyers standing in line to defend him. If the hold the trial in LA, they can probably get him off.
He was probably abused as a child and came from a poor home and best of all, it is Bush's fault he turned.

Not just an American but one of many just like him.
This an easy 4 step process:
1) Transport back to the US
2) Judiciously convict
3) Give the death penalty
4) Execute
It will take millions of dollars to take him to trial, and his lawyer will get richer from it. Then, if he gets the death penalty, it will take another 15 years of appeals to enforce it, at the cost of millions of dollars again.
That's what's wrong in America. The system is broke. In the old days, he would've been hung at sunrise if found guilty of this. That's another reason you didn't see as much of it, either.
No US citizen will ever defend these actions, if true he is a traitor in the truest definition of the word. And by US law can be executed for treason. What is needed is a trial. Should what has been stated be true, let it be open, and fair. What is not wanted is a shroud of secrecy, torture, or any immoral behaviour on our part. If we can establish these items justice will be served. We need to expect this out of ourselves so that we can expect this from our enemies.

The combat veteran's who captured him were the same who actually faced the rocket barrage, they could have very easily executed him on the spot. The world would very probable never known anything. Instead they had the guts, and professionalism to do the right thing, and probable under extreme duress.

Your reasoning is noble and very much the hope of the land but "idealism" carries inherent flaws. Sometimes, the answer to the obviously "no" queries are "yes" when the "enemy" takes advantage of the flaws and uses them as weakness. The short answer is that this guy does need a trial because he was captured...rather than killed on the spot. I do not know if the troops knew who this guy was when they captured him or what they would have done if they did know. It really depends on the individual I suppose. If this guy goes to trial, is found "not guilty" and released, goes back and does carry out another act of aggression, would not have been pragmatic to have chosen otherwise. I know we cannot armchair quarterback or speculate and whatever decision made by the troops that captured him: it would not be my place to judge.

IF this is true, he certainly deserves the firing squad or short rope. But remember, sometimes things are not quite true - how the American football player was supposedly shot in an ambush, then it turned out it was "friendly" fire that killed him. We all may not like it, but that's what courts are for - try and establish truth. And even if it is not what you like, he does deserve somebody to represent him, to try and show the case from both sides. But having said that, some lawyers do a real and fair job, and others try to use every slimy trick to get their client off. Kind of like the difference between rape and a prostitute - same activity, but is it something you are forced to do, or are you enjoying?

Why does everyone on this board seem to think that the US uses hanging or firing squads to execute people? Federal death penalties are by lethal injection or by the method of the state the crime was committed in. New York no longer has the death penalty.

You are right, everyone deserves a fair trial. If we can't provide that, then we are no better than despots. Even Nazi leaders received a fair trial, which is much better than they provided to their victims.
It is not be out of concern for our enemies comfort and welfare that we do this, but for the sake of our own moral and ethical souls. We must not become the same kind of animals that these people have become.
I hope they throw the book at him and het gets the full 90 days of probation that Eric holder thinks a terrorist should get.
What has he done that your average Media Reporter hasn't done with providing information to the enemy? They tell the enemy our every move, the locations of our Troops, etc. etc...
Remember the Walker case? He cut a deal so that hw owuld not be executed and that his son might be paroled for his completecandor in what informatio had been handed over and to whom. Sounds like this weasel did the same.

Isn't it interesting how so many people accept this story at face value and start calling for the death penalty or something even worse, without thinking about a few important details. First , how could this guy be close enough during the rocket attack to be positively identified, yet escape and not be captured until weeks later in another country? Was he using personalized rockets, or did he drop his drivers license at the scene of the attack?
Second, I don't think the NYC subway system is a classified installation. Was he a former transit employee who might have had useful inside knowledge terrorists could exploit?The story doesn't say. Anyone can learn a lot about NYC transit by buying a $2 token and riding it, getting an online route map, or watching the movie Pelham 123. Is it criminal to talk about generally available public knowledge? Was he giving critical information or just suggesting what routes to avoid during rush hour?
Obviously the guy was involved with Al Quaida and up to no good, but stories like this should provide facts that make sense and do more than stir up a lynch mob mentality among the readers.
While I was writing the above comment the story was updated and completely re-written. Now it appears the man is a witness assisting in other investigations. It will be interesting to see how many more changes in the story pop up before it disappears forever, leaving only the vague impression that we can sleep well, our government is protecting us from, from- well something bad.

Even if this low life is convicted of treason, attempted murder, and terrorism, he has a friend in the White House.
